COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is July 20, 2009.

2. D.S. 2-03.6.1.D.2 Identify all recorded subdivisions on the location map by book and page.

3. D.S. 2-03.6.1.F This project is located within the boundaries of a Planned Area Development (PAD) zone, PAD 7, provide a reduced-scale map of the entire PAD District on the first sheet, indicating the location of the portion being developed.

4. D.S. 2-03.6.1.H The title block shows block 43 as a "COMMON AREA". During the tentative plat review it was stated that block 43 would be dedicated to the city as a park, if this is still the case then block 43 is not common area, please clarify.

5. D.S. 2-03.6.2.B Based on the last submitted tentative plat there were 17 lots and 6 common areas, now there are 17 lots and 4 common elements listed under General note 3, please clarify what happened to common areas E & F. Also General note 3 list "COMMON ELEMENTS", please change elements to areas. On sheets 3, 4, 5 & 7 the common areas are called out as "TRACT" please clarify what is meant by "TRACT".

6. D.S. 2-03.6.2.H Add a note to the plat stating "There will be no further division of lots without the expressed approval of the City of Tucson."

7. D.S. 2-03.6.3.D In the Approval block provide "ROGER W. RANDOLPH" in the (fill in name of current City Clerk) space.

8. D.S. 2-03.6.3.D In the Recording Data block provide "F. ANN RODRIGUEZ" in the (name of current Recorder) space.

9. D.S. 2-03.6.6 Zoning acknowledges receipt of the "Master Declaration of Covenant, Conditions and Restrictions of La Estancia De Tucson". Within the CC&Rs there are exhibits, i.e. the Specific Plan. As the PAD and plat is being revised the changes will need to be reflected with in the CC&R's exhibits.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

Sheet 1: In the Dedication Block, third paragraph, first line after the word PUBLIC add the words ,PIMA COUNTY.

Sheet 1: In the Dedication Block, fourth paragraph, third line after the word PUBLIC add the words ,PIMA COUNTY.

We will send to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of residential blocks. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the Final Plat.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

The subject submittal has been reviewed and it can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that were made and references the exact location on the Plat and in the CC & R's where the revisions were made:

Final Plat:

1. Show the nearby major watercourse on the Location Map (D.S. 2-03.6.1.D.2.).
2. Include the Township and Range in the brief legal description below the Location Map (D.S. 2-03.6.1.D.3.).
3. This project is located within the boundaries of a Planned Area Development (PAD) zone, PAD 7, provide a reduced-scale map of the entire PAD District on the first sheet, indicating the location of the portion being developed (D.S. 2-03.6.1.F.).
4. Add a note to the plat stating "There will be no further division of lots without the expressed approval of the City of Tucson." (D.S. 2-03.6.2.H.).
5. Are there proposed drainageways within the subject development? If there not, remove the word "drainageways" from the second paragraph of the Dedication.
6. If Block 43 is being dedicated to City of Tucson as a public park, it can not be considered a common area as stated in the Title Block. If the Block is going to be dedicated as a private park, it can not be called Block 43. Revise the Title Block accordingly.
7. The fourth paragraph of the "Dedication" includes Common Area "E" which is not shown on the plan nor is it included in the Title Block. Additionally, the other common areas are not included in Paragraph four of the dedication. Revise as necessary.
8. The current City Clerk is "ROGER W. RANDOLPH". Fill in the name of current City Clerk in the Approval block (D.S. 2-03.6.3.D.).
9. The current Recorder is In "F. ANN RODRIGUEZ". Fill in the name of the current Recorder in the Recording Data block as required by D.S. 2-03.6.3.D.
10. It is not clear why the word "Tract" is being used for the proposed detention basins. Clarify.
11. It seems that the Temporary Drainage Easements need to be included in the fourth paragraph of the "Dedication".
12. It appears that the 40' gas easement and the 55' Private Drainage easement, shown on Sheet 3 of 8, are not included in the Title Report. Additionally, the 40' gas easement recordation numbers, on the Tentative Plat, are different from the numbers shown on the Final Plat. The Tentative Plat show the gas easement to be vacated by the Final Plat, but the Final Plat does not show the same information. Revise as necessary.
13. The status of the easements, that are shown on the plat but are not described as either "existing" or "by this Plat", is not clear. Clarify if these easements are existing or to be dedicated by the Plat.
14. The easements that are shown and described as "to be abandoned" have to be either abandoned by this Final Plat or abandoned by a separate instrument and the abandonment recordation numbers shall be provided with the next submittal.
15. The purpose of the 33' X 33' sight visibility triangles is not clear. The required sight visibility triangles information and dimensions are provided in D.S. 3-01.5.0. Revise as necessary.
16. Indicate the width of Camino Boleadoras as required by D.S. 2-03.6.4.A.
17. The overhead easements, shown on the Tentative Plat, need to be shown on the Final Plat (D.S. 2-03.6.4.A.).
18. Show the existing El Paso Natural Gas Property and add a note stating that "an existing, underground natural gas pipeline is located within the north-south 66' wide utility easement located midway within this subdivision. See sheets ____ and ______ for exact dimensions and bearings". Provide similar notes for all existing natural gas pipeline easements.
19. Provide the square footage of each block as required by D.S. 2-03.6.4.B.
20. Show required setback lines as required by D.S. 2-03.6.4.E.
21. Corner lots may be designated with a star symbol indicating which street will be used for access (D.S. 2-03.6.4.G.).
22. Show no-vehicular access easements where applicable (D.S. 2-03.6.4.H.).
23. Indicate whether the distances and bearings between monuments are calculated or measured (D.S. 2-03.6.5.C.5.).
24. In order to expedite the plat review and approval, provide the boundary survey and closure calculation report (D.S. 2-03.6.5.C.3.).
25. The 40' Gas Easement, shown on Sheet 4 of 8, within Block 40, seems to be described as Communication Facilities in the Title Report. Address this issue and revise as necessary.
26. The recordation page number for the 5' Gas Easement within Block 46, on Sheet 4 of 8, is different from the page number provided in the Title Report. Address this issue and revise as necessary.
27. Show clearly where Vuelta De Ocho Rios changes from 70' right of way to 75' right of way.
28. The description of the easement ( Docket 10874, Page 2938) within Block 51, on Sheet 6 of 8, is different from the description in the Title Report (Waterline easement on the Plat and communication facilities in the Title Report). Address this issue and revise as necessary.
29. The "75' drainage easement" within Block 53, shown on Sheet 7 of 8, is not included in the Title Report. Address this issue and revise as necessary.
30. The existing "1' no access control easement" within Block 53, shown on Sheet 7 of 8, is not included in the Title Report. Address this issue and revise as necessary.
31. To expedite the next submittal review, provide, with the resubmittal, a list of all existing easements, provided in the revised Title Report and there locations in the Plat.
32. Submit an assurance package to assure the construction of the proposed drainage and road infrastructure.
