Tent. Plat – 1st Submittal
S08-121

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

This project will be tributary to the Roger Road WTF via PTI. Obtain a letter from the PCWMD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

http://www.pima.gov/wwm/forms/docs/CapResponseRequest.pdf.

The tentative or preliminary plat for this project cannot be approved until a copy of this letter has been received by this office.

Sheet 1: Revise General Note #11 to read as follows:

THE ON-SITE SANITARY SEWAGE COLLECTION LINES WILL BE PUBLIC AND DESIGNED AND CONSTRUCTED TO PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT STANDARDS AND MUST BE ACCEPTED AND RELEASED FOR SERVICE BY THE PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT PRIOR TO THE ISSUANCE OF SEWER CONNECTION PERMITS.

Sheet 1: Add a General Note that states:

CONSTRUCTION AUTHORIZATION FROM THE PIMA COUNTY DEPARTMENT OF ENVIRONMENTAL QUALITY IS REQUIRED BEFORE BEGINNING ANY WORK ON THIS PROJECT. APPROVAL OF THIS DEVELOPMENT PLAN DOES NOT CONSTITUTE CONSTRUCTION AUTHORIZATION.

Sheet 2: The MH#2 shown as the furthest downstream should be labeled as #1. Also the length of sewer line from MH#5 to MH#6 should not be more then 500’.

Sheet 2: The length and slope of pipe from MH#6036-20 to MH#1 does not fit with the inverts shown for the two manholes.

Sheet 2: The proposed manhole symbol is to close to the symbol shown for the property corners.

Sheet 2: Show the public sewer easement for G-86-128A and include the recordation information.

Sheet 2: Call out the area for proposed sewer line D as common area or show a proposed public sewer easement. Also demonstrate an all weather drivable surface along this line.

Sheet 2: Call out the existing public manhole shown just northeast of this project and include the rim and invert elevations. Also show that the manhole is in the ROW or show the public sewer easement with recordation information. Demonstrate that access to the manhole will not be hindered.

Sheet 2: Call out the existing public manholes with IMS#’s and rim and invert elevations along Sellarole Rd. and show the road on plan.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the tentative or preliminary plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

If you have any questions regarding the above-mentioned comments, please contact me.

11/24/2008 JASON GREEN ENGINEERING REVIEW Denied DATE: November 24, 2008
SUBJECT: Sellarole Development Lot D Tentative Plat- Engineering Review
TO: Patricia Gehlen, CDRC Manager
LOCATION: 9161 E Sellarole, T14S R15E Sec27 Ward 4
REVIEWERS: Jason Green, CFM
ACTIVITY: S08-121

SUMMARY: Engineering Division of Development Services Department has received and reviewed the submitted Tentative Plat, Drainage Report (Greg Carlson Engineering, L.L.C., 17OCT08) and a copy of the Title Report. The Drainage Report was reviewed for Tentative Plat purposes only. The Tentative Plat and Drainage Report are not approved at this time. The following items need to be addressed:

DRAINAGE REPORT:

1) Tucson Code Chapter 26 Sec.26-5.2.4: Revise the Drainage Report, Tentative Plat and the location of the development to show no unnecessary disturbance of the riparian 100-year floodplain within the Watercourse Amenities, Safety, and Habitat (W.A.S.H.) wash. Portions of the proposed development are located within the mapped 100-year floodplain per the Drainage Report and are not considered a necessary disturbance. Review and approval for the disturbance and proposed mitigation is required by the Landscaping Department prior to Tentative Plat approval. Specifically the disturbances within the W.A.S.H. wash 50-foot study area.

2) Revise the Drainage Report to provide a statement that the Spanish Trail Wash is a W.A.S.H. wash and subject to DS Sec.9-06 and Chapter 29 of the Tucson Code. Verify that all requirements have been addressed for the proposed disturbance of the W.A.S.H wash (toe down wall connecting to the existing bank protection within Spanish Trail Wash).

3) It is acknowledged that a tentative agreement with the applicant and Matt Flick for the Stormwater Retention requirements was agreed upon. However per DS Sec. 10-01 threshold retention requirements are still applicable and may only be waived in certain cases when stormwater retention is not feasible due to constraints imposed by subsurface conditions. For this project since the parcel does not fall within balanced or critical basin 5-year retention is required. Provide a Development Standard Modification Request that specifically addresses the waiving of the retention requirements.

4) DS Sec.10-02.5.3.2: Revise the Drainage Report to provide a backwater flow depth analysis for each of the existing regulatory washes that are adjacent to the site. The wash crossing and convergence of the regulatory washes at the Pantano Wash presents a hydraulic control factor that necessitates a more detailed analysis than that provided by the Manning's equation and handful of cross sections shown.

5) Revise the Drainage Report and Tentative Plat to calculate the top of fill pad and Finish Floor Elevation of each lot that is affected by the existing and/or proposed 100-year floodplain. Finish Floor Elevations must be calculated during the Tentative Plat process to assure conformance with the Floodplain Ordinance and grading standards. All finish floor elevations must be elevated 1-foot above the calculated water surface elevation, which must be clearly shown on the plat and the post drainage exhibit.

6) DS Sec.2-03.2.4.K: Provide the Geotechnical Report that is required for this project. The soils report needs to discuss suitability and feasibility of the project and must provide specific discussion with recommendations for the proposed "basin" and all constructed slopes. Description of existing soil constraints for the site, structural design recommendations, and other typical geotechnical data is needed. The soil report shall provide identification / assessment of any potentially hazardous geotechnical areas. Recommendations need to be incorporated into the Tentative Plat and Drainage Report.

TENTATIVE PLAT:

7) Revise the Tentative Plat to provide additional sheets so that all proposed information that is shown and/or required is clearly shown in plan view. Additional sheets can be used to provide the information for Zoning, Engineering and Landscaping without leaving the plan cluttered and hard to review.

8) Provide a separate application for the Watercourse Amenities, Safety, and Habitat overlay review. The application package for W.A.S.H. review is submitted to the CDRC section at DSD. The W.A.S.H. review must be approved prior to Tentative Plat approval.

9) DS Sec.9-06.2.1: All site plans, development plans, Tentative Plats, plot plans or other plans providing for approval of development within property that includes any Regulated Area as defined in Development Standard 9-06.2.2 shall identify and delineate the Regulated Areas and the Protected Riparian Area. The Regulated Areas on this site are the existing 100-year floodplain limit. Revise the Tentative Plat as necessary to clearly document the locations of the exiting 100-year floodplain limit. Show the same information (regulatory limits) on the plant inventory, landscape/mitigation plans, and future grading plan.

10) DS Sec.9-06.2.5.B.2: All development within the Protected Riparian Area shall be reviewed to insure that there is no unnecessary disturbance of the riparian resources. Refer to this section on Development Restrictions and revise the plans as necessary. Necessary development shall include only the crossing of riparian habitats with roadways, bikeways, paved walkways and utilities as listed below where there is no viable alternate crossing available and the crossing is necessary for the reasonable development of the property. A written explanation as to why the development is necessary shall be submitted with the appropriate plans. The Drainage Report and Tentative Plat indicate that a toe-down wall is proposed within the existing 100-year floodplain of the W.A.S.H. wash. This is not consistent with the provisions for "necessary development".

11) Tucson Code Sec 26-11: A Floodplain Use Permit (FUP) is required at the next Tentative Plat submittal for the proposed grading and alteration of the mapped regulatory 100-year floodplain. Per Chapter 26 of the Tucson Code a Floodplain Use Permit is required for any improvements within a mapped 100-year floodplain. Provide the FUP application with the resubmittal for review and approval.

12) DS Sec.2-03.2.1.B: Revise the Tentative Plat sheets to show the required ½ inch margins on each side of the sheet and to clearly show all wording proposed on the plat. The bottom margin of the sheet has cut-off the Tentative Plat number and Rezoning Case number reference.

13) DS Sec.2-03.2.1.D.2: Revise the project location map on Sheet 1 to identify all major watercourses (Spanish Trail Wash and Eastview Wash) that are within the one square mile area shown.

14) DS Sec.2-03.2.1.G.1: Revise the Title Block to remove the word Development Plan. The proposed project is a Tentative Plat and the Title Block must be reworded to reflect.

15) DS Sec.2-03.2.1.G.2: Revise the Title Block to reference the number of proposed lots within the subdivision.

16) DS Sec.2-03.2.1.J: Revise the legend to show all symbols that are shown/required on the proposed Tentative Plat. Specifically the water surface elevations symbol that will be required for all associated washes adjacent to the site.

17) DS Sec.2-03.2.2.A.2: Revise the Tentative plat to include the seal and signature of the civil engineer of record for all of the shown floodplain and drainage improvement information. Provide the telephone number, name and address of the civil engineer.

18) DS Sec.2-03.2.2.B.1: The correct Tentative Plat number (S08-121) may be added to the lower right hand corner of the plans where indicated by "S08-XXXX."

19) DS Sec.2-03.2.2.B.7: Provide a General Note or revise General Note #3 on the Tentative Plat to reference all special overlay zones that are applicable to this plat, specifically state that the plat is designed to meet the overlay zone criteria for Sec.29-12 through 29-19 Watercourse Amenities, Safety, and Habitat (W.A.S.H.) Ordinance of the Tucson Code. Provide the case file number, date of approval and any conditions placed on the review for the W.A.S.H wash.

20) DS Sec.2-03.2.2.C.2.b: Provide a note on the Tentative Plat to state the following; "A Floodplain Use Permit and/or finish floor elevation certificates are required for all improvements and grading in the floodplain. The following Lots require a Floodplain Use Permit: ____."

21) DS Sec.2-03.2.2.D.1.b. Revise the Tentative Plat to provide the following note: "Total miles of public streets are_ "and "Total miles of private streets are_". If there are no public streets proposed the blank must be filed in with a zero (0).

22) DS Sec.2-03.2.3.A: Revise the Tentative Plat to show Benchmark locations, the proposed location of and method of tie to a permanent survey monument or to the nearest section or quarter section corner, and the proposed location and type of subdivision controls monuments that must be shown at the proposed lot corners. All monuments found or set will be described.

23) DS Sec.2-03.2.3.B: Revise the Tentative Plat and the Benchmark statement to be referenced to found, readily locatable monuments. The basis of bearings should be established from two (2) found, physically monumented points described and shown on the Tentative Plat. If the monuments at each end of the reference line are fully described on the plat, they need not be described in the "Basis of Bearings" statement.

24) DS Sec.2-03.2.3.D: Revise the Tentative Plat and associated details to label and dimension the existing width of paving, curbs, curb cuts and sidewalks for Hearth Stone Drive. Label the shown right-of-way as existing.

25) DS Sec.2-03.2.3.F: Revise the Tentative Plat and the Basis of Elevation Section to indicate the ground elevation based on City of Tucson Datum (indicate the COT field book number and page).

26) DS Sec.2-03.2.3.J.1: Revise the Tentative Plat to include the location of all existing 100-year flood limits with the associated water surface elevations. The water surface contours for the 100-year flood with water surface elevations indicated must be shown and clearly labeled.

27) DS Sec.2-03.2.3.J.2: Revise the Tentative Plat to show the water surface elevations such that the linear distance between contours intervals do not exceed 200-feet.

28) DS Sec.2-03.2.4.A: Revise the Tentative Plat to clearly show all proposed lot lines with approximate distances and measurements for the lots that are being created by this plat.

29) DS Sec.2-03.2.4.C: Revise the Tentative Plat to clearly label each common area individually with a separate letter designation. Enclose with a solid line each common area, private street, etc., that will have separate restrictions, a separate homeowners association or other common area that specifies responsibility and maintenance of the common used areas. Verify that CC&Rs are submitted and that they provide for maintenance responsibility for all common areas.

30) DS Sec.2-03.2.4.F: Revise the Tentative Plat so that it is designed in accordance with Street Development Standard 3-01.0. The following items need to be revised or added to the proposed Tentative Plat:

a) Clarify the street cross section (Detail #2) versus the shown dimension in plan view. Verify that the private street is shown to be in conformance with all public roadway standards, DS Sec.3-01. Clearly label the street width, curb and sidewalks.

b) Label and dimension in plan view the minimum street width for the 20-foot emergency access drive from Sellarole Road.

31) DS Sec.2-03.2.4.I: Revise the Tentative Plat to clearly identify and provide dimensions, approximate areas and purpose of any lots proposed for dedication (such as open space, recreation areas or natural areas) or for reservation for a public use. Specifically for the recreation area, basin and the land that is to be deeded to Pima County.

32) DS Sec.2-03.2.4.J: Provide easements for all utilities with recordation information or provide the description for each utility (access, drainage structures, private streets, gas, water, electric, etc.) in respective Common Areas, verify that the CC&Rs match the Common Area descriptions. Easements are to be dimensioned and labeled as to whether they are public or private and recordation information must be provided prior to Tentative Plat approval.

33) DS Sec.2-03.2.4.J: Revise the Tentative Plat to label and dimension the required access and maintenance easements for the required bridge crossing of the Eastview Wash. Verify that the easement is sufficient to access the channel for maintenance of the drainage improvement and that the access ramp meets the requirements within DS Sec.10-02.14.3.4.

34) DS Sec.2-03.2.4.K: Either provide separately, or show a conceptual grading plan on the Tentative Plat, with the resubmittal of the Tentative Plat and Drainage Report. The conceptual grading plan is required on this project due to the existing regulatory washes and floodplain limits. A Geotechnical Report is required to discuss the suitability of the project site. The soils report needs to discuss suitability and feasibility of the project. Besides description of existing soil constraints for the site, structural design recommendations, pavement design section, and other typical geotechnical data is needed. The soils report shall provide identification / assessment of any potentially hazardous geotechnical areas, provide proposed recommendations for setbacks from building to drainage areas include minimum distance from foundations to drainage channels, basin, and provide infiltration test results. The geotechnical report shall specifically address all criteria listed in this section. See last sentence of this section for items 6 (c) & (d) regarding hydro-collapsing soils and 30-foot test boring for basin design. Recommendations need to be incorporated into the conceptual grading plan, Tentative Plat, and Drainage Report.

35) DS Sec.2-03.2.4.L: Revise the Tentative Plat, in conjunction with the submitted Drainage Report, to reflect the following information. For additional information regarding drainage standards, see the City of Tucson Standards Manual for Drainage Design and Floodplain Management (10-02), Detention/Retention Manual (10-01), and Floodplain, W.A.S.H., and Environmental Resource Standard (9-06).

a) Revise the Tentative Plat and Drainage Report to clearly show the design of the proposed drainage channel with the minimum percent longitudinal slope of 0.5%. The bottom of channel slope must be 0.5% or greater to prevent accumulation of standing water and mosquito infestation.

b) Revise the Tentative Plat to clearly show the start/end call outs for the proposed erosion hazard retaining wall. Provide a label for the toe-down wall that connects to the existing Spanish Trial Wash bank protection. All work within the 50-study area of the W.A.S.H. wash requires review and approval per DS Sec.9-06 and Tucson Code Chapter 29. Concrete within the 50-foot study area require Mayor and Council approval.

c) Revise the Tentative Plat so that all 100-year floodplain limits are shown in a surveyable manner. All areas that are to be dedicated must be clearly dimensioned and if deeded over the recordation information must be proved prior to Tentative Plat approval.

d) Revise the Tentative Plat to label and dimension all drainage improvements per the Drainage Report and the Rezoning conditions. The Tentative Plat must label and dimension the proposed culverts from the basin to the Eastview Wash and the rock riprap pad at the end of the drainage channel that is shown offsite.

e) Per DS Sec.10-02.2.3.1.5 provide a notarized signed letter from the adjacent property owner for all proposed offsite drainage improvements on adjacent properties. A signed written agreement from the owner and adjacent property owner for offsite improvements is required along with maintenance and access easements for these areas. Specifically the rock riprap fill pad, the required bridge, proposed culverts, erosion hazard retaining wall and the excavation of fill within the channel.

f) Revise the Tentative Plat to meet all conditions of Rezoning. Specifically the access drive into the proposed subdivision must be designed as a bridge crossing over the Eastview Wash (#15), the proposed basin can not have rectangular shapes (#24d), and the security barriers around the basin perimeter must be constructed with minimum 10% vegetation (#24e). Verify that all Rezoning conditions have been adequately addressed.

g) Per DS Sec.10-02.14.3.4 revise the Tentative Plat and the basin access ramp to clearly show it meets the minimum width requirement of 15-feet and maximum slope requirement of 15%.

h) Revise the Tentative Plat and all associated cross sections to label the water surface elevations within the channels and basin. The WSEL must reflect the Drainage Report.

36) DS Sec.10-02.14.3.2: Provide a General Note on the Tentative Plat stating that, (a) the owner or owners shall be solely responsible for operation, maintenance, and liability for all drainage channels, drainage structures, and Detention Basin; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at lease once every year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and retention/detention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with the maintaining of the drainage channels, drainage structures, and Detention Basin, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities."

37) DS Sec.6-01: Refer to Environmental Services comments for all refuse comments, if applicable.

38) DS Sec.11-01.9: Revise the Tentative Plat and cross sections to provide the required 2-feet setback from all property boundaries to the proposed limits of grading, fill slopes, retention basin, block wall and any associated erosion protection. Plan view and sections show that the limits of grading do encroach within the required 2-feet setback. Provide sufficient room to allow for the 2-feet setback from property lines to top of fill slopes and associated erosion protection. Provide a cross section for all property boundaries that show the 2-foot setback for all structures from the property line.

39) Provide approval from Tucson Department of Transportation Street and Maintenance and Real Property for all proposed work, excavation and improvements within the public drainage channels. All improvements to public channels will require a right-of-way use permit and the improvements must be approved (tentatively at a minimum) by TDOT prior to Tentative Plat approval.

40) Review and approval from Pima County Regional Flood Control District is required for all drainage improvements proposed into their right-of-way and/or infrastructure (toe down wall and connection into existing bank protection). Provide a copy of the approved PCRFCD Floodplain Use Permit and list all conditions of this permit on the Tentative Plat.

41) Due to the above comments and the possible re-design of the project not all comments have been reflected within this letter. The minor redlines and other quality control issues will be addressed after the major comments have been removed.

42) Review and approval from TDOT Permits and Codes for all improvements within the public right-of-way will be required. A right-of-way use permit application will be required prior to construction. Refer to the following links for TDOT Forms and applications:

a) http://www.tucsonaz.gov/dsd/Forms_Fees___Maps/Applications/applications.html /

b) http://www.dot.ci.tucson.az.us/engineering/pia.php

c) Or contact Thad Harvison at 837-6592 for all additional questions regarding r-o-w.

ENVIRONMENTAL RESOURCE REPORT:

43) DS Sec.9-06.2.5.B: The project proposes encroachment within the Regulated Areas (proposed toe down wall) of the W.A.S.H. wash of Spanish Trail and will require a revised ERR to demonstrate conformance with DS Sec.9-06 and Chapter 29 of the Tucson Code. The Environmental Resource Report must include all items (a-x) within this section.

GEOTECHICAL REPORT:

44) DS Sec.10-02.14.2.6: A geotechnical evaluation needs to be submitted for review. The soils report needs to discuss suitability and feasibility of the project. The report must address the following

a) Soils report should provide conformance with DS section 10-02.14.2.6 regarding 30-foot boring for the proposed detention basin, and provide discussion of potential for hydro-collapsible soils and any recommendation for setbacks from buildings to proposed basin.

b) The soils report shall provide identification / assessment of any potentially hazardous geotechnical areas, and state any geotechnical recommendations and whether there are special provisions for the soil preparation for this development.

c) Provide slope stability recommendations for any proposed constructed slopes.

d) Provide pavement structure design recommendations.

e) Provide infiltration rates for detention/retention basin design. It is acknowledged that detention retention requirements have been waived per Matt Flick, however a basin is still being proposed and shown on the Tentative Plat therefore must still conform to all basin requirements. A percolation test will be required to assure that the system drains within the required time limit per DS Sec.10-01.

GRADING PLAN:

45) DS Sec.11-01.2.1: For future references a grading permit application will be required for this project. A grading permit may not be issued prior to Tentative Plat approval.

46) Please ensure the grading plan is consistent with the Tentative Plat, Drainage Report, and Geotechnical Report. Grading standards may be accessed at http://www.ci.tucson.az.us/dsd/DevStandsTOC.pdf.

47) Arizona Pollutant Discharge Elimination System (AZPDES) requirements are applicable to this project. Stormwater Pollution Prevention Plans and text addressing stormwater controls for all areas affected by construction activities related to this development will be required with grading plan submittal. For further information, visit www.adeq.state.az.us/environ/water/permits/stormwater.html.

Dear Mr. Lara

SUBJECT: Sellarole Development
Lots 1-41
S08-121

Tucson Electric Power Company (TEP) has reviewed the tentative plat dated November 5, 2006. This Company is unable to approve the plat at this time.

There are existing electrical facilities within the boundaries of the development. The facilities along the southeast corner with the easement recording information must be shown on the plat prior to approval. If an existing easement is not found add a dimensioned easement by prescription and a general note that the facilities will be abandoned. All relocation costs will be billable to the developer. Please direct questions concerning easement(s) to Liza Castillo, Right-of-Way Agent in our Land Department at 520-917-8745.

TEP will provide a preliminary electrical design on the Approved Tentative Plat within fifteen (15) working days upon receipt of the plat. Additional plans necessary for preparation of the design are: building plans including water, electrical, landscape, sidewalk and paving plans. Should you have any questions, please contact area designer Marcus Hayes at 917-8705.

x Plat meets Assessor's Office requirements.
_______ Plat does not meet Assessor's Office requirements.

COMMENTS: Tentative plat approved. Please make the following changes to ensure the approval of the final plat:
1. The General Notes must include the Basis of Bearing.
2. The General Notes must include the number of miles of new road, public or private, even if the number is zero.
3. The plat must include a section tie with distances and bearings from the section corner to a point of tie in the subdivision.
4. The perimeter line must be solid and the heaviest line weight on the plat. The lot lines and common area lines must be solid and the next heaviest. Lines for erosion setbacks, floodplains etc. should be the lightest line weight and be dashed or dot-dashed.
5. All hatching, stippling, stripping etc. must be removed in the final plat unless another agency requires it.
6. All adjacent subdivisions should be named, with map and plat, in the appropriate areas around the subdivision. In the case of unsubdivided areas, label "unsubdivided".
7. The title block must include the number of lots.
