The Common Areas must be clearly defined with dims and bearings for each line. The name of, and Map and Plat of any adjacent subdivisions, unsubdivided property should be labeled “unsubdivided”. The Final Plat cannot be approved as submitted. Please address the following review comments prior to the next submittal. Final Plat: 1. Please include a response letter to the comments along with the corrected copies of the Final Plat. 2. Assure that all common elements are used for sole use. 3. Project-location map drawn in the upper right corner of the first sheet shall provide the following information: 4. Identify major watercourse within the square mile area. 5. DS Sec.2-03.6.1.H.1: Verify that the title block on the proposed Final Plat and/or all applicable wording in the CC&R's to match each other. All names, common elements, limited common elements, and descriptions must have the same wording in the CC&R's as in the Title Block. 6. The S09-016 subdivision case number assigned to the approved tentative plat will be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also. 7. If the property is subject to conditions of rezoning, add the following note: "This plat is subject to the conditions of rezoning case number C9-__-__, unless superseded by a subsequent rezoning ordinance." 8. This property is subject to floodplain requirements, add the following note: "Prior to issuance of any future building permits will require a Floodplain Use Permit for Lots 1-10." 9. Enclose each common element with a solid line each common area, private street, etc., that will have separate restrictions or a separate homeowners' association. 10. Ensure that each common element include, labeled square footage. 11. Add general note that states, "Property is located 100% within FEMA Zone AE". Provide FIRM Panel number in a general note on plan. 12. Show any detention/retention areas in a surveyable and readily retraceable manner in a separate common element. 13. Indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Where a coordinate system has been established by the City Engineer or County Engineer, primary control points may be referenced thereto. At least one (1) corner of the subdivision will be tied by course and distance to a section corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. Specifically call out section corner to tie (ie ¼ or 1/16). 14. Indicate tract boundary lines; right-of-way and centerlines of streets, easements, and other rights-of-way; and property lines of residential lots and other sites, with accurate dimensions, bearings, or deflection angles and radii, arcs, and central angles of all curves. 15. All boundary monumentation must be labeled as "found" or "set." a. Fully describe and show all markings on found monuments. b. A one-half (½) inch iron rod tagged by a registered land surveyor will be set at all corners upon completion of construction. 16. Please submit a copy of the subdivision boundary closure calculations. 17. DS Sec.2-03.6.4.A: Revise the Final Plat to include the recordation information for all proposed public easements that are depicted on the plat. Final Plat can not be approved prior to the recording and posting of these easements. 18. DS Sec.14.3.2: Provide a note on the Final Plat and within the CC&R's stating that, (a) the owner or home owners association shall be solely responsible for operation, maintenance, and liability for drainage structures; (b) that the owner or home owners association shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage facilities at lease once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or home owners association agree to reimburse the City for any and all costs associated with the maintaining of the drainage facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities." 19. DS Sec.2-03.6.6: A final signed original copy of the CC&Rs is required for approval of the Final Plat. The Final Plat can not be approved prior to original CC&Rs being submitted and approved. 20. DS Sec.2-03.6.6.A: Verify the CC&R's to accurately reflect all of the proper common elements labels and responsibility for maintenance and liability for any proposed commonly-owned elements. Revise the following information within the CC&R's: a) Revise to accurately describe the property (Name, number of units, common elements, limited common elements, with descriptions) per the Title Block. Both the CC&Rs and the Title Block must be revised to match with exact wording for the name and all Elements. b) Provide all Exhibit's within the CC&Rs. All exhibits must be provided in order for the CC&Rs to be a complete package. 21. DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided: a) if there is any remaining construction, the financial assurances are submitted and approvable; or, b) provide a copy of Certificate of Occupancy paperwork accepted by the City of Tucson for the final construction. 22. DS Sec.2-03.7.1.B: Provide signature and seal of both the Surveyor and Civil Engineers for the project. When engineering information (current floodplain conditions) is provided on the final plat, the seal and signature of the responsible engineer is also required. This will be required for approval of the Final Plat for this condo conversion. 23. Clarify the distance between limited common elements and east and west property boundaries. There are more than 2' of discrepancy for width of project. Label area with regard to which common element it belongs. GENERAL COMMENTS: 24. The revised Final Plat and CC&R's to address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments. 25.
