The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a plat. If, at the end of that time, the plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is February 14, 2009.

2. D.S. 2-03.6.1.H Revise the title block to read "AND COMMON AREA "A" (PARKING/PAAL/LANDSCAPE/DRAINAGE).

3. D.S. 2-03.6.2.G Once the Board of Adjustment for the loading space size has been approved a general note stating "THIS PLAT IS SUBJECT TO BOARD OF ADJUSTMENT VARIANCE C10-___-___, UNLESS EXPIRED OR SUPERSEDED BY A SUBSEQUENT APPLICATION" will need to added to the plan.

The subject submittal has been reviewed and it can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that were made and references the exact location in the Final Plat and Assurances where the revisions were made:

Final Plat:

1. Since this is a commercial subdivision, revise General Note #6 by removing the word "homeowner's" and replacing it with words that are more appropriate to a commercial subdivision (e.g. lot owners', property owners', etc).
2. Replace the name "Kathleen Detrick" with the words "the undersigned".
3. Add the following sentence to the Surveyor's Certificate: "I further certify that this plat was prepared under my direction (D.S. 2-03.6.3.A.).
4. Add the word "drainage" between the words "utilities" and "private sewers" in the fourth line of the second paragraph of the Dedication (D.S. 2-03.6.3.B.2.c.).
5. Provide a copy of a recent Title Report to assist in the review of existing easements.
6. Provide 1' "No Vehicular Access Easements" where applicable (D.S. 2-03.6.4.H.).
7. Show retention area in a surveyable readily retractable manner (D.S. 2-03.6.4.I.). Additionally, the retention area shall be called out as an underground system.
8. In order to expedite the plat review and approval, provide the boundary survey and closure calculations report in accordance with D.S. 2-03.6.5.C.3.

CC & R's:

1. The CC & R's are acceptable pertaining to Engineering and Floodplain Review. This Office recommends including the Drainage Facilities Maintenance Checklist as an exhibit to the CC & R's to facilitate the Property Owners' Association maintenance responsibility.

Assurances:

1. Revise the project name in the Agreement Recitals and in the Amendment to match the project name in the Final Plat Title Block including the common area description.
2. Provide the subdivision case number on the Agreement and the Amendment.
3. Provide the Trust Number on the first page of the "Trust Agreement".
4. Revise, in the "Termination Section" of the Amendment, the Paragraph number from "18" to "19". The City Clerk's Office identified that the number in the Template that was produced by the City is incorrect.
5. Include in the Assurances Package an up to date Title report.
6. The "Agreement to construct Subdivision Improvements" is missing Exhibit "A" to Exhibit "A" and Exhibit "B" to Exhibit "A".
7. The "Amendment to Trust" is missing Exhibit "A".
8. The first Page 6 of 6 has the title company name "Ticor Title Agency of Arizona" and an acknowledgement date of 2006. This information appears to be incorrect. Revise as necessary.
