An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before August 16, 2011. 2. Zoning cannot approve the Final Plat until Development Plan D10-0022 has been approved. 3. The proposed Plat does not match what is shown on Development Plan D10-0022. Ensure that the Plat and Development Plan match on your next submittal. 4. D.S. 2-03.6.1.K Place the S10-034 subdivision case number in the lower right corner of the plat next to the title block. 5. The Condominium Declaration title should match the title block of the final plat, "PLAZA CENTRO GARAGE, UNITS 1-23 AND COMMON ELEMENT "1" (ACCESS LANES AND OTHER COMMON ELEMENTS)" 6. Based on the definition of "COMMON ELEMENTS" provided in the Condominium Declaration it does not appear that "PUBLIC" access for parking and pedestrians has been addressed. Engineering Division of Planning & Development Services Department has received and reviewed the documents and does not recommend approval of the Development Package until the following items are addressed. FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.5.C.1: Basis of bearings - The purpose of the basis of bearings on a survey is to enable another surveyor to retrace the original survey. As such, the statement must be referenced to found, readily locatable monuments. There are three general methods of establishing bearings. 2) DS Sec.2-03.6.1.K: Add the subdivision case number in the lower right corner of the plat next to the title block on each sheet. Since the property is subject to a rezoning case, add the C9-__-__ rezoning case number to each sheet. Add the Development Package case number to cover sheet. 3) DS Sec.2-03.6.5.B: Assure that all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Specifically also address the following comments on sheet 2 of plat regarding schedule B: a) Label & delineate utilities/pedestrian easement Dkt.13578 pg.5494 per Schedule B item 10. b) Delineate drainage easement Dkt.13578 pg.5494 per Schedule B item 9. c) Clarify dimensioning of fire access easement on north portion of plat. d) In response letter, please state whether the items (8-10, 16, 21-24, & 27) of Schedule B are shown on the plat. e) Clarify in response letter or with an easement the fiber optic line indicated in 27 North Parcel item (e). f) Provide ALTA that addresses all items listed in item 27 of schedule B. 4) DS Sec.2-01.3.9.L: All proposed easements are to be dimensioned and labeled as to their purposes and whether they will be public or private. 5) DS Sec.2-03.6.5.B: Indicate parcel delineations for parcels 117-06-562C and 117-06-081D, and proposed project boundary with accurate dimensions, bearings, or deflection angles and radii, arcs, and central angles of all curves. Explain in response letter and show on plan/in note how these areas are lot-combined or parcel property lines are revised. 6) DS Sec.2-01.3.8.B: Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided. 7) DS Sec.2-01: Clarify if boundary data is measured, recorded or calculated on the development package on sheet 1 as a note, or label on planview on site plan sheets or base layer. 8) DS Sec.2-03.6.5.C.1: The basis of bearings needs clarification. Address the following comments: a) The tie from the basis of bearings to the project corner must be clarified on sheet 2. b) Dimension the distance within line L1 to L2. c) Leader line and monument RLS 18211 in Basis of bearing detail needs clarification of location. d) A basis line and a basis of bearing line are labeled on sheet 2 and on sheet 1 a different basis of bearing is listed. Clarify. 9) DS Sec.2-03.6.3.B: The title report indicates OT Kino LLC and City of Tucson as owners - clarify on dedication paragraph. Provide additional documentation regarding Parkwise owning the property. 10) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Submit assurances. 11) Sec.10-02.14.3.2. The CC&R's or Final Plat shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. Per Standards Manual for Drainage Design and Floodplain Management, the drainage area maintenance and responsibility verbiage from DS Sec.10-02.14.3.2.a-d (above as well as DS Sec.10-02.14.3.3 must be included on the CC&R's, or placed on the Final Plat. 12) DS Sec.2-03.6.6.B: List conditions of rezoning and verify compliance. 13) DS Sec.2-03.6.3.E: Update Assurances block on sheet 1: City of Tucson Planning & Development Services Department Director, City of Tucson Planning & Development Services Engineering Administrator. CC&R's and assurances will be re-reviewed upon next submittal. Please provide revised Final Plat sheets, ALTA survey, CC&R's, title report, rezoning conditions, assurance package, and a comprehensive response letter that addresses in detail responses to all of the above comments.
