This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. We will need to see a site plan or tentative plat showing how the condominiums are to be sewered. This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents. Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet. The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter. Engineering Division has reviewed the submitted Final Plat, CC&R's and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed: FINAL PLAT COMMENTS: 1) The Final Plat Condominium Conversion can not be approved until Site Plan and Grading Plan approval. The associated Site Plan (T08CM00528) and Grading Plan (T08BU00855) have yet to be approved by Development Services therefore the Final Plat could not be shown to be in conformance with building locations, basin dimensions, Vehicular Use Areas, etc. The Final Plat must reflect any required changes from the Site Plan and Grading Plan comment letters that have been posted under separate reviews. 2) DS Sec.2-03.6.1.E: Revise Sheet 1 to include an index of all sheets included with the Final Plat submittal, or provide a small index drawing of the site showing the area represented on each sheet. 3) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&R's to match each other. All names, common elements, limited common elements, and descriptions must have the same wording in the CC&R's as in the Title Block. Provide a clear definition of each Common Element and Limited Common Element within the Title Block. 4) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S08-087) where indicated by "S08-", it may be added to the lower right hand corner of the plans on all sheets. 5) DS Sec.2-03.6.2.I: Provide the following note on the Final Plat (if the subdivision is the result of a rezoning case); "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expensive to the public." 6) DS Sec.2-03.6.4.A: Revise the Final Plat to include the recordation information for all proposed public easements that are depicted on the plat. Final Plat can not be approved prior to the recording and posting of these easements. 7) DS Sec.2-03.6.4.C: Revise the Final Plat to clearly enclose with a solid line each common element, specifically Common Element B that surrounds the Retention/Detention Basin area. The surveyable lines for the basin are required but the closed lines exclude the rest of the area that is adjacent to the basin and does not clearly label it as Common Element B. 8) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. The Found Brass disc must be clearly described. 9) DS Sec.2-03.6.5.C.1.a: Revise General Note # 5 the Basis of Bearing Section to include the recordation information of the referenced subdivision of Airport Commerce Center Lots 1thru 81. 10) DS Sec.2-03.6.5.C.4: Revise the Final Plat to fully describe the found brass disc at the intersection of Brosius and Medina Road. If the corner tie information is measured from this point the monument must be fully described and show all markings on the found monument. 11) DS Sec.2-03.6.5.C.5: Revise the Final Plat to clearly indicate whether the distance and bearings between monuments were measured or calculated for all property line boundary information. The legend shows the symbols used for measured, calculated or recorded, but these are not clearly shown on Sheet 2 with the provided dimensions, revise. 12) DS Sec.14.3.2: Provide a note on the Final Plat stating that, (a) the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and retention basin; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and retention facilities at lease once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with the maintaining of the drainage and retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities." 13) DS Sec.2-03.6.6: A final signed original copy of the CC&Rs is required for approval of the Final Plat. The Final Plat can not be approved prior to original CC&Rs being submitted and approved. 14) DS Sec.2-03.6.6.A: Revise the CC&R's to accurately reflect all of the proper common elements labels and responsibility for maintenance and liability for any proposed commonly-owned elements. Revise the following information within the CC&R's: a) Revise to accurately describe the property (Name, number of units, common elements, limited common elements, with descriptions) per the Title Block. Since this project does not have an approved site plan or grading plan and the improvements have yet to be constructed Financial Assurances are required. GENERAL COMMENTS: Provide the last approved site plan, approved grading plan, a revised Final Plat, a revised original CC&R package and a Financial Assurance Package at re-submittal. The revised Final Plat, CC&Rs and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.
