The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

Sheet 1: Add a General Note that states:

THE ON-SITE SEWERS ARE EXISTING AND PRIVATE. NO NEW SEWERS ARE PROPOSED.

Sheet 1: In the Dedication Block, second paragraph, seventh line after the word ELEMENTS add the words ,AND PRIVATE SEWERS.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

COMMENTS:

1. An applicant has one (1) year from the date of application to obtain approval and recordation of a final condominium plat that complies with zoning and other development requirements in effect at the time of application. This final condominium plat must be approved and recorded on or before 1/21/09.

2. DS 2-03.6.1.C All lettering and dimensions will be the equivalent of twelve (0.12) point or grater in size. The purpose of this requirement is to assure that all lettering is legible when reproduced or photographically reduced for record keeping purposes.

3. DS 2-03.6.1.K Case number S07-200 has been assigned to this final plat. Please place this number in the right corner of all sheets of the final plat.

4. DS 2-03.6.2.A Revise general note #1 on sheet 1 to read: "The gross area of this subdivision is .38 acres."

5. DS 2-03.6.2.B Add a note to the general notes on sheet #1 to read: "The total number of lots is 10."

6. DS 2-03.6.2.H Revise general note #7 on sheet #1 to read: "There will be no further division of lots without the expressed approval of the City of Tucson."

7. Remove all sidewalks, curbs, trash enclosure, fences , walls and cross hatching from the plat.

8. DS 2-03.6.4.C Label each common area and limited common element individually with a separate letter designation. Enclose with a solid line each common area and limited common element that will have separate restrictions. This information is required on sheet #1.

The last approved site plan submitted indicates that each unit has its own "back yard". These are considered limited common elements for the use of an individual owner. Clearly indicate such.

The bicycle parking lockers and maintenance building are also considered limited common elements.

"Limited Common Elements" means a portion of the common elements so designated in the declaration as being reserved for the use of a certain unit or units to the exclusion of other units, including but not limited to balconies, terraces, patios and parking spaces or facilities."

In the title block of all pages list the common areas and limited common elements.

9. LUC 4.1.9.2 Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.
a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.
b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.
1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.

10. DS 2-03.6.6.A On the cover sheet and page one of the CC&Rs provide the number of units within this project. (Units 1-10)
11. Clearly define the boundaries of the electrical easement along the south side of the property. Remove the electrical transformer from the plan.

12. Review LUC Sec. 2-03.6.3 and provide the applicable Final Plat Standard Paragraphs.

submitted December 20, 2007. TEP is unable to approve the plat at this
time. In order for TEP to approve the final plat, make the following
changes to the dedication:

Add the following paragraph:

"AN EASEMENT IS GRANTED FOR THE PURPOSE OF ACCESS, INSTALLATION,
REPLACING, REPAIRING, AND MAINTENANCE OF ELECTRICAL METERS, CABLE AND
CONDUITS, WHICH GROUPED ELECTRICAL METERS ARE ATTACHED TO THE EXTERIOR
WALLS."

Show the requested dedication on the resubmittal of the final plat.
