SUMMARY: Engineering Division of Development Services Department has received, Sheet 1 and 2 of the proposed revised final Plat, and copy of the CC&Rs. Engineering Division has reviewed the submitted Final Plat and CC&Rs and does not recommend approval of the Final Plat or CC&Rs at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

2) DS Sec.2-03.6.3.A: For Final Plat approval the Certificate of Survey section must be sealed and signed by the Surveyor and Engineer of Record prior to Mylar submittal. The word "Preliminary" works for initial review (must be included on both stamps), however final Mylar approval will not be given until the Final Plat is sealed and signed. Note: It appears that the preliminary block is not snapped over the digitized stamp. May want to have drafter fix and save so that it is not an issue of future projects. Engineering digitized stamp along with preliminary note appears to be correct. It is acknowledges that mylar will be signed. But, all stamps must either signed and dated or marked as preliminary.

5) DS Sec.2-03.7.1.F: Since the development is a conversion to a COMMERCIAL condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required the Final Plat can not be approved prior to Zoning review of the above applicable items. - See Zoning Comments.

6) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:

a) If there is any remaining construction, the financial assurances shall be submitted and approvable; or,

b) Provide a copy of Certificate of Occupancy (CofO) paperwork accepted by the City of Tucson for the final construction. Per Matt Flick, PE and David Rivera, Zoning Supervisor a Letter of Completion will not work to satisfy this requirement. A CofO or Assurances must be submitted for review. For further clarity please contact Matt Flick at 837-4931 or David Rivera at 837-4957. - Acknowledge response in comment letter, provide email that states that a Letter of Completion is the equivalent to a Certificate of Occupancy.

7) Please concider providing a table of contents so that it is easier to find the sections provided.

8) Please number each sheet of the pages submitted in the CC&R(s) and provide copy of original signed revised copies.


GENERAL COMMENTS:

Provide a revised Final Plat at resubmittal

The revised Final Plat must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat.
