TO: Development Services Department Plans Coordination Office
FROM: Steve Shields
Lead Planner

PROJECT: Mountain Vail Estates, Phase II
S08-135
Final Plat (2nd Review)

TRANSMITTAL DATE: February 17, 2009

DUE DATE: February 5, 2009

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The Zoning Review Section conditionally approves the final plat for this subdivision, subject to the following changes on the executed CC&Rs for the final plat. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

2. D.S. 2-03.6.6 Revise the CC&R's title to read as the title reads on the final plat, "MOUNTAIN VAIL ESTATES LOTS 1-135" and "MOUNTAIN VAIL ESTATES LOTS 136-501". Also revise all references to "MOUNTAIN VAIL" or "MOUNTAIN VAIL LOTS" to read "MOUNTAIN VAIL ESTATES".

3. D.S. 2-03.6.6 CC&R section 5.2.3 references rezoning case C9-03-01, this reference appears to be incorrect. Revise reference to the appropriate rezoning case number(s).

4. D.S. 2-03.6.6 CC&R section 17.12 revise the year "2007" to "2009" in the notary block.
