COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a tentative plat. If, at the end of that time, the tentative plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is February 24, 2011.

2. After reviewing the legend and keynotes it was noticed that several of the key notes and demolition keynotes were not pointing to the correct object assigned to the keynote or the key note numbers and symbol were placed in the wrong location. Review and correct all affected key note symbols. DS 2-03.2.1.J

3. This project has been assigned the CDRC subdivision case number S10-006. List the case number in the lower right corner of all plan sheets including the landscape and NPPO sheets. The case number listed on the plan S07-111 is not applicable to this project. Remove the case number from all sheets. DS 2-03.2.B.1

4. Add to general note one the rezoning case number C9-05-08 as follows; "Proposed zoning is R-1 per rezoning case C9-05-08, see sheet 4 for a list of rezoning conditions."

7. Add the following note "The following lots are affected by the City of Tucson Floodplain regulations" List the lots affected by lot number. DS 2-03.2.2.C.2.a

8. If applicable add the following note, "A floodplain use permit and/or finished floor elevation certificates are required for the following lots: __________." (List the lots affected by lot number.) DS 2-03.2.2.C.2.b

9. If applicable, "If the applications includes property with Protected Riparian Area within the 100-year floodplain shall conform to Development Standard 9-06 and shall include a note referencing all lots impacted, and state that the plat is designed to comply with the regulation." DS 2-03.2.2.C.3

10. Please review and correct the private street total listed in general note 8. I believe the total should be .11 miles. DS 2-03.2.2.D.1.b

11. Correct on sheet 1 and 2 the bearing adjacent to lots 11-13. The bearing is labeled as S E it should be S W. DS 2-03.2.3.B

12. If applicable to this site, all existing easements will be drawn on the plat, and recordation information, locations, widths, and purposes shall be included. If the easement is not in use and proposed for abandonment, so indicate. Blanket easements should be listed in the notes, together with recordation data and their proposed status. DS 2-03.2.3.C

13. Per the drawing the street is to be private. The private street should also be labeled with a Common Area Designation, such as Common Area "B". List the common area for the private street in the title block. DS 2-03.2.4.C

14. Identify and provide dimensions, approximate areas in square footage, and purposes of any lots proposed for dedication (such as open spaces, recreation areas, or natural areas) or for reservation for a public use (such as public parks, water facilities, or school sites). It is requested that the area to be dedicated to the City of Tucson also be drawn on the plan. DS 2-03.2.4.I

15. If applicable, all proposed easements (utility, sewer, drainage, access, etc.) are to be dimensioned and labeled as to their purposes and whether they will be public or private. DS 2-03.2.4.J


16. Correct the following typos in the general notes section sheet one (1) as follows.

a. General note 3, revise the word 'assignees" to "assigns".

b. Correct the typos in general note 10, for the word "standards" in the 3rd sentence and the word "the" 5th sentence.

c. Revise General note as follows; "All amenities and improvements must be completed when no more than fifty percent (50%) of the residential units served by the project amenities and site improvements are constructed"

d. Revise general note 18; Development standard 2-13 has been renumbered to development standard 9-06. Revise the note to reflect the new development standard section.

e. General note 20 is repeat note of general note 16, remove one or the other.

f. Correct the word "through" in general note 23.

g. Replace the mechanical note under the FLD text box with the new text per LUC section 3.6.1.5.B.5; "Mechanical equipment, utility boxes, irrigation equipment and similar elements shall be screened from adjacent streets exterior to the project and from adjacent existing residential development. Screening shall be architecturally integrated with the overall design of the FLD."

17. Clearly delineate the proposed functional open space 2 and sheet 3. LUC section 3.6.1.4.D.1.a

18. Add the following note; "Where a perimeter wall is proposed along a public right-of-way, it shall be constructed of, or painted with, graffiti-resistant materials. The wall shall incorporate one or more of the following decorative materials:" LUC section 3.6.1.5.B.6

19. Revise the setbacks under note one (1) as follows; remove side loading garage or carport from the note. Per your site design on sheet 4 it does not appear that side loaded garages or carports will be proposed. If this is not the case leave the note in as listed. In addition the note for the 19 foot setback is for a front loaded garage or carport. Separate and revise the note to state that the front loaded garage or carport setback is based on the greatest of 18 feet from the property line or 19 feet from the back of the sidewalk. DLUC section 3.6.1.5.C.2

20. Clarify where and what the proposed slope is for the pedestrian access to the common area facilities. LUC section 3.6.1.5.G.2, .3 and .5

21. CC&R's will be required for this project. If they are available for review please submit a copy with the next submittal. LUC section 3.6.1.7

22. Provide a separate response memo detailing how all the rezoning conditions have been addressed. It is clear on the plan that some of the conditions have not been depicted on the plan.

23. Additional comments may be forthcoming based on the response and revisions to the plans.

Community Planning staff offers the following comments:
The proposed tentative plat shall be in substantial compliance with rezoning case C9-05-08, including the conceptual land plan provided to Mayor and Council at the rezoning hearing on March 27, 2007. Also, shall comply with the LUC, Flexible Lot Development (FLD) requirements.

1. Please revise tentative plat, sheet 1 of 4, general note # 17 to reflect "flexible lot development" (FLD), instead of the previous "residential cluster project" (RCP) requirement (See general note #3).

2. Please revise landscape plan, sheet LS1 and tentative plat, sheet 4 of 4 (Detail "M"), to identify within Common Area "A", the land area to be calculated as "functional open space." Identified area to equal 6,878 sq.ft, as indicated on tentative plat, sheet 1. Please include a legend that provides a symbol such as a cross-hatch pattern or other means of identifying the functional open space. Landscape plan, sheet LS1, and tentative plat, sheet 4 of 4 (Detail "M"), to provide the actual calculation break down of 6,878 sq. ft., to reflect tentative plat, sheet 1, Site Calculations R1 (4.45 Acres) note #2.

3. Rezoning condition #6 requires a trail easement along the Pantano Wash and shall be constructed as determined by City of Tucson Parks and Recreation Department. Provide documentation that the City of Tucson Parks and Recreation Department is reviewing this requirement. Based on Parks and Recreation direction, please revise landscape plan, sheet LS1 to include the pedestrian path/easement, to be designed for both pedestrian and bicycle use. An example of this trail is identified in the rezoning concept land plan, sheet SD2. The pedestrian path is within Common Area "A" and along the south boundary of the site adjacent to lots 14 through 17. An all-weather pedestrian path is required to each amenity (bench) within Common Area "A." These revision should address any conflicts with the proposed grading plan.

4. Please revise development plan and landscape plan where appropriate to address rezoning condition # 8. Please provide documentation that the Pima County Parks and Recreation Department is currently reviewing tentative plat S10-006, as it relates to rezoning condition #8.

5. Please revise development plan and landscape plan to address pedestrian safety issue since the proposed pedestrian path and vehicle service/maintenance road within Common Area "A." are one and the same with no safety separation. Please provide barriers between the two distinct uses, such as bollards or other compatible durable structures.

6. Please revise development plan and landscape plan to address/comply with LUC, Flexible Lot Development (FLD) requirements under section 3.6.1.5.G.5 - Circulation and Connectivity.

7. Please revise landscape plan to comply with Flexible Lot Development (FLD), requirement under the LUC, Section 3.6.1.5.B.2 - Landscaping, Screening and Wall requirements. Landscape plan does not comply with amount of trees required.

8. Please revise development plan and landscape plan to address/comply with LUC, Flexible Lot Development (FLD) requirements under section 3.6.1.6.B. - Architectural Variation. Must also comply with rezoning condition #10, 11, 12, 13, & 14.

9. The proposed floor plans for Models A, B, C, & D are not in compliance with 3.6.1.6.B.3.c.

10. Per LUC, Section 3.6.1.6.B.4, please submit an Architectural Variation Plan (AVP), for Model A, B, C, & D. Must also comply with rezoning condition #10, 11, 12, 13, &14.

1. Along Escalante Road schematically illustrate the transition of the parking lane to the existing edge of pavement at the East End of the project.

RESUBMITTAL REQUIRED: Tentative Plat and Drainage Report.

The Tentative Plat (TP) and Drainage Report (DR) cannot be approved as submitted. Please address the following review comments prior to the next submittal.

Tentative Plat:

1. Please include a response letter to the comments along with the corrected copies of the TP.
2. This subdivision is subject to numerous conditions, floodplain and drainage constraints. To develop this parcel in the manner shown, will be become engineering challenge to develop.
3. There is a large amount of bank protection required for the Pantano Wash and Escalante Wash to protect this subdivision in the occurrence of a 100-yr. flood event. A feasibility/cost analysis study for the subdivision is strongly suggested at this point due to the enormous cost associated with the bank protection cost vs. the limited number of lots to be developed and sold.
4. It appears that this is a re-submittal of a previous TP with the City of Tucson activity no. S07-111. The rezoning conditions per the previous TP are still valid. Some of the rezoning conditions and comments that are listed in this comment letter are from the previous TP (S07-111) comments. Some of the old comments may have been updated to reflect today's current standards.
5. The Escalante Wash is labeled as a Xeroriparian Intermediate Habitat and an ERZ on the Tucson Department of Transportation maps. The W.A.S.H. ordinance regulations will apply for this wash. A mitigation plan will be required. Contact Patricia Gehland for more information at 837-4919.
6. Show the 50-foot study area (resources area) for parcels subject to the W.A.S.H. Ordinance. (Escalante Wash).
7. Per rezoning condition no. 2: The owner/developer shall design and construct street improvements along the frontage of Escalante Road. These improvements shall include an additional parking lane, curbs, sidewalks and curb access ramps. The owner/developer shall dedicate any additional right-of-way along the site frontage on Escalante Road to accommodate the street improvements being located within the public right of-way.
8. A permit or a private improvement agreement will be necessary for any work performed within the public right-of-way. Contact Permits and Codes at (520) 791-5100 for right-of-way permit information.
9. Per rezoning condition no. 3: The owner/developer shall design and construct bank protection/erosion prevention structure along the Pantano Wash and Escalante Wash as required. It seems that the bank protection shown is not adequate. See DR comments for more information.
10. Per rezoning condition no. 4: The natural area on the site shall include the 100-year floodplain of the Escalante Wash and the portions of the parcel to the east are to be rezoned. These areas shall be platted as natural undisturbed open space (NOUS) and shall be included in the Covenants, Conditions, and Restrictions (CCR's) as NUOS. The NOUS areas are only shown on the cover sheet, the entire NOUS areas to be dedicated per the final plat shall be shown on the TP with metes and bounds also.
11. Per the City of Tucson flood hazard maps, the COT flood hazard area encompassing the Escalante Wash shall be shown on the TP. Also show the EHS for the Escalante Wash per Chapter 26-7 of the floodplain ordinance and per Chapter 7 of the SMDDFM. The flood hazard maps are available on line on the new City of Tucson GIS map at: http://maps.tucsonaz.gov/dsdmain/dsdmain.html
12. The FEMA regulated floodplain limit for the Pantano Wash is not shown correctly per FEMA panel no. 04019C2270K Show the limits of the 100-year floodplain and water surface elevations per D.S. 2-02.2.1.15.
13. Per rezoning condition no. 5: The developer shall evaluate threshold retention alternatives in lieu of providing threshold retention. Water harvesting shall be incorporated into all alternatives.
14. Per rezoning condition no. 6: A trail easement along the Pantano Wash shall be constructed as determined by the City of Tucson Parks and Recreation Department. The dedication of a trail easement will be for public use and will allow for pedestrian and bicycle activity.
15. Per rezoning condition no. 7: The owner/developer shall provide a corridor a minimum of 50 feet wide along the bank of the Pantano Wash as measured from the top of the bank or bank protection, north. This condition affects the buildable areas of the lots on the south side of the subdivision.
16. Per rezoning condition no. 8: The owner/developer shall construct the subject segment of the Pantano River Park, as may be required by the Pima County Parks and Recreation Department for information and requirements.
17. Per rezoning condition no. 17: Amenities within parks/common areas/detention areas shall include park benches and/or picnic tables, barbeques, playground equipment, or similar passive/active equipment that can be used by residents. These areas will be made ADA accessible with a minimum five-foot wide path constructed of either stabilized DG, asphalt, or textured concrete. Show all proposed Amenities on the TP.
18. Please list estimated cut & fill quantities per D.S. 2-02.2.1.17.
19. Additional information on the detail for the bank protection is needed.
20. Add the basin(s) maintenance responsibility note per S.M.D.D.F.M. 2.3.1.6 C 1 and 2 to the TP.
21. Show the 50-foot study area (resources area) for parcels subject to the W.A.S.H. Ordinance.
22. A Stormwater pollution prevention plan (SWPPP) is required during Grading plan submittal.
23. Additional comments may be forth coming depending on the changes made to the DR and TP upon the re-submittal of the TP and DR.

Drainage Report:
1. Please include a response letter to the comments along with the corrected copies of the DR.
2. This review was performed for Tentative Plat purposes only.
3. Show the existing EHS for the Pantano Wash and the Escalante Wash per Chapter 26-7 of the floodplain ordinance and per Chapter 7 of the SMDDFM. See comment no. 8 above.
4. If the there are plans to change the FEMA flood plain limits, than Please a time table for completing a CLOMR and/or LOMR for the revision to the federally mapped Pantano Wash. This review was done assuming the acceptance of the CLOMR and/or LOMR by FEMA. Should the CLOMR be denied or significantly modified form it's present form, a new review will be required. The CLOMR and/or must obtained prior to the issuance of this permit.
5. The bank protection for the Pantano Wash and Escalante Wash must be constructed up to and beyond the EHS for both washes. A feasibility/cost analysis study for the subdivision is suggested at this point due to the enormous cost associated with the bank protection cost vs. the limited number of lots.
6. There are two depths given by two engineers for the scour depths for the bank protection. Please explain.
7. The equations used to determine the scour depth from the SMDDFM in the DR lack components, data and/or variables needed that must be in order to figure the proper depth. If the depth is determined to be less than 10', the accepted minimum depth for scour protection by the Pima County flood control district for regional watercourses, then 10' will be the min. depth of scour. However the scour protection depth may be significantly deeper since the depth is determined by the invert of the wash or the thalweg.
8. A geotechnical report will be required for the recommendation/determination, but not limited to, the length of the bank protection that reaches the EHS and beyond, soils stability/properties, hydrostatic pressure, percolation rates and weep holes.
9. A permit will be necessary for any work performed within the public drainage way of the Pantano Wash if applicable.
10. A backwater analysis is required at the confluence of the Pantano and Escalante Wash.
11. A recent field visit noticed an earthen channel from the dev. parcel to the East. Discuss and account for this significant amount of water coming onto the sight from the site.
12. Additional comments will be made, depending on the changes made to the DR and TP, upon the re-submittal of the TP and DR.
13. A $150.00 review fee for the Drainage Report is required.
14. Please show the project address on the cover of the Drainage report.

9) Revise the "Typical Street Landscaping" detail on LS-1 to include trees for Lots 7 and 22 in order to comply with rezoning condition 19 and note that one tree is required on every other lot adjacent to the sidewalk.

10) Revise the basin to comply with LUC 3.6.1.4.D.3.b.i and b.iii.

11) Per LUC 3.7.2.4.A.2.c The Escalante Road landscape border shall be recorded as common area.

12, Common areas are to be maintained by the homeowners association (HOA). The subdivision CC&Rs and shall reference the maintenance standards in Sec. 3.7.6.

Tucson Electric Power Company (TEP) has no objection to the preliminary plat submitted for review March 10, 2010.

This job will require a primary underground line extension on a loop system because of the amount of new homes being fed. There is hypothetical equipment placed on this tentative plat. The placement of this equipment is subject to change as the platting process proceeds. We may feed from the poles on the north end of the project on the south side of the street. There is however a conflict with the existing overhead lines and poles. Pole (1) appears to be in the turn lane and pole (2) is in the entrance to the subdivision. Engineering will be involved due to the angle in the existing pole line. This will be billable to the developer if relocating or removing any of the existing facilities is required. All monies are to be paid up front and are non refundable. The cost of the line extension to feed this project will be the total footage of all primary and secondary cable utilized, multiplied by $18.00 per foot. This money will also need to be paid up front and is non refundable. We will need a set of approved plans and load plans with a request from the customer for a preliminary layout.

Enclosed is a copy of TEP's facility map showing the approximate location and unit numbers of the existing facilities. Also enclosed is a copy of the tentative plat showing where TEP will be placing the aboveground equipment for this subdivision. This is not a preliminary design. TEP has provided this drawing to show where the proposed locations are for transformers and pedestals.

TEP will provide a preliminary electrical design on the Approved Tentative Plat within fifteen (15) working days upon receipt of the plat. Additional plans necessary for preparation of the design are: building plans including water, electrical, landscape, sidewalk and paving plans. The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Regional Wastewater Reclamation Department (PCRWRD).This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


1. Obtain a letter from the PCRWRD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

2. Sheet 2: Why are you proposing a new public manhole next to 9558-05 instead of tapping into the existing MH?

3. Sheet 2: Some of the lengths shown for the proposed sewer line segments in plan (per the scale of 1"= 40') do not match the distances shown in the New MH Table.

4. Sheet 2: The terminal reach for the proposed public sewer from MH 7 to MH 6 must be a minimum of 1% slope.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the tentative or preliminary plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.
