03/14/2008 STEVE SHIELDS ZONING REVIEW Denied CDRC TRANSMITTAL

TO: Development Services Department Plans Coordination Office
FROM: Steve Shields
Lead Planner

PROJECT: Monte Vista Condominiums
S07-186
Final Plat (2nd Review)

TRANSMITTAL DATE: March 14, 2008

DUE DATE: March 20, 2008

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is November 25, 2008.

2. This comment has not been addressed. LUC Sec. 4.1.9.2 states "Disclosure Requirements. Any subdivider who files a final plat for a condominium, cooperative, community apartment, townhouse, or mobile home park subdivision, whether for the purpose of new development or the subdivision of an existing development, shall submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following. Provide documentation on how the condo conversion meets the requirements of LUC Sec. 4.1.9. If the project is currently under construction and the units have not been leased the requirements of LUC Sec. 4.1.9 may not apply.

If you have any questions about this transmittal, please contact me at Steve.Shields@tucsonaz.gov or (520) 837-4956

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Revised final plat, CC&R's and additional requested documents.
03/18/2008 JASON GREEN ENGINEERING REVIEW Denied DATE: March 18, 2008
SUBJECT: Monte Vista Condominiums Final Plat Submittal- 2nd Engineering Review
TO: Patricia Gehlen, CDRC Manager
LOCATION: 3943 E Monte Vista Dr, T14S R13E Sec 34 Ward 3
REVIEWERS: Jason Green, CFM
ACTIVITY: S07-186

SUMMARY: Engineering Division of Development Services Department has received the revised sheets, Sheet 1, 2 and 3 of the proposed Final Plat, a copy of the CC&R's and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&R's and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:

FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.H: Revise the Title Block to add "A Condominium Conversion Project" in the lower right corner of each Sheet. The response comment does not make since. The original site plan was approved for an apartment complex and by applying for a Final Plat to convert the rental apartments into sellable units, by rule of thumb that would make this activity (S07-186) a Final Plat Condominium Conversion whether or not the units are still under construction.
2) DS Sec.2-03.6.4.C: Verify the exact location of Common Element "B." Per the approved site/grading plan there is a 11.5' drainage swale that runs along the east side of the west property line. Per the proposed plat this area is now being dedicated as private yards. All drainage infrastructures must be located within Common Element "B" for maintenance purposes, revise.
3) DS Sec.2-03.6.5.C.4: Revise the Final Plat to fully describe and show all markings on found monuments. This comment was not addressed. The legend only says "Found Property Pin," it needs to be fully described (i.e. a one-half inch iron rod, stamped pin in concrete marked with…).
4) DS Sec.2-05.6.5.C.5: Revise all distance and bearing between monuments used to indicate whether measured or calculated. This comment was not fully addressed at resubmittal. All measurements with a bearing must be labeled as measured or calculated, revise.
5) DS Sec.2-03.7.1.F: Since the development is a conversion to a condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 do apply and they need to be submitted with the resubmittal of the final plat. Please provide all documentation required, if a statement is not applicable then it must be shown in the comments as to why it does not apply (i.e. if tenants have not yet occupied the units then make the statement under that bullet item to that affect).
6) Provide the final signed original copy of the Covenants, Conditions, and Restrictions (CC&R's) that is required prior to the approval of the Final Plat.

GENERAL COMMENTS:

Provide a revised Final Plat and an original CC&R package (signed and notarized) at re-submittal. The revised Final Plat must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments. Further comments may be generated upon resubmittal of the Final Plat and CC&R's.

If you have any questions or to schedule a meeting I can be reached at 837-4929.

03/19/2008 ANDY STEUART COT NON-DSD REAL ESTATE Approv-Cond Request gas easement, DKt. 1319 Pg. 728, be abandoned due to multiple reasons as follows:
-The easement form is not satisfactory and SW Gas has validated this problem.
-The gas easement corridor is within Common Element "A" & "B" which are to be dedicated for utility easments, creating an easement within an easement, creating a potential unwanted situation.
