This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

1. Obtain a letter from the PCWMD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

The proposed final plat for this condominium project has been reviewed, and found to be unacceptable. The following comments replace and supercede those comments in Tom Porter’s September 12, 2008 review letter for the above referenced submittal.


Sheet 9: The existing 15’ public sewer easement granted by Book 32, Page 32 must be shown on this sheet final plat. It also must be shown in a surveyable manner.

The retaining walls constructed across the existing 15’ public sewer easement granted by Book 32, Page 62, M&P and the grading authorized on the site (under City of Tucson Site Plan No. T07CM00467) physically block the Pima County Regional Wastewater Reclamation Department’s (PCRWRD’s) sewer maintenance vehicles from being able to travel down this easement from manhole to manhole.

These features of the proposed development (which have now been constructed) create an excessively long dead end sewer easement on the north side of this development, with no location where the PCRWRD’s sewer maintenance vehicles can physically turn around at or within 150’ of existing public sewer manhole 7041-07 without trespassing.

These features of the proposed development (and the design of on-site private streets) also physically block PCRWRD sewer maintenance vehicles from reaching existing public sewer manhole #7071-09 via the proposed private streets of this development. The PCRWRD’s ability to access this manhole from the south via the existing 15’utility easement created by Book 40, Page 66, M&P, is blocked by mailboxes, steep side slopes and landscaping, and is also somewhat legally questionable, as there are no public sewers in that utility easement.

Also per City of Tucson Site Plan No. T07CM00467, the northernmost side of the proposed garage for Unit 5 will encroach into the existing 15’ public sewer easement, which both further reduces the ability of the PCRWRD to use this easement for its intended purposes, and may lead to this structure being damaged when replacement of existing public sewer line, G-84-88, becomes necessary.

PCRWRD staff and PCDSD’s Development Review Division wastewater review staff were not provided with the opportunity to review and comment on the features of development shown on T07CM00467.

It should also be noted that Mr. Gerry Koziol’s review and approval of Site Plan No. T08PL00475 was limited strictly to assessing whether the point and method of connection to the public sewer was appropriate, and the assessment of connection fees. While Mr. Koziol is employed by PCDSD Technical Services Division, he is not authorized to speak for the PCRWRD regarding such easement encroachments, and his approval of Site Plan No. T08PL00475 does not constitute any form of authorization to encroach into this easement.

During a short site visit of the property on Friday, October 3, 2008, I saw that a utility trench had been dug directly over existing public sewer line, G-84-88, between existing manholes #7071-08 and #7071-09, and what appeared to be telephone cabling being installed in this trench. The PCRWRD authorized no such installation over this public sewer line, and the unauthorized installation of such utilities directly over ours without our written consent is another form of unauthorized encroachment into this easement.

Until such time that the PCRWRD has been provided with adequate legal and physical access to those portions of existing public sewer line, G-84-88, located both on and immediately north and south of this property, and the remainder of the items in this letter adequately addressed, neither of the following may occur:
Approval of the final plat.
Issuance of a signed ADEQ/PDEQ Sewer Service Agreement form for this project, which is necessary to obtain PDEQ’s Subdivision Approval and an ADOR Public Report.

Should the owner(s)/developer(s) of this property proceed with constructing the buildings shown on City of Tucson Site Plans No. T07CM00467 and T08PL00475 prior to the resolution of the issues identified in this letter, they will do so at their own risk.

The PCRWRD may elect to refer this matter to the Pima County Attorney’s Office for formal enforcement of the County’s easement property rights, if the issues identified in this letter are not resolved via informal processes in a timely manner.

SUMMARY OF MEETING:

Agreements Reached:

Adequate vehicular access to existing public sewer manhole #7041-09 (on-site, just inside southern boundary of the project) can be provided by:
Moving the patio wall to the southernmost boundary of the property, and bringing MH #7041-09 up to grade, so that can be reached from the proposed private streets of the project by driving down the existing 15’ public sewer easement created by Book 32, Page 62, M & P.
Keeping all planting within the existing public sewer easement to a minimum and limited to low shrubs that are on the PCRWRD’s Approved Plant List.
Constructing the vertical curbs of the private streets and the driveway for Unit 6 within and for 5’ on each side of the existing 15’ public sewer easement, to withstand H20 loading.
The landscaping within that portion of the existing 15’ public sewer easement between existing public sewer manholes #7041-07 and #7041-08 will also need be minimized and limited to low shrubs that are on the PCRWRD’s Approved Plant List.
Ms. Gehlen indicated that the above referenced changes to the project were acceptable, but would require a revised Landscape and Site Plan for the project, to ensure that the COT inspectors would know that these revisions had been approved.
The retaining walls constructed across the existing public sewer easement prevent PCRWRD’s sewer maintenance vehicles from traveling along the easement from manhole to manhole and will increase the cost and difficulty of repairing and/or replacing the public sewer within this easement, when this becomes necessary. Also, the garage for for Unit 5 will overhang the easement into the existing further making repair and/or replacement of this sewer more difficult. Fuirthermore, with the additional fill being placed over the existing sewer line, the recorded easement no longer meets the PCRWRD’s minimum requirement of the easement width being twice the depth of the sewer. For these reasons, the PCRWRD’s approval of the final plat for this project will need to be contingent upon Mr. Spreiser and Mr. Coelho entering into an Easement Encroachment/Hold Harmless Agreement (or Restrictive Notes on the Final Plat) to bind the future homeowner’s association to all of the following:
Bearing all costs of repair and/or replacement to the retaining walls constructed across the existing 15’ public sewer easement created by Book 32, Page 62, M&P., should replacement of public sewer line, G-84-88 become necessary.
Holding Pima County harmless in the event that Unit 4 of this project are damaged during any replacement of public sewer line, should replacement of public sewer line, G-84-88 become necessary.
Adequate vehicular access to existing public sewer manhole #7041-08 (on-site, in one of the proposed private streets) will be provided by the proposed private streets, which are located in common areas, which will be dedicated to Pima County by the final plat as public sewer easements.
Mr. Spreiser and Mr. Coelho agreed to adjust the rim of MH #7041-08 to grade during the construction of the private streets, and to adjust the rim of MH #7041-09 to grade, if necessary, and to acquire one or more PCRWRD Small Activity Permits for this work prior to starting these tasks.
Adequate vehicular access to existing public sewer manhole #7041-07 (off-site, on Parcel 116-21-378B; City of Tucson property being utilized as a detention basin) could be provided by the City of Tucson granting Pima County a blanket easement across Parcel 116-21-378B. (Ms. Gehlen had left this meeting by the time this was being discussed, to attend another meeting.) The PCRWRD agreed not to require any grading or stabilized driving surfaces within this blanket easement.
The PCRWRD will provide a tubular steel swing gate across the proposed entrance into Parcel 116-21-378B between this project and the guardrail along Sentinel Peak Road to prevent unauthorized vehicles from entering Parcel 116-21-378B at this point.

Action Items:

Mr. Spreiser and Mr. Coelho agreed to brief Mr. Jim Rossi of COT Real Property on the situation and the need for the public sewer access (ingress/egress) easement.

Mr. Spreiser and Mr. Coelho are to arrange for the telephone cabling on the site to be relocated outside of the existing 15’ public sewer easement.

Bright Design Associates is to show the existing 15’ public sewer easement created by Book 32, Page 62, M & P on the final plat in a surveyable manner, and:
A) Add a Restrictive Note to the final plat that states:

THE HOMEOWNER’S ASSOCIATION AND THE OWNERS OF UNITS 4, 5 & 6 SHALL MINIMIZE AND LIMIT THE LANDSCAPING WITHIN THE EXISTING PUBLIC SEWER EASEMENT ADJACENT TO THESE UNITS TO GROUND COVER AND LOW SHRUBS SHOWN ON PIMA COUNTY REGIONAL WASTEWATER RECLAMATION DEPARTMENT’S APPROVED PLANT LIST.

B) Add a Restrictive Note to the final plat that states:

IN THE EVENT THAT REPLACEMENT OF THE EXISTING PUBLIC SEWER WITHIN THE PUBLIC SEWER EASEMENT CREATED BY BOOK 32, PAGE 62, M&P, BECOMES NECESSARY; THE HOMEOWNER’S ASSOCIATION SHALL BEAR ALL COSTS ASSOCIATED WITH THE REMOVAL AND REPLACEMENT OF ALL RETAINING WALLS, PATIO WALLS AND OTHER PERMANENT FEATURES OF DEVELOPMENT LOCATED WITHIN OR ACROSS THE PUBLIC SEWER EASEMENT.

C) Add a Restrictive Note to the final plat that states:

IN THE EVENT THAT REPLACEMENT OF THE EXISTING PUBLIC SEWER WITHIN THE PUBLIC SEWER EASEMENT CREATED BY BOOK 32, PAGE 62, M&P, BECOMES NECESSARY; THE HOMEOWNER’S ASSOCIATION AND THE OWNERS OF UNITS 4 & 5 SHALL HOLD PIMA COUNTY HARMLESS IN THE EVENT THAT UNIT 4 OF THIS PROJECT IS DAMAGED DURING THE REPLACEMENT OF THE PUBLIC SEWER.

D) Add a Restrictive Note to the final plat that states:

THE HOMEOWNER’S ASSOCIATION AND THE OWNERS OF UNITS 4, 5 & 6 SHALL NOT CONSTRUCT ANY ADDITIONAL PERMANENT STRUCTURES (I.E., MASONRY WALLS, FENCES, ETC.) WITHIN OR ACROSS THE EXISTING PUBLIC SEWER EASEMENT ADJACENT TO THESE UNITS WITHOUT SEPARATE WRITTEN CONSENT OF THE PIMA COUNTY REGIONAL WASTEWATER RECLAMATION DEPARTMENT.

Eric Weiduwilt and I met with Jim Rossi of COT Real Property on 10/14/08 and discussed the possibility of the City of Tucson granting Pima County a blanket ingress/egress easement across the following City of Tucson owned properties:

Mr. Rossi indicated that this might indeed be possible, in exchange for one or more tubular steel gates to keep unauthorized vehicles out of this retention/detention basin area, as he knows of no plans for these parcels to be used as anything other than retention/detention basin. He also indicated that COT DOT might prefer a more specific ingress/egress easement, however, and he wouldn’t know the answer to that until after he has the opportunity to discuss this matter in depth with COT DOT.

The PCRWRD agreed to ask PC Real Property staff to work with Mr. Rossi of COT Real Property toward formalizing the necessary easements(s) via a Memorandum of Understanding or other acceptable instrument.

Upon receipt an acceptable draft Memorandum of Understanding or other acceptable instrument for the blanket easements, and a revised final plat addressing Action Item 4 of this meeting summary:
PCRWRD staff may conditionally approve the final plat for this project.
PCRWRD and/or PCDSD staff may sign a PDEQ or ADEQ Sewer Service Agreement form for the project, allowing the project to obtain a Subdivision Approval and Real Estate Report.

Upon receipt of final ingress/egress easement documents, PCRWRD will prepare one or more contracts to:
Construct the necessary gate(s) to prevent unauthorized access onto Parcel 116-21-378B
Bring MH ##7041-07 back up to grade. (It had been buried under a foot or so of dirt during the construction of the retaining walls for this project.)

Mr. Spreiser and Mr. Coelho are to obtain a Small Activity Permit from PCRWRD’s Central Permits Group (740-6360) for all manhole rim adjustments.
