12/14/2007 STEVE SHIELDS ZONING REVIEW Denied CDRC TRANSMITTAL

TO: Development Services Department Plans Coordination Office
FROM: Steve Shields
Lead Planner

PROJECT: Monte Vista Condominiums
S07-186
Final Plat

TRANSMITTAL DATE: December 14, 2007

DUE DATE: December 24, 2007

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is November 25, 2008.

2. D.S. 2-03.6.1.D.3 The section corners shown on the south end of the location map are incorrect. The south side of Grant Road sections are 04 & 03, revise the location map.

3. D.S. 2-03.6.1.K Place the S07-186 subdivision case number assigned to the plat in the lower right hand corner of the plat next to the title block.

4. D.S. 2-03.6.4.C It appears that parking spaces are to be assigned to each unit, "LIMITED COMMON ELEMENTS "A"". If the plan is to call these out as limited common elements then each parking space must be called out as a single limited common element with a separate letter designator. Zoning recommends that the entire parking area be called a common element and assignment of parking be handled within the Condominium Declaration or some type of Covenant, Conditions and Restrictions (CC&R's). If you decide to use the common element for the parking you could combine all the landscape, parking and pedestrian access into one common element. Ensure that any changes to the common elements or limited common elements are reflected on the title block.

5. Provide documentation on how the condo conversion meets the requirements of LUC Sec. 4.1.9. If the project is currently under construction and the units have not been leased the requirements of LUC Sec. 4.1.9 may not apply.

If you have any questions about this transmittal, please contact me at Steve.Shields@tucsonaz.gov or (520) 837-4956

SUBJECT: Monte Vista Condominiums Final Plat Submittal- Engineering Review

ACTIVITY: S07-186

SUMMARY: Engineering Division of Development Services Department has received, Sheet 1, 2 and 3 of the proposed Final Plat, a copy of the CC&R's and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&R's and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:

FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.D.3: Revise the project location map to correctly label the Township, Range and Section corners. The section corners at the intersection of Alvernon and Grant must be revised.

2) DS Sec.2-03.6.1.H: Revise the Title Block to add "A Condominium Conversion Project" in the lower right corner of each Sheet.

3) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&R's to match each other. All names, common elements, and descriptions must have the same wording in the CC&R's as in the Title Block.

4) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S07-186), it may be added to the lower right hand corner of the plans on all sheets.

5) DS Sec.2-03.6.2.I: Provide a General Note on Sheet 1 of 3 that states the following: "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."

6) DS Sec.2-03.6.3.D: Under recording data statement, provide the name of the current Pima County Recorder.

7) DS Sec.2-03.6.3.E: Revise the last signature line under the Assurance Block to accordingly reflect the following information,
_______________________________________________
City of Tucson Development Services Engineer Administrator

8) DS Sec.2-03.6.4.C: Verify the exact location of Common Element "B." Per the approved site/grading plan the retention basin and drainage area located in the northwest corner is not correctly represented on the Final Plat with the boundary location of the referenced Common Element "B", revise.

9) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.

10) DS Sec.2-03.6.5.C.4: Revise the Final Plat to fully describe and show all markings on found monuments.

11) DS Sec.2-05.6.5.C.5: Revise the distance and bearing between all monuments used to indicate whether measured or calculated. Measured is the physical, direct occupation of a point/line by line of sight and not through calculations of other measured distances.

Covenants, Conditions, and Restrictions (CC&R's): A final signed original copy of the CC&R's is required for approval of the Final Plat.

12) DS Sec.2-03.6.6.A: Revise the CC&R's to accurately reflect all of the proper common area labels and responsibility for maintenance and liability for any proposed commonly-owned areas. Revise the following information within the CC&R's:

a) Revise Page 1; paragraph 1 to accurately describe the property per the Title Block. Either the CC&R's or the Title Block must be revised and must match with exact wording for the name and Common Elements.

b) Revise Page 16, Article X; Revise the wording in the language to include the retention basin, drainage and landscape area that is within Common Element "B", as shown on the approved site plan.

13) DS Sec.2-03.7.1.F: Since the development is a conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required.

14) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:

a) If there is any remaining construction, the financial assurances shall be submitted and approvable; or,

b) Provide a copy of Certificate of Occupancy (CofO) paperwork accepted by the City of Tucson for the final construction.

15) DS Sec.7-01.3.A: All easements that are shown on the Title Report must either be abandoned or the easement is to be shown on the Final Plat with the width, purpose of granting, and recording data of the original subdivision plat or separate instrument shown. Specifically explain Items #5 and 6 in Schedule B of the Title Report.

GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package and either an Assurance Package or a final CofO at re-submittal.

The revised Final Plat and CC&R's must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and CC&R's.
