Engineering Division of Planning & Development Services Department has received and reviewed the documents and recommends conditional approval of the Development Package with the following conditions to be addressed. FINAL PLAT CONDITIONS OF APPROVAL: 1) DS Sec.2-03.6.5.B: Assure that all easements listed on the revised Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Specifically also address the remaining comments on sheet 2 of plat regarding schedule B: a) Delineate drainage easement Dkt.13578 pg.5494 per Schedule B item 9 and label as to be abandoned by separate instrument. Also show new drainage easement for realigned stormdrain. b) Clarify dimensioning of fire access easement on north portion of plat. Note can remain regarding easement however the final plat shall have all lines dimensioned with curve data for the public access easement provided. c) Submit most recent title report with schedule B. 2) DS Sec.2-01.3.9.L, DS Sec.7-01.4: PDSD Engineering reviews easements for permitting & construction issues and is awaiting Fiber Optic Utility acknowledgement as indicated in Schedule B 27 North Parcel item (e). 3) DS Sec.2-03.6.6: The CC&R's need clarification in section 5.1 that fiber optic lines will not have easement rights under the Limited Common Elements. 4) DS Sec.2-01.3.8.B: As shown on the Development Package, and in response letter it was stated, that there is an encroachment into the stormdrain easement by the building structure in the location of the stairwell at the south corner: The stormdrain easement needs to be realigned and reflected on the plat. Abandonment of the old easement is also required. 5) DS Sec.2-03.7.1.G: Replace the Assurance paragraph on sheet 1 with: "Any transfer of the property to a non-City of Tucson entity may require the submittal of an assurance or other surety as the City of Tucson deems necessary and proper."
