The drawings for the proposed Final Plat for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

ALL SHEETS. Add the Project No. S08-086 to the Title Block. This number should be shown bold and larger than any other cross-reference numbers.

Show all necessary sanitary sewer easements.

3. A Development Plan for this project needs to be submitted and approved before this Final Plat can be approved. If the DP has already been approved, please show its project number as a cross-reference number.

This office will require a submittal of the revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

The next submittal of this project will be the second ( 2nd ) submittal. A check for the review fee of this submittal in the amount of $150.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

SUMMARY: Engineering Division of Development Services Department has received, Sheets 1 thru 3 of the proposed Final Plat, a copy of the CC&Rs and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&Rs and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) The Final Plat can not be approved until Site Plan and Grading Plan approval. The associated Site Plan (T08CM00528) and Grading Plan (T08BU00855) have yet to be approved by Development Services therefore the Final Plat could not be shown to be in conformance with building locations, basin dimensions, Vehicular Use Areas, etc. The Final Plat must reflect any required changes from the Site Plan and Grading Plan comment letters that have been posted under separate reviews.

2) DS Sec.2-03.6.1.E: Revise Sheet 1 to include an index of all sheets included with the Final Plat submittal, or provide a small index drawing of the site showing the area represented on each sheet.

3) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&Rs to match each other. All names, common areas, and descriptions must have the same wording in the CC&Rs as in the Title Block. Provide a clear definition of each Common Area within the Title Block.

4) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S08-086) where indicated by "S08-", it may be added to the lower right hand corner of the plans on all sheets.

5) DS Sec.2-03.6.2.H: Revise General Note # 6 to correct the typographical error by adding the "ed" to the word 'express.' Refer to the referenced section for the complete accurate note that must be on the Final Plat.

6) DS Sec.2-03.6.2.I: Provide the following note on the Final Plat (if the subdivision is the result of a rezoning case); "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expensive to the public."

7) DS Sec.2-03.6.4.A: Revise the Final Plat to include the recordation information for all proposed public easements that are depicted on the plat. Final Plat can not be approved prior to the recording and posting of these easements.

8) DS Sec.2-03.6.4.A: Revise the Final Plat to correctly label the existing streets with the correct name. Verify that the recordation information shown is correct once the plat is revised. Specifically Elvira and Aragon are either incorrectly labeled or not shown.

9) DS Sec.2-03.6.4.C: Revise the Final Plat to clearly enclose with a solid line each common area, label the common area individually with a separate letter designation that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way. Specifically for all proposed basins, vehicular use areas, landscaping, etc.

10) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. All Found Brass disc must be clearly described.

11) DS Sec.2-03.6.5.C.1.a: Revise General Note # 4 the Basis of Bearing Section to include the recordation information of the referenced subdivision of Airport Commerce Center Lots 1 thru 81.

12) DS Sec.2-03.6.5.C.4: Revise the Final Plat to fully describe all found brass discs that are shown. All found monuments must be fully described and show all markings on the found monuments.

13) DS Sec.2-03.6.5.C.5: Revise the Final Plat to clearly indicate whether the distance and bearings between monuments were measured or calculated for all property line boundary information. The legend shows the symbols used for measured, calculated or recorded, but these are not clearly shown on the plat with the provided dimensions, revise.

14) DS Sec.14.3.2: Provide a note on the Final Plat stating that, (a) the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and retention basin; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and retention facilities at lease once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with the maintaining of the drainage and retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities."

15) DS Sec.2-03.6.6: A final signed original copy of the CC&Rs is required for approval of the Final Plat. The Final Plat can not be approved prior to original CC&Rs being submitted and approved.

16) DS Sec.2-03.6.6.A: Revise the CC&Rs to accurately reflect all of the proper common area labels and responsibility for maintenance and liability for any proposed commonly-owned areas. Revise the following information within the CC&Rs:

a) Revise to accurately describe the property (Name, number of lots, common areas, with descriptions) per the Title Block. Either the CC&Rs or the Title Block must be revised and must match with exact wording for the name and all common areas.

b) DS Sec.14.3.2: Provide a note in the CC&Rs under Article 3 stating that, (a) the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and retention basin; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and retention facilities at lease once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with the maintaining of the drainage and retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities."

d) Revise the CC&Rs so that the pages or numbered in sequential order beginning with the first page (exhibits are not numbered).

17) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until Financial Assurances are submitted and approved. Since this project does not have an approved site plan or grading plan and the improvements have yet to be constructed Financial Assurances are required.


GENERAL COMMENTS:

Provide the last approved site plan, approved grading plan, a revised Final Plat, a revised original CC&R package and a Financial Assurance Package at re-submittal.

The revised Final Plat, CC&Rs and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat, CC&Rs and Assurance Package.
