SUMMARY: The revised Final Plat, title report, and a copy of revised unsigned CC&R's were received by Engineering. Engineering has reviewed the received items and does not recommend approval of the Final Plat at this time. Conditional approval may be provided if assurable comment is addressed prior to 10SEP09. Address the remaining Final Plat and CC&R comments:

FINAL PLAT COMMENTS:
1) DS Sec.2-03.7.1.G, DS Sec.2-03.6.3.E: Financial assurances are generally required to be submitted as part of the final plat submittal. Exceptions to this requirement will be allowed if, in these instances, the City Engineer's Office is advised that the final plat submittal does not include the assurances. However, assurances must be submitted to the City Engineer's Office some time during this review phase. The final plat cannot be scheduled for Mayor and Council consideration until the assurances are approved by the City Engineer's Office. Verification of assurable items is required prior to approval of the final plat. If the improvements are not all completed, assurances will be required. Although there were PIA, Water, and PCWW approvals, access is an assurable item. Per inspector's report 2SEP09, the outstanding access items include required pedestrian access for lot 3 to pedestrian connection north of Lot 1. Submit estimate to Engineering Reviewer for acceptance of assurance amount prior to obtaining bond or other security.
2) DS Sec.2-03.6.1.J: Line weights will reflect the nature of the line, e.g., boundary lines will be more prominent than lot lines. Revise legend on sheet 2.
3) DS Sec.2-03.6.6.A: Address the remaining CC&R comments:
a) Provide exhibits A, B, & C.
b) Provide clarification of maintenance for sidewalk area adjacent to Irvington Road, per PIA approval letter. Provide page number in response letter for reference to any cross access agreement or easement in the CC&R's. It will be necessary to provide on the Final Plat, one of the following: a general note for a cross access agreement, or, a note for cross access easement reference to CC&R's and easement drawn on planview, or, revised lot lines for PAAL between lots 2 & 3.
c) Please add subdivision case number (S07-101) to the CC&R's. This is preferred on the cover / first page next to or below Riverfront Plaza.
d) An original signed copy of the CC&R's with all pages numbered will be required for Final Plat approval.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The Zoning Review Section conditionally approves the final plat for this subdivision, subject to the following changes on the executed final plat. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

2. This comment was not addressed. The title block for the CC&Rs should read Riverfront Plaza, Lots 1, 2, 3, 4 and common Area A (Parking, Drive Lanes, Landscaping, & Utilities) and B (Detention Basin) D.S. 2-03.6.6 The Title of the Declaration of Covenants, Conditions and Restrictions should match the title block shown on the plat. This should include a letter designation for the common area.

3. Per a discussion with the design engineer a general note will be added to the final plat in regards to pedestrian and vehicle access. The note should state "CROSS ACCESS ACROSS LOTS 1, 2 & 3 FOR VEHICULAR ACCESS, PEDESTRIAN ACCESS AND PARKING SHALL BE PROVIDED PER THIS PLAT'.

The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(1) * 81/2"X11" copy of plat
(1) * Check in the amount of $20.00 per plat page for recorded plat distribution made payable to the local print company that has access to Pima County Recorders on line platting system or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page and fees for consent(s) to dedicate, if applicable.
(2) Executed and notarized CC&R's document (if applicable) and Assurance Package (if applicable). One original set and one copy of each.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 5-6 weeks from the date submitted to the date scheduled for Mayor and Council approval.
