COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is April 20, 2010.

2. D.S. 2-03.6.1.D.2 Identify all subdivisions on the location map, reference recorded subdivision plats by book and page numbers.

3. D.S. 2-03.6.1.D.3 The lower right section reference "21" on the location map is not correct this should be "22".

4. D.S. 2-03.6.1.D.4 As the southern end of section 16 and all of section 15 are not within the City jurisdiction show the City jurisdictional limits on the location map.

5. D.S. 2-03.6.2.D Remove General Note 5 from the plat as there is no rezoning for this project. Case No. C15-88-01 is an Annexation Number.

6. D.S. 2-03.6.2.J Add the following note: "This subdivision is subject to Ordinance No. 7090 which established zoning in the Country Club/Valencia Annexation Area."

7. D.S. 2-03.6.3.D Under the Recording block move "F. ANN RODRIGUEZ" above the line.

8. D.S. 2-03.6.6 Easements with Covenants and Restrictions Affecting Land (ECR), Exhibit A-2 shows a "OUTDOOR SALES AREA" and a "FUTURE EXPANSION" these areas are not shown on the approved tentative/development plan. Either one of these, or a combination of both appear to push the total square footage above the 100,000 square foot threshold therefore are required to be process through a Special Exception Land Use. Remove the "OUTDOOR SALES AREA" and a "FUTURE EXPANSION" from this exhibit.

9. D.S. 2-03.6.6 Easements with Covenants and Restrictions Affecting Land (ECR), Exhibit D-1 shows signage that has not been approved at this time. Remove the references to signs from this exhibit. If needed show only the sign easements.

The Final Plat (FP) cannot be approved as submitted. Please address the following review comments prior to the next submittal.

Final Plat:

1. Please include a response letter to the comments along with the corrected copies of the FP.
2. Submit the Subdivision Improvement Assurances for review. The following items are required in the assurance package if a Third Party Trust Agreement will be used:
" Title Report
" Special Warranty Deed
" Trust Agreement
" Amendment to Trust
" Agreement to Construct
3. Submit the above documents containing original signatures, copies of the documents and signatures will not be forwarded to the City of Tucson attorney for review.
4. Label Palo Verde Road on sheet 1.
5. A small, project-location map will be drawn in the upper right corner of the first sheet of the plat at a scale of 3" = 1 mile. The location map shall provide the following information:
" The City's jurisdictional limits will be shown, if within the mapped area.
3. Line weights will reflect the nature of the line, e.g., right-of-way lines will be more prominent than lot lines or easements, and drainageways will be in heavy solid lines except at street crossings.
4. A legend which shows and describes all symbols used on the drawing will be placed on either the first sheet of the plat or the first sheet which contains all or part of the subdivision drawing.
5. Indicate the name and width of each street, alley, easement (type), and drainageway within the subdivision boundary being created by this plat. Label each as public or private, along with the appropriate dedication notation.
6. If the project has common areas, label each common area individually with a separate letter designation. Enclose with a solid line each common area, private street, etc., that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way.
7. Show required setbacks, such as erosion hazard, drainage, etc.
8. Show the 50' W.A.S.H. wash setback line.
9. Per FEMA firm panel 2243K, show the limits of the 100-year flood prone area (Zone A) in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for all flows of one hundred (100) cfs or more.
10. Show detention/retention areas in a surveyable and readily retraceable manner. A common area designation may be used for the ret/det area. This would also create an avenue in which to hold all lots responsible for basin maintenance and can be assured by the CCR's.
11. Additional details to be shown are as follows.
" Basis of bearings - The purpose of the basis of bearings on a survey is to enable another surveyor to retrace the original survey. As such, the statement must be referenced to found, readily locatable monuments.
" The basis of bearings should be established from two (2) found, physically monumented points described and shown on the final plat.
12. All boundary monumentation must be labeled as "found" or "set."
i. Fully describe and show all markings on found monuments. Indicate/call-out if a found monument has no survey information.
13. Please submit a copy of the subdivision boundary closure calculations.
