SUMMARY: Engineering Division of Development Services Department has received, Sheets 1 thru 3 of the proposed Final Plat, a copy of The Declaration of Restrictions and Reciprocal Easement and Maintenance Agreement, a copy of the AMENDMENT TO TRUST and a copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST. Engineering Division has reviewed the submitted Final Plat and recommends conditional approval of the Final Plat at this time. Engineering Division does not however recommend approval of the Financial Assurance Package at this time. The following items need to be addressed prior to Final Plat Mylar submittal:

d) Assure that all exhibits are correctly placed/attached, and the case number "S08-086" is at the top of the first page of the AGREEMENT TO CONSTRUCT, EXHIBIT B in the AGREEMENT TO CONSTRUCT, and AMENDMENT TO TRUST;

e) Provide a Title Report. The Title Report should be current within 30 days of recordation of the proposed plat;

f) Provide a copy of a sample Warranty Deed;

g) An 8½" by 11" location map.

18) New Comment: Due to the Financial Assurances submitted for review and the Trust Agreement and Trust Number, 18207-T, shown the Dedication Section on Sheet 1 of the Final Plat much be revised to reflect the Trust Officer and the Beneficiary.

a) DS Sec.2-03.6.3.B.4: revise the plat to add the signature lines for all property owners. The number of signatures depends on the number of persons who have fee title interest according to the Title Report current within 30 days of recordation of the proposed plat.

b) DS Sec.2-03.6.3.C: Provide the required Beneficiary Block on the Title Page to read; "The Beneficiary of (Title Company Name and Trust Number) is (Name and Address)."


GENERAL COMMENTS:

Provide the Final Plat Mylar, complete Financial Assurance Package and Easement Recordation information for review and approval of conformance with Final Plat submittal and the above comments.

The Final Plat Mylar and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments. If a cursory review is required prior to Mylar submittal to verify if all comments on the Final Plat have been addressed I am more than willing to meet at the counter to go over any questions or comments.
