The drawings for the proposed Final Plat of the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Regional Wastewater Reclamation Department (PCRWRD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

We will send to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of LOTS. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Subject to the above, the Pima County Department of Environmental Quality and the Regional Wastewater Reclamation Department hereby CONDITIONALLY approve the above referenced submittal of the Final Plat as received by us on January 07, 2009.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is January 08, 2010

The subject submittal has been reviewed and it can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that were made and references the exact location in the CC & R's and on the Final Plat where the revisions were made:

Final Plat:

1. Since the project does not appear to have public drainageways and parks, remove the reference to them in the second paragraph of the Dedication.
2. The third paragraph of the Dedication shall include language concerning the reservation of common areas for the private use and convenience of all owners, etc. (D.S. 2-03.6.3.B.2.c.)
3. Leave blank spaces for the Docket and Page information in the third paragraph of the Dedication.
4. Remove the reference to the year 2008 wherever applicable. Replace with the year 2009.
5. Change the name "Kathleen Detrick" in the approval block to "Roger W. Randolph".
6. Revise word "owner" to "owners" in the first line of the first paragraph of the Dedication.
7. Provide a "Beneficiary" block as required by (D.S. 2-03.6.3.C.).
8. Show detention/retention areas in a surveyable and readily retraceable manner. Additionally call out detention/retention areas (D.S. 2-03.6.4.I.).
9. Provide an Engineer Certification for detention/retention information shown on the Plat.
10. Indicate whether the distances and bearings between monuments are measured or calculated (D.S. 2-03.6.5.C.5).
11. Explain the purpose of the proposed grading easements. When will they be needed and how will the dedication be verified by the City. Clarify if these easements will be temporary easements or permanent. Additionally, provide the different width of the proposed grading easement shown on Sheet 3 of 4 north of the detention basin.
12. The existing ingress/egress easement (DKT. 4437, PG. 501), shown on Sheets 3 and 4 of 4, appears to conflict with proposed public right of way and Common Areas "A" and "B". The Easement need to be abandoned.
13. Are the proposed easements shown on the Plat proposed to be dedicated by this Plat?
14. Some street names have been changed from the Tentative Plat. Are these the final street names?
15. Provide a recent copy of the Title Report to facilitate reviewing existing onsite easements.
16. In order to expedite the plat review and approval, provide the boundary survey and closure calculations report in accordance with D.S. 2-03.6.5.C.3.

CC & R's:

Submit a revised CC & R's document in accordance with the following comments:

1. Some page numbers in the Table of Contents do not match the numbers in the body of the document. Revise as necessary
2. Article III in the Table of Contents is missing the page numbers.
3. The CC & R's execution date shall be filled in on the Recital page.
4. Some of the defined terms, in Article I "Definitions", are underlined and some are not. Is there a reason for this?
5. The Recitals Page is not included in the Table of Contents. Additionally, the Recitals page is not numbered. Revise as necessary.
6. The exhibits shall be numbered separately starting with page 1 and the Exhibits numbers shall be included in the Table of Contents under the "Exhibits" Title.
7. Section 3.4 "Detention, Retention and Drainage Areas" refers to Exhibit G. The CC & R's Document does not appear to include such exhibit. Revise as necessary.
8. Revise Section 3.4 to include information that matches the proposed drainage structures within this project (i.e. the project does not have drainageways and Common Area "B" does not include drainage structures).
9. Revise the "Retention/Detention Basin Inspection List" in Exhibit "A" to include the basins within the subject project. Additionally, revise the name of the project name to "Mountain Vail Shipley".
