The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

This project will be tributary to the Roger Road Wastewater Treatment Facility via the Pantano Interceptor.
Obtain a letter from the PCWMD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

The development plan for this project cannot be approved until a copy of this letter has been received by this office.

Sheet 1: Add a General Note that states:

THIS PROJECT WILL HAVE ______ EXISTING AND______ PROPOSED WASTEWATER FIXTURE UNIT EQUIVALENTS PER TABLE 13.20.045(E)(1) IN PIMA COUNTY CODE 13.20.045(E).

And fill in the blanks with the appropriate values.

Sheet 1: Revise General Note #15 to read as follows:

THE ON-SITE SANITARY SEWERS WILL BE PRIVATE AND WILL BE CONSTRUCTED, OPERATED AND MAINTAINED ON A PRIVATE BASIS, AND IN ACCORDANCE WITH AN APPROVED OPERATION AND MAINTENANCE PLAN, IF REQUIRED. THE LOCATION AND METHOD OF CONNECTION TO AN EXISTING PUBLIC SANITARY SEWER IS SUBJECT TO REVIEW AND APPROVAL BY THE PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT.

Sheet 2: Show the actual existing public sewer line and sewer line elements in Uhl St. There should be a symbol in the Legend for the existing public sewer line other than just an S.

Sheet 2: Show the construction plan # and pipe size for the existing public sewer line in Uhl St.. Also show the IMS #’s with the rim and invert elevations for the existing public manholes shown on plan.

Sheet 2: Show the proposed connection to the existing public sewer line for this project. Call out the line as private and include the pipe size/ slope and length of pipe.

Sheet 2: Show the proposed private cleanouts on site with the rim and invert elevations.

Sheet 2: The minimum size for the private sewer line is 4” therefore remove the callout for 3” sewer to units 7 and 8.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the development plan. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

SUMMARY: Engineering Division of Development Services Department has received and reviewed the submitted Tentative Plat, Drainage Submittal (not sealed or signed by the engineer of record) and a copy of the Title Report. The Tentative Plat is not approved at this time. The following items need to be addressed:


TENTATIVE PLAT:

1) Title 4 Chapter 30 R4-30-304.E.4: Revise the Tentative Plat to provide the expiration date along with the seal for the engineer of record. Per the referenced section; "All original documents should include a notation beneath the seal either written, typed, or electronically generated that provides the day, month, and year of expiration of current registration, as shown in Appendix B. (Effective 3/08/08)."

2) DS Sec.2-03.2.1.D.2: Revise the project location map on Sheet C1 to identify conditions within the square mile shown, such as subdivisions adjacent to the site. Reference recorded subdivision plats by book and page numbers.

3) DS Sec.2-03.2.1.D.3: Revise the project location map on Sheet C1 to clearly label the section corners for the Township, Range and Section reference provided.

4) DS Sec.2-03.2.1.E: Revise the Tentative Plat to include a small index drawing of the site showing the areas represented on each sheet. If the plat contains more than one sheet an index map or a Sheet Index reference is required on the first sheet.

5) DS Sec.2-03.2.1.G.2: Revise the Title Block to reference the number of proposed Units and provide a statement that the project is part of a Residential Cluster Project (RCP).

6) DS Sec.2-03.2.2.B.1: The correct Tentative Plat number (S08-085) may be added to the lower right hand corner of the plans.

7) DS Sec.2-03.2.2.B.7: Revise the Tentative Plat to reference the following special overlay zone that is applicable to this project. Provide a note stating that "the plat is designed to meet the overlay zone criteria for a Residential Cluster Project (RCP), LUC Sec.3.6.1."

8) DS Sec.2-03.2.2.D.1.b. Revise the Tentative Plat and General Note #13 to include the following note: "Total miles of public streets are_ ." If there are no public streets proposed the blank must be filed in with a zero (0).

9) DS Sec.2-03.2.3.A: Revise the Tentative Plat to show all benchmark locations, proposed location of and method of tie to the permanent survey monuments or nearest section corner. All monuments found or set will be described, revise the Tentative Plat to show monuments at all new property corners at the proposed Unit lot lines.

10) DS Sec.2-03.2.3.C: Revise the Tentative Plat to reflect all existing easements with recordation information, location, widths, and purpose. Specifically Items #5 and #7 on Schedule B of the Title Report could not be located on the plans, either clarify the location or add to the Tentative Plat. Blanket easements should be listed in the notes, together with recordation data and their proposed status.

11) DS Sec.2-03.2.3.D: Revise the Tentative Plat to label the recordation data for Uhl Street.

12) DS Sec.2-03.2.4.B: Revise the Tentative Plat to identify each unit/lot with the approximate square footage of each, or a note may be provided stating that all lots comply with the minimum lot size requirements.

13) DS Sec.2-03.2.4.C: Revise the Tentative Plat to clearly label and enclose with a solid line each Common Area that will have separate restrictions or a separate homeowners' association. Specifically the recreation areas. Verify that CC&Rs are submitted and that they provide for maintenance responsibility for all common areas. Or refer to DS Sec.2-03.2.5.I and identify and provide dimensions, square footage and purpose of any lots proposed for dedications based on the recreation area proposed.

14) DS Sec.2-03.2.4.F: Revise the Tentative Plat so that it is designed in accordance with Street Development Standard 3-01.0. Revise the proposed private street to meet the minimum width requirements per Figure 1 "Typical Cross Section for Interior Streets with No on Street Parking" of Supplement #8 within DS Sec.3-01. The minimum right-of-way width for private interior streets with no on street parking is 40-feet.

15) DS Sec.2-03.2.4.F: Revise the Tentative Plat so that the "T" shaped turn around meets the minimum width and setback requirements per DS Sec.3-01, Figure 3. The turn around must be setback a minimum 4-foot from the property line and must provide a minimum 24-foot width.

16) DS Sec.2-03.2.4.F: Revise General Note #21 to correctly label that parking and private streets will be paved with asphalt. PAALs are not acceptable within residential subdivisions.

17) DS Sec.2-03.2.4.J: Provide easements for all utilities (water, electric, private sewer, etc.) with recordation information or provide the description for each utility in respective Common Areas, verify that the CC&Rs match the Common Area descriptions. Easements are to be dimensioned and labeled as to whether they are public or private.

18) DS Sec.2-03.2.4.L: Provide a sealed and signed Drainage Statement from An Arizona Registered Civil Engineer for the project. The Drainage Solution submitted was not signed, sealed or dated. Provide the name and contact information for the civil engineer that prepared the Statement.

19) DS Sec.2-03.2.4.L.2: Revise the Tentative Plat and all landscaping areas to meet the minimum requirements for water-harvesting. Water harvesting areas within the required landscape areas are to be constructed to maximize stormwater run off per Ordinance #10210 The Water Harvesting Guidance Manual dated October 25. Provide a method of collecting onsite drainage to allow stormwater runoff to enter the landscape areas prior to leaving the site to help alleviate off site run off. Provide the location of the curb cuts (or other method) on the Tentative Plat with spot elevations showing that the stormwater run off is directed into these areas.

20) DS Sec.6-01: Provide a letter of approval from Environmental Services for the proposed curbside pick up for the refuse and recycling containers per the note on the Tentative Plat. Refer to Environmental Services for any additional comments.

21) DS Sec.11-01.9: Revise the Tentative Plat to clearly dimension the required 2-feet setback from all property boundaries to the proposed limits of grading, fill slopes, proposed construction, etc. Provide sufficient room to allow for the 2-feet setback from property lines to top of fill slopes and proposed construction.

22) Review and approval from TDOT Permits and Codes for all improvements within the public right-of-way will be required. A right-of-way use permit application and PIA will be required prior to construction. Refer to the following links for TDOT Forms and applications:

DRAINAGE STATEMENT:

23) DS Sec.10-02.2.3.2: A Drainage Statement may be submitted in lieu of a Drainage Report due to the existing site conditions. An Arizona Registered Professional Civil Engineering must prepare the Statement and can us their judgment on what technical information is provided for review. However in all cases, the Drainage Statement must be clearly written, sealed, and signed by the Engineer of record.


GRADING PLAN:

24) DS Sec.2-03.5.2: For future references a grading permit application will be required for this project. A grading permit may not be issued prior to Tentative Plat approval.

Within vehicular use areas, one (1) canopy tree is required for each 10 motor vehicle parking spaces and every parking space shall be located within forty (40) feet of the trunk of a canopy tree (as measured from the center of the tree trunk) per LUC 3.7.2.3.A.1.a

2. The landscape border shall be recorded as common area and maintained by the homeowners association (HOA). The subdivision CC&Rs and shall reference the maintenance standards in Sec. 3.7.6. The DSD Director may allow the recording of a public use easement with the subdivision plat in cases where the requirements of this section is the only reason for the creation of an HOA. The public use easement shall require the abutting property owner to install and maintain a landscape border in accordance with the standards in this Division. LUC 3.7.2.4.A.1.c.

COMMENTS:

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a tentative plat. If, at the end of that time, the tentative plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is July 7, 2009.

2. This project was reviewed for compliance with the Land Use Code (LUC) and Development Standards - specifically for content of DS 2-03, tentative plat standards. This project was also reviewed for compliance with rezoning case C9-07-29 (to convert the site to R-2 zoning) and Special Exception 07-26 (to allow an RCP on a site under 5 acres).

3. Per DS 2-03.2.1.D.3 & 4, on location map:
A) list adjacent township, range and section numbers
B) list recorded subdivisions by book & page next to map and keynote position on map

E) provide setback notes on sheet C1 clarifying that subdivision boundary setback at west side is the greater of 10' or 3/4 of the height of the exterior building wall due to adjacent R-3 zoning.
F) provide setback note corrected on sheet C-1 clarifying that RCP developing area setbacks used for Uhl Street to allow setback of the greater of 20' or Height of exterior building wall from nearest edge of travel lane of Uhl. (don't' mix developing and developed area setbacks.)
G) for building code requirements - place units 1 and 2 a minimum of 3' setback from north property lines.

RESIDENTIAL CLUSTER PROJECT COMMENTS DS 2-10.

13. Per DS 2-10.3.1.C, this is a density bonus per the calculations provided. Please explain which criteria are used to justify the bonus under LUC 3.6.1.4.B and how the increased density criteria are all being met.

14. Per DS 2-10.3.1.D, indicate by note that 25% of the units must be barrier free and indicate which units shall meet that criteria.

15. Per DS 2-10.3.2.D.2, provide elevation drawings of the standard unit and show
A) the setbacks to the subdivision boundaries typical for both east and west boundaries
B) the heights of the building walls facing each subdivision boundary
C) the heights of the wall(s) at street front property line
D) the garage and living area above any garage called out on the elevations
E) the building heights from grade to the roof, and from roof to top of parapet

16. Per DS 2-10.3.2.D.3, it is noted the widths of the lots are not all the same. Clarify if more than one model unit will be used in the subdivision. Be sure to provide elevation plans for all unit styles.

17. Per DS 2-10.3.2.E, provide CCRs maintaining all common areas.

RESIDENTIAL CLUSTER PROJECT COMMENTS LUC 3.6.1.

18. Per LUC 3.6.1.4.B, please declare which density increase option(s) will be utilized and explain how these density increase criteria will be met.

19. Per LUC 3.6.1.4.A.5, please declare how what percentage and which specific units will be barrier free from the right of way sidewalk to the house entry.

20. Per LUC 3.6.1.4.A.6, the drawing shows a 5' block wall surrounding the project. To meet LUC 3.6.1.4.A.6, a 6' tall wall is required. Revise

21. Per LUC 3.6.1.4.A.9, provide a note on the plat stating the following "All mechanical equipment shall be screened from adjacent streets exterior to the project and from adjacent existing residential development. Screening shall be architecturally integrated with the overall design of the RCP."

22. Per LUC 3.6.1.4.A.10, provide a note on the plat stating the following "In every RCP, there shall be no further division of land or resubdivision without the developer or successor in interest furnishing written notice to all property owners of record within the boundaries of the RCP. In no event shall further division of land occur without the written approval of the Mayor & Council."

23. Per LUC 3.6.1.4.D.2.C, staff concurs the plan meets the 300 sq. ft. open area on each lot. Please provide a note" each lot must provide 300 square feet of open area, a minimum of which 100 square feet must be consolidated and meet all criteria of LUC 3.6.1.4.D.2.C."

24. Per LUC 3.6.1.4.D.2.C, please provide a note on the plat that "along interior lot lines a 0 setback between units is provided".

25. Per LUC 3.2.5, staff is seeking determination from zoning administration on the following issues regarding the detached ramada in the common area along Uhl Street. Be advised, further comments on these issues may be forthcoming.
A) a detached accessory structure is not allowed on a site by itself, it requires a principal use that is permitted in that zone.
B) a detached accessory structure is not allowed in the area between the street front lot line (of the subdivision, which is Uhl) and a principal structure (residence on lot 2).

26. Per LUC 3.6.1.4.F, regarding parking:
A) Per DS 3-01.Fig.1, 1 guest parking space to be provided for each lot if on street parking is not provided. The amount of guest parking is insufficient.
B) Parking cannot back out into a street, as there is no street cross section within the Development Standards that allows that. Re-design street access/parking.
C) provide parking calculation on sheet C1 that indicates 1 guest parking space required for each lot when parking is not provided on street.
D) specify type of curbing where accessing garage parking spaces - show on drawing and on detail AA on sheet C2.

27. Per LUC 3.6.1.4.G.2, regarding pedestrian circulation:
A) detail AA on sheet C2 shows sidewalk, however, drawing on sheet C1 does not clarify that a sidewalk is provided. RCP standards require sidewalks to connect all lots with pedestrian access to all elements of the development.

28. Per LUC 3.6.1.5. A and B, provide CCRs to ensure HOA maintains common areas.

29. LIST ALL CONDITIONS OF REZONING ON PLAT.
30. PROVIDE SEPARATE RESPONSE LETTER ADVISING HOW ALL CONDITIONS OF REZONING WILL BE MET.
