SUMMARY: Engineering Division of Planning and Development Services Department has received, Sheets 1 thru 3 of the proposed Final Plat, a copy of the Assurance package, Covenants, Conditions and Restrictions (CC&R's) and the Title Report. Engineering Division has reviewed the submitted Final Plat and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.3.E: Revise the signature lines of the Assurance paragraph to reflect the new name of the Department.

2) DS Sec.2-03.6.5.A: Revise the Final Plat to clearly indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.

3) DS Sec.2-03.6.5.C.5: Revise the Final Plat to clearly indicate in plan view whether the distance and bearings between monuments were measured or calculated for all property line boundary information.


COVENANTS, CONDITIONS, AND RESTRICTIONS (CC&R'S):

4) DS Sec.2-03.6.6: Revise the CC&R's to accurately reflect all of the proper Common Area labels. Revise the following information within the CC&R's:

a) Revise the Title Page and all references within the declaration to accurately describe the Common Areas with descriptions per the Title Block. The CC&R's and Title Block must match with exact wording for the subdivision name and Common Areas.

b) Revise Page 1 to include the Declarant name of the LLC and to correct the 2009 date to read 2010.

c) Revise Page 2 Section 1.3 to include the Declarant name of the LLC.

d) A final signed original notarized copy of the CC&R's will be needed prior to approval of the Final Plat.


ASSURANCE PACKAGE COMMENTS:

5) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Revise the assurance package and address the following comments:

I. Provide a copy of the original Trust Agreement.
II. Amendment to Trust:
a) Revise the legal description on Page 1, Section 1 to accurately reflect the Title Block on the proposed Final Plat. Specifically remove the references to Common Element(s)/Unit(s) after Common Area(s), keep the Common Area description within the legal.
III. Agreement to Construct:
a) Revise the legal description in Section A, Page 1 to match the Title Block on the proposed Final Plat. Specifically remove the references to Common Element(s)/Unit(s) after Common Area(s), keep the Common Area description within the legal.
b) Revise Item #1 of Assurable Items located in Exhibit "B to state "Paving of private streets…." The word "private" must be within the line item.
IV. Provide a sample copy of the Special Warranty Deed with the Assurance Package.
V. For this and future projects, please provide an 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.


GENERAL COMMENTS:

Provide a revised Final Plat, Assurance Package, and CC&R's at re-submittal. The revised Final Plat submittal must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat.

submitted September 30, 2010. TEP is unable to approve the plat at this
time.



In order for TEP to approve the final plat, the following will be
required.



* Add the following paragraph to the dedication: "We hereby
grant to the public and all utility companies all easements as shown
hereon for the purpose of access, installation and maintenance of public
sewers and utilities and other uses as designated by this plat."

* Add a 10' x 10' TEP easement for the proposed junction cabinet
