This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

SUMMARY: Engineering Division of Development Services Department has received, Sheet 1 and 2 of the proposed revised final Plat, a copy of the CC&Rs and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&Rs and Title Report and does not recommend approval of the Final Plat or CC&Rs at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&Rs to match each other. All names, common elements, and descriptions must have the same wording in the CC&Rs as in the Title Block. This item was not fully addressed with this submittal.

2) DS Sec.2-03.6.3.A: For Final Plat approval the Certificate of Survey section must be sealed and signed by the Surveyor and Engineer of Record prior to Mylar submittal. The word "Preliminary" works for initial review (must be included on both stamps), however final Mylar approval will not be given until the Final Plat is sealed and signed.


Covenants, Conditions, and Restrictions (CC&Rs):

3) A final signed original copy of the CC&Rs is required for approval of the Final Plat.

4) DS Sec.2-03.6.6.A: Revise the CC&Rs to accurately reflect all of the proper common elements labels and responsibility for maintenance and liability for any proposed commonly-owned elements. Revise the following information within the CC&Rs:

a) Revise the title page and Page 2; paragraph 1 to accurately describe the property (Name, number of units, common elements, with descriptions) per the Title Block. Either the CC&Rs or the Title Block must be revised and must match with exact wording for the name and Common Elements (with descriptions). This comment was not fully addressed with this submittal.

b) Revise Pages 36 and 37; Revise the CC&Rs within the maintenance section to correct the typographical error for the "detention/retention" basin, the wording in the CC&Rs states "detension/retension", revise.

c) Provide Exhibit A within the CC&Rs as stated. The legal description for the subdivision must be provided within Exhibit A prior to CC&R approval.

5) DS Sec.2-03.7.1.F: Since the development is a conversion to a COMMERCIAL condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required the Final Plat can not be approved prior to Zoning review of the above applicable items.

6) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:

a) If there is any remaining construction, the financial assurances shall be submitted and approvable; or,

b) Provide a copy of Certificate of Occupancy (CofO) paperwork accepted by the City of Tucson for the final construction. Per Matt Flick, PE and David Rivera, Zoning Supervisor a Letter of Completion will not work to satisfy this requirement. A CofO or Assurances must be submitted for review. For further clarity please contact Matt Flick at 837-4931 or David Rivera at 837-4957.


GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package and either an Assurance Package or a final CofO at re-submittal.

The revised Final Plat and CC&Rs must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and CC&Rs.
