The Development Plan for this project was reviewed on October 7, 2009 and WAS NOT APPROVED. This Final Plat cannot be approved until the DP comments are addressed and the DP is approved.

The subject project has been reviewed. The project can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that where made and references the exact location on the Final Plat where the revisions were made:

1. The easement information shown on the plat does not match the easement information included in the title report (e.g. 16' Public Drainage Easement, 1' access control easement, etc. are not listed in the Title Report). Provide a revised title report that includes all the existing easements shown on the plat and revise the plat easement information in accordance with the title report information. Include recordation information, locations, dimensions and the easements purposes. In the response letter, please state whether the items (numbers) of Schedule B are shown on the plat and state the status of those easements that are to be abandoned or vacated.
2. The existing electrical easements do not appear to be needed. Additionally, it appears that the location of at least one of the electrical easements conflicts with the location of the proposed building. According to D.S. 7-01.4.0, "The interest of the City of Tucson is abandoned by recordation of the final plat. However, the interests of other entities may also have to be abandoned prior to recording the final plat". In D.S. 7-01.4.0.A, B and C, the process of abandonment is further explained. Verify compliance with D.S. 7-01.4.0.
3. The abandoned 1' access easement need not be shown on the plat, because it does not exist. Only show where the 1' no access easement is applicable.
4. The easement described in General Note #9 is described as the "CC & R's" in the Title Report. Clarify this issue and show the location of this easement on the Plat. Submit a revised Title Report that reflects this revision.
5. Submit a revised Title Report that clarifies Item #13 (i.e. Access Via 22nd Street and thru Common Area "A"). Show the location of this access and Common Area "A".

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of submittal to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before September 23, 2010. The Development plan must be approved prior to approval of the final plat. As of this final plat review the development plan has not been approved.

2. The previous comment was poorly written and should have instructed to have all reference case numbers out of the margins areas and listed in the lower right corner of all plan sheets next to the title block. Disregard the previous comment left as reference only. Revise the case numbers to reflect the new case numbers as follows, the development plan was assigned the new case number D09-0033 and the final plat has been assigned the new case number S09-059. Remove the old case numbers listed on the plan sheets of the development plan final plat sheets.

Previous comment 4: Relocate or add the development plan case number in the lower right corner of the plat sheets within the margins. All reference case numbers except the Book and Page" should within the margins next to the title block which should be in the lower right corner of all sheets.

Previous Comment 4: Case number S07-137 has been assigned to this final plat. Please place this number and the rezoning case number C9-96-10 in the right corner of all sheets of the final plat.

3. List the recording information for the 30-foot sewer easement.

Previous Comment 7: Ensure that existing or proposed easements depicted on the final plat are also depicted, labeled, dimensioned and recordation information added on the tentative plat.

4. General note one must be revised to reflect the actual square footage and acreage of the site based on the legal description of the property not from the centerlines of the streets. Revise General note accordingly.

5. Show detention/retention areas in a surveyable and readily retraceable manner.
