The Title Block must name the subdivision from which these condos are being resubdivided. 2. The plat must contain a line tying a section corner to a point in the subdivision. 3. All lot lines must be solid, even those separating common areas. 4. All lot lines and perimeter lines must have a distance and bearing. 5. Each lot/unit must have it's square footage listed. 6. All hatching, stippling, striping etc, must be removed in the final plat unless another agency requires it. 7. All adjacent subdivisions must be named, with map and plat, in the appropriate areas around the subdivision. NOTE: THE ASSESSOR'S CURRENT INVOLVEMENT IN PROCESSING ITS MANUAL MAPS TO DIGITAL FORMAT IS EXPEDITED GREATLY BY EXCHANGE OF DIGITAL DATA. | 10/02/2008 | JASON GREEN | ENGINEERING | REVIEW | Denied | DATE: October 2, 2008 SUBJECT: The Flats at Julian Drew Block Condominium Conversion Final Plat Submittal- Engineering Review TO: Patricia Gehlen, CDRC Manager LOCATION: 128 S 5th Avenue, T14S R13E Sec13 Ward 6 REVIEWERS: Jason Green, CFM ACTIVITY: S08-112 SUMMARY: Engineering Division of Development Services Department has received, Sheet 1 thru 4 of the proposed Final Plat, a copy of the CC&Rs and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&Rs and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed: FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&Rs to match each other. All names, common elements, limited common elements, and descriptions must have the same wording in the CC&Rs as in the Title Block. Provide a clear definition of each Common Element and Limited Common Element within the Title Block and CC&Rs. Also add the statement "Condominium Conversion" to the Title Block. 2) DS Sec.2-03.6.1.E: Revise the Final Plat to provide a small index drawing or label showing what is on each sheet of the proposed plat. All plats containing more than 1 sheet must contain a small index drawing of the site, the exception is for plats that have only 2 sheets the project location map required in DS Sec.2-03.6.1.D may be used as the index map. 3) DS Sec.2-03.6.1.H: Revise the Title Block to add "A Condominium Conversion Project" in the lower right corner of each Sheet. 4) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S08-112) where indicated by "S08-", it may be added to the lower right hand corner of the plans on all sheets. 5) DS Sec.2-03.6.1.L: Revise the Final Plat to include a legend which shows and describes all symbols used on the drawing. The legend must be on the first sheet of the plat or the first sheet which contains all or part of the subdivision drawing. 6) DS Sec.2-03.6.4.A: Revise the Final Plat to label all streets or alleyways shown as public or private along with the appropriate dedication notation. 7) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. 8) DS Sec.2-03.6.5.C.1.a: Revise the Basis of Bearing Note (General Note # 3) so that the basis of bearing is established from 2 found, physically monumented points described and shown on the final plat. If the monuments at each end of the reference line are fully described on the plat the need not be described in the "Basis of Bearing" statement or note. 9) DS Sec.2-03.6.6.A: Revise the CC&R Title, cover page and all references within the CC&Rs to accurately reflect the proposed Final Plat. Revise the following information within the CC&Rs: a) Revise to accurately describe the property (Name, number of units and blocks, common elements, limited common elements, with descriptions) per the Title Block. Either the CC&Rs or the Title Block must be revised and must match with exact wording for the name number of units and all Elements. b) Revise Page 5, Section 4.1 to correctly label the subsections under this paragraph. Specifically revise the subsections to read, 4.1.1, 4.1.2, 4.1.3, etc, currently this sections reads 4.2.1, 4.2.2 which is then repeated under Section 4.2, revise. 10) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided: a) If there is any remaining construction, financial assurances shall be submitted and approvable; or, b) Provide a copy of Certificate of Occupancy (CofO) paperwork accepted by the City of Tucson for the final construction. GENERAL COMMENTS: Provide a revised Final Plat, a revised original CC&R package and either a Financial Assurance Package or CofO at re-submittal. The revised Final Plat, CC&Rs and Assurance Package/CofO must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments. LUC 4.1.9.1.A Please provide an affidavit stating that the subdivision has provided or will provide written notice of the subdivider's intent to convert to all tenants of units to be converted, beginning not less than one hundred twenty (120) days prior to the date on which the first unit is offered for sale, and will continue to provide such notice to prospective tenants until all units have been sold. 4. LUC 4.1.9.1.B Please provide an affidavit stating that the subdivider will provide existing tenants an exclusive right to purchase the unit the tenant leases at a price which is not more than the price at which the subdivider intends to offer the unit to the general public for a period of not less than sixty (60) days from the date a tenant's units is offered for sale. 5. LUC 4.1.9.1.C Please provide an affidavit that the subdivider will provide to each tenant, who has indicated to the subdivider his/her intention not to exercise his/her right to purchase, a written statement listing at least three (3) rental units unique to that tenant of comparable size and price to the unit occupied by the tenant. 6. ) LUC 4.1.9.1.D Please provide an affidavit stating that the subdivider will provide to tenants a relocation payment of three hundred fifty (350) dollars per residential unit to be paid prior to termination of the tenants occupancy, including written notice of the availability of such payment prior to termination, provided that: a) The tenant has occupied his unit for at least two (2) years prior to the date on which the tenant was eligible to receive a notice of intent to convert pursuant to Sec. 4.1.9.1.A. b) The tenant has made a written request to the subdivider for the relocation payment. c) The tenant has a total annual income at or below maximum eligibility limits established by the U.S. Department of Housing and Urban Development for the participation in the Section 8 Housing Assistance Payments Program or is sixty-two (62) years of age or older. 7. LUC 4.1.9.1.E Please provide an affidavit stating that the units to be converted meet the applicable standards of the Housing Code, Tucson Code, Chapter 16. 8. LUC 4.1.9.2 Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following. a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase. b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure. c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data. d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied. e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety. 1. Accessibility of buildings and structures to fire-fighting equipment; and 2. Proximity and frequency of fire hydrants. 9. DS 2-03.6.6 On the title page of the CC&Rs provide the number of units and common areas similar to what is in the title block of the final plat pages.
