As of this final plat review date the tentative plat has not been approved therefore the one year date of the final plat approval is based on the date of submittal of the final plat documents. Once the tentative plat has been approved the approval date of the final plat will be on one year from the tentative plat approval date. This date will be provided on a future review of the final plat.

SUMMARY: Engineering Division of Planning and Development Services Department has received, Sheets 1 and 2 of the proposed Final Plat and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat and does not recommend approval of the Final Plat at this time. The following items need to be addressed:

FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.H.1: Revise the Title Block so that the name matches the proposed Tentative Plat; "Blocks 1-4."

2) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S09-081) in the lower right hand corner of the plans on all sheets.

3) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the rezoning case number (C9-09-10) associated with the project in the lower right hand corner of the plans on all sheets.

4) DS Sec.2-03.6.2.D: Provide a General Note to state that the property is subject to conditions of rezoning, add the following note: "This plat is subject to the conditions of rezoning case number C9-09-10, unless superseded by a subsequent rezoning ordinance."

5) DS Sec.2-03.6.3.B: Provide a copy of the Trust agreement referenced in the Dedication Paragraphs under Trust #1037.

6) DS Sec.2-03.6.4.A: Revise the Final Plat to remove the old abandoned easements and to only show all new proposed easements for access, drainage and utilities. Include with the Final Plat submittal the Docket and Page references for all easement abandonment that must take place prior to the Final Plat going to Mayor and Council. For easements that are to remain, but be abandoned in the future (16-foot sewer easement) label as such.

7) DS Sec.2-03.6.4.A: Revise the Final Plat to include the blank space for the Docket and Page for all new proposed easements that will be completed after Tentative Plat approval and prior to Final Mylar approval for the Final Plat.

8) DS Sec.2-03.6.4.A: Clearly label the required 1-foot no access easement along the west property line between Blocks 3 and 4, per the rezoning condition.

9) DS Sec.2-03.6.5.C.5: Revise the Final Plat to clearly indicate whether the distance and bearings between monuments were measured or calculated for all property line boundary information. This can be labeled in plan view are as a note within the General Note Section or Legend.

10) DS Sec.2-03.6.6: Provide a copy of the CC&R's or Easement Agreement for all new easements that are proposed under this plat. Very all maintenance and ownership has been clarified within the documents.

GENERAL COMMENTS:

Provide a revised Final Plat at re-submittal. The revised Final Plat must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.
