COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is January 15, 2010.

2. D.S. 2-03.6.2.J Add the following General Note to the final plat "THIS SUBDIVISION IS SUBJECT TO ORDINANCE NO. C15-07-01 WHICH ESTABLISHED ZONING IN THE WEST VALENCIA DISTRICT ANNEXATION AREA."

3. D.S. 2-03.6.3.D Revise the Approval block to include "ARIZONA" following "CLERK OF THE CITY OF TUCSON:. Also change the reference to "2007" to reflect the correct year.

4. D.S. 2-03.6.3.D Revise the "RECORDING DATA" block to match the information shown in D.S. 2-03.6.3.D

5. D.S. 2-03.6.6 There are numerous references to "Common Areas" within the CC&R's but there are no common areas called out on the final plat. If common areas are to be used delineate the common areas on the final plat and add the common areas to the title block.

6. There is a "10 LANDSCAPE BUFFER EASEMENT TO BE GRANTED BY THIS PLAT" called out on the plat. Zoning acknowledges that a 10" landscape buffer is required but is unclear as to why an easement is proposed, please clarify.

SUMMARY: Engineering Division of Development Services Department has received, Sheets 1 thru 4 of the proposed Final Plat, a copy of the recorded CC&Rs and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&Rs and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat to include a reference to the common areas per the CC&Rs. Provide a clear definition of the common area(s) within the Title Block.

2) DS Sec.2-03.6.2.J: Revise the Final Plat to clearly delineate the proposed common areas. The common areas are defined per the CC&R however the common areas versus the building pad locations must be clearly delineated to show the exact location of the common area that will require maintenance and access per the CC&Rs.

3) DS Sec.2-03.6.3.B.1: Revise the Certification of Title paragraph to accurately read the following statement from the Development Standard section referenced, "We, the undersigned, hereby warrant that we are the owners and the only parties having any interest in the land shown on this plat, and we consent to the subdivision of said land in the manner shown hereon." Remove the wording "Record Title."

4) DS Sec.2-03.6.3.B.2.b: Revise the 3rd dedication paragraph to correctly read per the Development Standard; "We hereby grant to the Public and all utility companies all easements as shown hereon for the purpose of access for installation and maintenance of the public sewers and utilities and other uses as designated by this plat." Revise to read "grant" instead of "convey."

5) DS Sec.2-03.6.3.B.4: Revise the signature lines to include the name and title of the person(s) who will sign the plat Mylar. Revise the description for the first title line to spell out the word "Company."

6) DS Sec.2-03.6.3.C: Clarify the Assurances that will be submitted for the proposed improvements. If applicable depending on the type of Assurances proposed add the Beneficiary paragraph to include the Trust Number that is applicable to this project.

7) DS Sec.2-03.6.3.D: Revise the Approval Paragraph to include the correct year, 2009 and to provide the word "Arizona" at the end of "...City of Tucson, Arizona."

8) DS Sec.2-03.6.3.D: Revise the Recording Data Paragraph to include all of the statement from the referenced section. The statement on the proposed plat is missing the following language; "Witness my hand and official seal, the day and year above as written."

9) DS Sec.2-03.6.3.E: Revise the Assurance paragraph to remove the additional wording that is not part of the Development Standard language; "There are no public infrastructure improvements requiring assurances." Assurances are required for the proposed drainage infrastructure, underground stormwater system, etc.

10) DS Sec.2-03.6.4.C: Revise the Final Plat to clearly enclose with a solid line each common area, label the common area individually, if applicable, with a separate letter designation that will have separate restrictions. The submitted CC&Rs and General Note #14 describe the common areas; however the final plat must clearly delineate them from the proposed building foot print areas.

11) DS Sec.2-03.6.5.A: Clarify or revise the Final Plat, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.

12) DS Sec.2-03.6.5.C.1.a: Revise Sheet 2 and 3 of the Final Plat to label the north section line of Section 15 as the "Basis of Bearing."

13) DS Sec.14.3.2: Provide a note on the Final Plat stating that, (a) the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and underground retention system; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and underground retention facilities at lease once every 6 months, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and underground retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with the maintaining of the drainage and underground retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities."

14) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until Financial Assurances are submitted and approved. The Final Plat Dedication Paragraphs must be revised to reflect the type of Assurances proposed, i.e. 3rd Party Trust that would require a Beneficiary Section.


GENERAL COMMENTS:

Provide a revised Final Plat and a Financial Assurance Package at re-submittal.

The revised Final Plat and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and Assurance Package.

The proposed sewer collection lines to serve the above-referenced development have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ), and the Pima County Regional Wastewater Reclamation Department (PCRWRD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


The PDEQ and the PCRWRD hereby approve the above referenced submittal of the Final Plat as received by us on January 15, 2009.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.
