COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is August 10, 2009.

2. D.S. 2-03.6.1.D.2 On the location map identify conditions within the square mile area, such as subdivisions, reference recorded subdivision plats by book and page numbers. Also show the Union Pacific railroad, along the west side of the map, on the location map.

3. D.S. 2-03.6.1.D.3 Show the section corners on the location map.

4. D.S. 2-03.6.1.D.4 Show the City's jurisdictional limits on the plan. South Tucson boarders this project along the northwest property line.

5. D.S. 2-03.6.1.F This project is located within the boundaries of a Planned Area Development (PAD) zone, include a reduced-scale map of the entire PAD District on the first sheet, indicating the location of the portion being developed.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

1. Sheet 1: In the Dedication Block, second paragraph, first line after the word PUBLIC add the words ,PIMA COUNTY.

2. Sheet 1: In the Dedication Block, third paragraph, fourth line after the word PUBLIC add the words ,PIMA COUNTY.

3. Sheet 1: Fill in the blanks for the Trust # where appropriate on this sheet.

4. We will send to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of block plat. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the .

5. The Final Plat can not be approved until the sewer construction plan has been approved.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

SUMMARY: Engineering Division of Development Services Department has received the proposed Final Plat and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.D.2: Revise the location map on Sheet 1 to identify all conditions within the square mile area shown. Specifically the major streets (Ajo Way), major water courses (Greyhound Wash and Downtown Airport Wash), and all subdivisions adjacent to the property. Reference recorded subdivision plats by book and page numbers.

2) DS Sec.2-03.6.1.D.3: Revise the project location map to label the required 3-inch equals 1-mile scale.

3) DS Sec.2-03.6.1.D.4: Revise the project location map to show the City's jurisdictional limits and the City of South Tucson limits that fall within the 1 square mile area shown.

8) DS Sec.2-03.6.2.H: Provide a General Note on the Final Plat to state the following: "There will be no further division of lots without the expressed approval of the City of Tucson."

9) DS Sec.2-03.6.2.I: Revise General Note D.1 on the Final Plat to read per the Development Standard; "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expensive to the public." Remove all additional wording that is not included within this standard.

10) DS Sec.2-03.6.3.A: Revise the Certification of Survey paragraph to include "I further certify that this plat was prepared under my direction." This statement needs to be the last sentence in the Certification of Survey paragraph.

11) DS Sec.2-03.6.3.B.2.b: Revise the 2nd Dedication paragraph to correctly read per the Development Standard; "We hereby grant to the Public and all utility companies all easements as shown hereon for the purpose of access for installation and maintenance of the public sewers and utilities and other uses as designated by this plat."

12) DS Sec.2-03.6.3.B.4: Revise the signature line for the Title Company to include the Trust Number and the name of the Trust Officer.

13) DS Sec.2-03.6.3.C: Revise the Beneficiary paragraph to include the Trust Number that is applicable to this property/project.

14) DS Sec.2-03.6.3.D: Revise the Recording Data paragraph to read per the Development Standard. Remove the wording "THIS INSTRUMENT WAS" and start the paragraph with "FILED FOR RECORD AT THE."

15) DS Sec.2-03.6.4.A: Revise the Final Plat to label all proposed streets as either public or private. Provide the recordation information for all proposed public streets or clearly state on the Final Plat that the streets are "to be dedicated by Final Plat."

16) DS Sec.2-03.6.4.B: Revise the Final Plat submittal to include the square footage of each proposed block (A-F).

17) DS Sec.2-03.6.4.D: Revise the Final Plat to provide the dimensions, areas in square footage and purpose of lots proposed for dedications (such as open spaces, recreation areas and natural areas) or the reservation for a public use (Such as public parks and water facilities).

18) DS Sec.2-03.6.4.F: Revise the Final Plat to label and dimension the limits of the 100-year floodprone are in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for al flow of one hundred cfs or more.

19) DS Sec.2-03.6.4.H: Revise the Final Plat to label the no-vehicular access easements where applicable.

20) DS Sec.2-03.6.4.I: Revise the Final Plat to label all detention/retention areas in a surveyable and readily retraceable manner.

21) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. All Found Brass disc must be clearly described.

22) DS Sec.2-03.6.5.C.4: Revise the Final Plat to provide monuments at all proposed block corners. All monuments must be labeled as found or set. Found monuments must be fully described and must show all markings on the found monuments.

23) DS Sec.2-03.6.5.C.5: Revise the Final Plat to clearly indicate whether the distance and bearings between monuments were measured or calculated for all property line boundary information.

24) DS Sec.2-03.6.6: Protective Covenants or Covenants, Conditions and Restrictions (CC&Rs) establishing responsibility for construction, maintenance and ownership of any proposed open space, common area, or similar joint use must be provided. The Final Plat can not be approved prior to original CC&Rs being submitted and approved.

25) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until Financial Assurances are submitted and approved.


GENERAL COMMENTS:

Provide a revised Final Plat, a CC&R package (if applicable) and a Financial Assurance Package at re-submittal.

The revised Final Plat, CC&Rs and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat, CC&Rs and Assurance Package.
