Under these conditions, a full commercial accessibility site review is required as per Chapter 11 of the IBC.

1. Identify the accessible route connected to the Public R.O.W. and parking, commom areas and all living units.
a. Provide spot grades along the accessible route to show compliance with section 403.3.
2. Provide one accessible parking space complete with signage, aisle and a marked crossing to the accessible route with all required ramps and detectable warning as per sections 406, 406.12 and .13.

The drawings for the proposed Final Plat for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Regional Wastewater Reclamation Department (PCRWRD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


ALL SHEETS. Add the project no. S08-114 to the Title Block of all sheets. This number should be shown larger and darker.

SUBJECT TO THE ABOVE, the PDEQ and the PCRWRD hereby CONDITIONALLY approve the above referenced submittal of the Final Plat as received by us on September 22, 2008.

It is noted that all sewers are existing and private. No new sewers are proposed.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. SUMMARY: Engineering Division of Development Services Department has received, Sheet 1 thru 3 of the proposed Final Plat, a copy of the CC&Rs and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&Rs and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&Rs to match each other. All names, common elements, limited common elements, and descriptions must have the same wording in the CC&Rs as in the Title Block. Provide a clear definition of each Common Element and Limited Common Element within the Title Block and CC&Rs. Also add the statement "Condominium Conversion" to the Title Block.

2) DS Sec.2-03.6.1.E: Revise the Final Plat to provide a small index drawing or label showing what is on each sheet of the proposed plat. All plats containing more than 1 sheet must contain a small index drawing of the site, the exception is for plats that have only 2 sheets the project location map required in DS Sec.2-03.6.1.D may be used as the index map.

3) DS Sec.2-03.6.1.H: Revise the Title Block to add "A Condominium Conversion Project" in the lower right corner of each Sheet.

4) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S08-114) where indicated by "S08-XXX", it must be added to the lower right hand corner of the plans on all sheets.

5) DS Sec.2-03.6.3.B.1: Revise the Certification of Title paragraph to accurately read the following statement from the Development Standard section referenced, "We, the undersigned, hereby warrant that we are the owners and the only parties having any interest in the land shown on this plat, and we consent to the subdivision of said land in the manner shown hereon." Remove the words "record title" from the paragraph where stated "...record title interest..."

6) DS Sec.2-03.6.3.E: Revise the Assurance paragraph language to accurately read the following statement from the Development Standards Section referenced, "This is to certify that all improvements, such as streets, sidewalks, private sewers, water and utility installation, drainage and flood control facilities, and monuments, required by the City of Tucson have been completed or the future completion of such improvements has been assured by the posting of performance bonds, assurances, or other security as the City of Tucson deems necessary and proper."

7) DS Sec.2-03.6.4.A: Revise the Final Plat to label all streets or alleyways shown as public or private along with the appropriate dedication notation and right-of-way widths.

8) DS Sec.2-03.6.6.A: Revise the CC&R Title, cover page and all references within the CC&Rs to accurately reflect the proposed Final Plat. Revise the following information within the CC&Rs:

a) Revise to accurately describe the property (Name, number of units, common elements, limited common elements, with descriptions) per the Title Block. Either the CC&Rs or the Title Block must be revised and must match with exact wording for the name number of units and all Elements.

b) Revise Page 6 Section 2.3 to correctly identify the number of Units proposed.

c) Revise Page 26 under Section 8.1 to clarify if the paragraph identified as "(b)" after Number 8 is supposed to be letter (a) or if it's a number 9. All numbering and alphabetical designation must be in sequential order.

d) A final signed original notarized copy of the CC&Rs will be required prior to approval of the Final Plat.

e) Revise CC7Rs so that all pages are in sequential order. Pages 26 and 27 along with Pages 31 and 32 or not in order, revise.

9) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:

a) If there is any remaining construction, financial assurances shall be submitted and approvable; or,

b) Provide a copy of Certificate of Occupancy (CofO) paperwork accepted by the City of Tucson for the final construction of all buildings.


GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package and either a Financial Assurance Package or CofO at re-submittal.

The revised Final Plat, CC&Rs and Assurance Package/CofO must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and CC&Rs.
