The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

This project will be tributary to the Roger Road Wastewater Treatment Facility via the Southeast Interceptor. Obtain a letter from the PCWMD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

The development plan for this project cannot be approved until a copy of this letter has been received by this office.

All Sheets Show the jurisdiction’s case number, S07-182, in or near the title block of each sheet. This case number should be shown larger and bolder than any associated cross-reference numbers.

Sheet 1: Add a General Note that states:

ANY RELOCATION, MODIFICATION, ETC., OF THE EXISTING UTILITIES AND/OR PUBLIC IMPROVEMENTS REQUIRED BY THIS DEVELOPMENT WILL BE AT NO EXPENSE TO THE PUBLIC.

Sheet 1: Add a General Note that states:

ANY WASTEWATER DISCHARGED INTO THE PUBLIC SANITARY SEWERAGE SYSTEM SHALL MEET THE REQUIREMENTS OF THE INDUSTRIAL WASTE ORDINANCE (PIMA COUNTY ORDINANCE NO. 1991-140, AS AMENDED).

Sheet 1: Add a General Note that states:

THE ON-SITE SANITARY SEWERS WILL BE PRIVATE AND WILL BE CONSTRUCTED, OPERATED AND MAINTAINED ON A PRIVATE BASIS, AND IN ACCORDANCE WITH AN APPROVED OPERATION AND MAINTENANCE PLAN, IF REQUIRED. THE LOCATION AND METHOD OF CONNECTION TO AN EXISTING PUBLIC SANITARY SEWER IS SUBJECT TO REVIEW AND APPROVAL BY THE PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT.

Sheet 1: Add a Permitting Note that states:

A PROJECT CONSTRUCTION PERMIT MUST BE SECURED FROM PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT BEFORE BEGINNING ANY WORK ON THIS PROJECT.

Sheet 3: The private sewer shown on Sheet 3 does not match what is shown on Sheet 4.

Sheet 3: The existing public manhole in Valencia Rd just west of this project should be IMS#8002-04.

Sheet 4: Call out the private main line BCS pipe size connected to the 8” public sewer line. Also show the slope/length of segments & material of pipe for all of the private BCS segments.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the development plan. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $150.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

SUMMARY: Engineering Division of Development Services Department has received, Sheet 1 and 2 of the proposed Final Plat, a copy of the CC&R's and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&R's and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.A: Revise the Final Plat to include a standard engineering scale, having no more than 40-feet to the inch, for all mapped data.

2) DS Sec.2-03.6.1.B: Revise each sheet of the Final Plat to include a 2-inch margin on the left side to comply with standardization requirements of state law for recorded plats.

3) DS Sec.2-03.6.1.C: Verify that all lettering on Sheet 2 is the equivalent of 12-point font or greater in size.

4) DS Sec.2-03.6.1.D.2: Identify conditions within the square mile area shown on the project location map located on Sheet 1, such as the major watercourse (Airport Wash).

5) DS Sec.2-03.6.1.D.3: Revise the project location map to label the Township, Range and Section corners for the property.

6) DS Sec.2-03.6.1.D.4: Revise the project location map to show the City's jurisdictional limits and the Pima County limits that fall within the 1 square mile area shown.

7) DS Sec.2-03.6.1.E: Revise Sheet 1 to include and index of all sheets included with the Final Plat submittal, or provide a small index drawing of the site showing the area represented on each sheet.

8) DS Sec.2-03.6.1.H: Revise the Title Block to add "A Condominium Conversion Project" in the lower right corner of each Sheet.

9) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&R's to match each other. All names, common elements, and descriptions must have the same wording in the CC&R's as in the Title Block.

10) DS Sec.2-03.6.1.I: Revise the Final Plat to include a north arrow on Sheet 2. Place the north arrow on the sheet in the upper right hand corner with the scale of the drawing beneath the arrow.

11) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S07-182) where indicated by "#", it may be added to the lower right hand corner of the plans on all sheets.

12) DS Sec.2-03.6.2.H: Provide a General Note on Sheet 1 that states the following: "There will be no further division of lots without the expressed approval of the City of Tucson."

13) DS Sec.2-03.6.2.I: Provide a General Note on Sheet 1 that states the following: "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."

14) DS Sec.2-03.6.3.A: For Final Plat approval the Certificate of Survey section must be sealed and signed by the Surveyor and Engineer of Record prior to Mylar submittal. The word "Preliminary" works for initial review, however final approval will not be given until the Final Plat is sealed and signed.

15) DS Sec.2-03.6.3.B.3.4: Provide the signature line for the property owners to include the verbiage "Printed Name" and "Signature" under the signature line.

16) DS Sec.2-03.6.3.C: Revise the Final Plat, if applicable, to include the Beneficiary information on the title page. The beneficiary information must include the Title Company Name and Trust number along with the contact information. If a Trust number is not applicable the Acknowledgment section on Sheet 1 must be filled out and the contact person must be identified.


Covenants, Conditions, and Restrictions (CC&R's): A final signed original copy of the CC&R's is required for approval of the Final Plat.

17) DS Sec.2-03.6.6.A: Revise the CC&R's to accurately reflect all of the proper common elements labels and responsibility for maintenance and liability for any proposed commonly-owned elements. Revise the following information within the CC&R's:

a) Revise Page 2; paragraph 1 to accurately describe the property (Name, number of units, common elements, with descriptions) per the Title Block. Either the CC&R's or the Title Block must be revised and must match with exact wording for the name and Common Elements.

b) Revise Page 26; Revise the CC&R's establishing responsibility for construction, maintenance, and ownership for all private common elements and all other similar joint uses. Specifically the maintenance section must provide clear responsibility for construction and maintenance of the proposed private detention/retention basins.

c) In the Common Element statement specify that all detention/retention basins in Common Elements B will require the schedule and unscheduled maintenance and certification of compliance by an Arizona registered civil engineer.

d) Provide a statement that Common Element A (private driveways, pedestrian circulation and landscape areas will also require the schedule and unscheduled maintenance and certification of compliance by an Arizona registered civil engineer.

e) Provide Exhibit A within the CC&R's as stated. The legal description for the subdivision must be provided within Exhibit A prior to CC&R approval.

18) DS Sec.2-03.7.1.F: Since the development is a conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required.

19) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:

a) If there is any remaining construction, the financial assurances shall be submitted and approvable; or,

b) Provide a copy of Certificate of Occupancy (CofO) paperwork accepted by the City of Tucson for the final construction.

20) DS Sec.7-01.3.A: All easements that are shown on the Sheet 2 of the Final Plat must be recorded prior to Final Plat approval. Provide the recordation information for the water and electric easement.


GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package and either an Assurance Package or a final CofO at re-submittal.

The revised Final Plat and CC&R's must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and CC&R's.
