10/07/2010 FRODRIG2 TUCSON WATER NEW AREA DEVELOPMENT REVIEW Denied The New Development section of Tucson Water has reviewed the subject plan and has the following comment(s).

Sheets 2 and 3 of the proposed plat map for the Mission district mis-labels the 30' reclaimed water easement as Dk 8974, Pg 1515, it should read Dk 12084 at Pg 380. In July at the request of Gadsden, Tucson Water operations and survey personnel physically excavated the 36" reclaimed main and re-surveyed the alignment of the pipe. We concluded that the pipe resides entirely within the 30' easement called out in Docket 12084 on Pages 380-382.

Additionally, the abandonment process can not be used on the Reclaimed Water Easement (Dk 12084, Pg 380) since there is an active reclaimed transmission main in place. This easement can only be abandoned after a new easement has been established and the active line has been relocated out of the existing easement area.

Consequently, Tucson Water objects to this proposed plat as submitted.

Cover Sheet:

1. Acknowledgement: Please delete the existing text and place the following between "appeared" and "executed": "Robert E. Walkup, who acknowledged himself to be the Mayor of the City of Tucson, and being authorized to do so,"

2. General Note #5: The bearing differs by one second from that indicated on Sheet 2 and Sheet 3. Please correct the discrepancy.

3. General Note #6: Delete. There are several possible forms of plans (plats, development plans, site plans, etc.) which enable development and it is understood that further plans are required.

4. Add a note under the heading "Abandonment of Rights-Of-Way and Ingress/Egress Easements": "By approval and acceptance of this plat, the City of Tucson hereby abandons that certain right-of-way dedicated as Avenida Acequia Primera and those certain ingress/egress easements identified herein as being abandoned by this plat."
