The subject submittal has been reviewed and it can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that were made and references the exact location on the Plat and in the CC & R's where the revisions were made:

Final Plat:

1. The mechanism of dedicating Block 43 as a public park and granting of the 66' El Paso Natural Gas easement as a community park is still being discussed by Engineering, Parks and Recreation and City Attorney's Office. Then assurances Exhibit "B" may need to be modified to include the said parks. This Office recommends that the next Final Plat submittal is made after this issue has been resolved.
2. Parks and Recreation Department is requesting adding the following general notes:

Park Requirements:

a- PAD Letter of Refinement, May 22, 2008: This note attests to the existence of a La Estancia PAD Letter of Refinement that identifies obligations relative to the construction of certain park elements within La Estancia. That Letter of Refinement will be recorded with and made a part of this final plat. Release of certificates of occupancy for dwelling units and commercial structures within the bounds of this plat may depend on the completion and acceptance of park facilities elsewhere in La Estancia, as indicated below.
b- Julian Wash Linear Park and Gas Line Park north of Camino Boleadoras: Prior to the issuance of any certificates of occupancy for any dwelling unit or commercial structure within the bounds of this plat, the Julian Wash Linear Park, and the Gas Line Park between Camino Boleadoras and the Julian Wash, must be completed by the owner/developer, and accepted by the City of Tucson.
c- Internal Community Park and Gas Line Park south of Camino Boleadoras: Prior to the issuance of a certificate of occupancy for the first dwelling unit above and beyond a) 20% of the total dwelling units to be built within the bounds of this plat, or b) the first 250 units within the bounds of this plat, whichever comes first, the internal Community Park, and the Gas Line Park south of Camino Boleadoras must be completed by the owner/developer, and accepted by the City of Tucson.
d- Pocket Parks: Within each residential subdivision or development, a neighborhood pocket park shall be completed by the owner/developer, prior to the issuance of a certificate of occupancy for the first residential dwelling unit above and beyond 50% of the total residential units to be built in the subdivision or development. The pocket parks will be privately maintained.
e- Owner/Developer to Notify City of Tucson: The owner/developer will notify the City of Tucson Building Official and the Director of the Parks and Recreation Department, in writing, a) when 75% of the trigger number of certificates of occupancy has been applied for, to give notice of the approaching time when the park needs to be constructed; and b) when the trigger certificate of occupancy has been applied for, such that the identified park needs to be completed, and found acceptable by the City, prior to the issuance of any additional certificates of occupancy. This note applies to the Julian Wash Linear Park, the Gas Line Park, the internal Community Park, and the pocket parks.
f- Calculations for Pocket Parks: Within each residential subdivision or development, the owner/developer will provide a pocket park. At least 200 square feet of pocket park will be provided for each residential unit within the subdivision. Calculations will be provided on each subdivision plat or development plan, to demonstrate that the square footage requirement for the pocket park is being met.
g- Assurances for Parks: Future plats may include the referenced parks as assurable items.

3. Add a general note that addresses what happens to the temporary drainage easements once the blocks are developed.
4. It appears that the 40' gas easement and the 55' Private Drainage easement, shown on Sheet 3 of 8, are not included in the Title Report. Additionally, the 40' gas easement recordation numbers, on the Tentative Plat, are different from the numbers shown on the Final Plat. The Tentative Plat show the gas easement to be vacated by the Final Plat, but the Final Plat does not show the same information. Revise as necessary.
5. The 40' Gas Easement, shown on Sheet 4 of 8, within Block 40, seems to be described as Communication Facilities in the Title Report. Address this issue and revise as necessary. Check all other easement and ensure their descriptions on the Final Plat and the Title Report match.
6. It seems that there is some easement information in the Title Report that does not match the information on the Final Plat. Address this issue and revise as necessary.
7. The overhead easements, shown on the Tentative Plat, need to be shown on the Final Plat (D.S. 2-03.6.4.A.).
8. Submit an assurance package to assure the construction of the proposed parks, drainage and road infrastructure.

The design of the trail corridor improvements must be reviewed and approved by ElPaso Gas and the City of Tucson Parks and Recreation Department."
-In Dedication block, add the following words to the end of Paragraph 2, ...for park and wellsite purposes, "Subject to General Note __________." Also, add relevent item number under General Notes for the following: "The City of Tucson will not accept responsibity for maintenance and liabilty for Block 43, Internal Community Park, until park improvments have been installed by the owner/developer, inspected, and accepted by the City of Tucson, Parks and Recreation Department. The Wellsite is excluded from acceptance by Parks and Recreation Department."

This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

We will send to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of residential blocks. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the Final Plat.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Pursuant to existing agreements, Block 43 is to be dedicated to the City of Tucson for park and wellsite purposes, as indicated on the cover page dedication block. Please amend the second paragraph of the dedication block so that the last sentence reads as follows:

“We also dedicate to the City, Block 43, for park and well site purposes, subject to General Note # ____ .”

Please add a new general note that reads as follows:

“ The City of Tucson will not accept responsibility for maintenance and liability for Block 43, the ‘internal community park’, until the park improvements have been installed by the owner/developer, and inspected and accepted by the City of Tucson Parks and Recreation Department. The wellsite is excluded from acceptance by Parks and Recreation. ”

Real Estate and Parks staff is working with ElPaso Gas regarding the future park area over the ElPaso Gas Line property (i.e., the Gas Line Park). Please add the following General Note (this wording supercedes the Real Estate comment on same subject):
