RECORD OF SURVEY COMMENTS:

1) DS Sec.2-03.11.1.C: Provide documentation showing that the required 5-foot wide sidewalk with curb has been installed or is existing along Blacklidge Drive; documentation can be in the form of a finalized right-of-way use permit or clear photographic documentation. Verification that the 5-foot sidewalk is installed is required prior to Record of Survey approval.

2) DS Sec.2-03.11.7.B: Revise the Record of Survey Sheet to include a 2-inch margin on the left side and ½-inch margins on all remaining sides.

3) DS Sec.2-03.11.7.D.2: Revise the project location map to identify conditions within the square mile area, such as major watercourses (Wilson Avenue Wash, Mountain Avenue Wash, etc.).

4) DS Sec.2-03.11.7.D.3: Provide the Section, Township and Range section corners on the project location map.

14) DS Sec.2-03.11.9.B: Provide the following language for the dedication paragraph to read the following statement from the Development Standard section:

a) "We, the undersigned, hereby warrant that we are the owner(s) and the only (party/parties) having any interest in the land shown on this plan, and we consent to the subdivision of said land in the manner shown hereon."

b) "We hereby grant to the Public and all utility companies all easements as shown hereon for the purposes of access for installation and maintenance of public sewers and utilities and other uses as designated by this plan."

c) "(I/We), the undersigned, do hereby hold harmless the City of Tucson, its successors and assigns, their employees, officers, and agents from any and all claims for damages related to the use of the property depicted on this plan now and in the future by reason of flooding, flowage, erosion, or damage caused by water, whether surface flood or rainfall."

d) Add the signature lines for the property owners.

15) DS Sec.2-03.11.9.C: Provide a 5"x5" box for the County Recorder stamp. The title over the box must read, "RECORDING DATA".

16) DS Sec.2-03.11.10.B: Revise the Record of Survey to indicate all existing easements with recordation information on the subject property, specifically the "Enjoyment" easement and the ingress-egress and utility easements that are shown on the proposed Condominium Conversion Final Plat.

17) DS Sec.2-03.11.10.C.1: Provide the description for the 2 found physically monumented points for the Basis of Bearing shown on the plan. If the monuments at each end of the reference line are fully described on the plan, they need not be described in the Basis of Bearing statement. If the monuments are not described provide the recordation information for the Basis of Bearing Section.

18) DS Sec.2-03.11.10.C.3: Revise the Record of Survey to show all boundary monumentation labeled as "found" or "set." Provide a ½ inch iron rod tagged by a registered land surveyor for all set property corners and/or fully describe and show all markings on found monuments.

19) DS Sec.2-03.11.11.A: Verify that all easements of record are drawn on the plan, and recordation information, locations, widths and purposes are included. Provide a copy of the latest Title Report that shows all existing or abandoned easements must be current within 90 days.

20) DS Sec.2-03.11.11.B: Revise the Record of Survey to provide all of the following information regarding the existing public right of way for Blacklidge Drive: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts and sidewalks.

21) DS Sec.2-03.11.11.C: Provide the location of any adjacent fire hydrants, storm drains and sanitary sewers, including pipe diameter and the invert and rim elevations of all manholes and clean outs. If water mains and sewers are not located on or adjacent to the property indicate the direction, distance to, and size of those nearest the property. This information should be included on the supplemental sheet only.

22) DS Sec.2-03.11.12.A: Verify on the Record of Survey that all proposed easements (utility, sewer, access, etc.) are dimensioned and labeled as to their purpose and whether they will be public or private. Recordation information must be included on the plan prior to final approval.

23) DS Sec.2-03.11.12.E: Revise the Record of Survey to clearly show all proposed or existing driveway locations. A driveway can only access two units. Accessing 3 or more units off a single access point require the development of a street or a PAAL. The development of a street or a PAAL requires a plat process; clarify the driveway location and the need for a PAAL.


GENERAL COMMENTS:

Please provide a revised Record of Survey and a current Title Report that address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

COMMENTS:

1. THE PROJECT - AS PROPOSED - CANNOT PROCEED. The lot identified as Parcel C, as represented in the drawing and in an aerial photo, is essentially an un-buildable lot. The city cannot allow a lot to be created that cannot be developed with a primary permitted use (i.e. residentially occupied structure) meeting code standards. This parcel C is an area used for a one way egress route through the site - which is essential for the access of the development on parcel B. It does not appear that a residence could be placed on parcel C, meeting setbacks from the property lines and the PAAL, provide sufficient parking - nor meeting lot coverage maximum requirements. In addition, the development of parcel C will require full code compliance. If the applicant can demonstrate parcel B can function with an alternative access plan that will not require parcel C's heavy involvement, staff can further review the proposal.

AS A COURTESY, STAFF DID REVIEW YOUR PROJECT FOR RECORD OF SURVEY NOTATIONS AND OTHER CODE RELATED ITEMS.

2. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a record of survey. If, at the end of that time, the record of survey has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this record of survey is March 12, 2009.

2. This project was reviewed for compliance with the Land Use Code (LUC) and Development Standards (DS). The content of the Record of Survey was reviewed for compliance with DS 2-03.11.

3. Per DS 2-03.11.7.B, please provide a 2 inch margin on left side of the document.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Regional Wastewater Reclamation Department (PCRWRD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

Please add ‘SITE PLAN’ to the title block for the Reference Only sheet.
Please add ‘RECORD OF SURVEY’ to the title block for the sheet with all the surveying information of this proposed minor land division. Add the words “Book____Page____” in both the upper and lower right corners outside the margin line.
Add the project number, S08-033, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers (e.g. re-zonings, etc).

Please provide evidence of a joint sewer use and maintenance agreement due to lot split in 2007. No connection permit is found for the duplexes. Please contact Ms. Ilene Deckard of the Pima County Wastewater Management Department (740-6544) to create a JOINT SEWER USE AND MAINTENANCE AGREEMENT for the portions of the private sewers that are shared. The agreement will need to be reviewed and approved by the Pima County Wastewater Management Department.

Site Plan and Record of Survey: If private sewers exist within the ingress-egress and utility easements shown on the site plan and on the Record of Survey, please change the easement labels to “INGRESS-EGRESS/UTILITY EASEMENT/PRIVATE SEWER EASEMENT by DKG____ and PG ____”. Label all public manholes that are downstream from any existing and proposed House Connection Sewer (HCS) for this project with their IMS numbers, and rim and invert elevations.
For example, show and label the existing public sewer main north of the proposed project as EXIST. 8” VCP I-651 and the existing public manholes as EXIST MH 9236-10 and EXIST MH 9236-11. Existing public sewer information may be found on the PCRWRD Maps and Records (5th floor) or on the PCRWRD and PCDOT MapGuide internet websites.

This office will require a revised set of plans, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.
