SUMMARY: Engineering Division of Development Services Department has received and reviewed the submitted Final Plat and proposed Performance Bond. Engineering Division has reviewed the submitted Final Plat and Performance Bond and recommends conditional approval at this time. The following items need to be addressed prior to Final Plat Mylar submittal:

10) DS Sec.2-03.7.1.G: The Final Plat Mylar cannot be scheduled for Mayor and Council consideration until the following items on the Performance Bond have been clarified and/or addressed.

a) The performance bond must refer to the project that it is prepared for - by name of the project (Casa del Pueblo), address, and or case number (S07-121). The name of project is typically acceptable however the case number is preferred (S07-121) on the bond document. This can be combined with the HUD Project Number 123-EE-103/AZ20S061009.

b) The surety company must be an Arizona company or have a statement, in the bond letter itself or by a separate letter, stating that the company may do business in Arizona. Clarify that the surety company (Travelers Casualty and Surety Company of America, a Connecticut Corporation) meets this requirement.

c) Revise the estimate for the site improvement assurances, provided by Tofel Construction, to include the CDRC case number (S07-121).

GENERAL COMMENTS:

Provide the Final Plat Mylar and revised Performance Bond that addresses the above comments.

The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(2) Title reports current within the last thirty (30) days.
(1) Executed Final Plat Double Matte Océ or Photo Mylar.
(1) * 81/2"X11" copy of plat
(1) * Check in the amount of $20.00 per plat page for recorded plat distribution made payable to the local print company that has access to Pima County Recorders on line platting system or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page and fees for consent(s) to dedicate, if applicable.
(2) Executed and notarized CC&R's document (if applicable) and Assurance Package (if applicable). One original set and one copy of each.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 5-6 weeks from the date submitted to the date scheduled for Mayor and Council approval.
