7) D.S. 2-03.6.3.B.2.a: Per the 1st submittal comment letter from Andy Steuart, COT Real Property the dedication of new right-of-way is to be "by final plat." Since additional right-of-way is required to be dedicated, call out the dedication and dimension(s) on the Final Plat. This comment was not fully addressed.

a) Provide the recordation information, Docket and Page number, for the temporary construction easement on Lot 2.
b) Remove the word "Temporary" from the Variable Width Retention Easement notation and add a reference to a required General Note on Sheet 1 for this easement and the required future Detention/Retention Easement for Lot 2.
c) Provide a General Note on Sheet 1 to state something along the lines of "The Variable Width Retention Easement on Lot 2 will be abandoned and a new Private Underground Detention/Retention Easement will be recorded with the development of Lot 2 for the required underground detention/retention system per the Drainage Report and the Tentative Plat. Recordation information and exhibits of the new easement will be required prior to site plan approval of Lot 2."

The final plat cannot be scheduled for Mayor and Council consideration until Financial Assurances are submitted and approved. If the assurances are submitted in the form of a Third Party Land Trust, a "Beneficiary" block shall be provided as required by DS Sec.2-03.6.3.C. This comment was not fully addressed.

18) Provide an Engineer Certification (a statement along with the seal and signature of the engineer of record) for detention/retention information shown on the Final Plat. This comment was not addressed.

20) DS Sec.2-03.6.5.C.1: Revise the Final Plat to label the Basis of Bearing line in plan view along the north line of the northeast quarter of Section 13. Revise the Basis of Bearing Section to include the reference under the Basis of Bearing Section header.

21) Revise the Final Plat so that all 3 references to the Title of the Final Plat match the Title Block in the lower right corner. The top of the page, the middle right and the title block should read identical with a reference to Lots 1 and 2 for clarity purposes.

22) DS Sec.14.3.2: Revise the Drainage Note on Sheet 1 of the Final Plat to state the following per the Tentative Plat, "(a) the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and underground retention system; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and underground retention facilities at lease once every 6 months, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and underground retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with the maintaining of the drainage and underground retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities."

GENERAL COMMENTS:

Provide a revised Final Plat and a Financial Assurance Package at re-submittal.

The revised Final Plat and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and Assurances.
