SUMMARY: The Final Plat package including plat sheets, CC&R's, assurances, and title report schedule was received by Engineering for Final Plat review. Engineering does not recommend approval of the Final Plat at this time. Please address the following comments for resubmittal.

ASSURANCE COMMENTS:
1) City of Tucson Development Standards (DS) Section No.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. For third party trust subdivision assurances, address the following:
a) Provide original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST;
b) Provide original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
c) Assure that all exhibits are attached, and the case number "S07-085" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
d) Provide copy of the original Trust Agreement;
e) Provide copy of a sample Warranty Deed;
f) Provide copy of the Title Report.
2) Assure that any/all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. In response letter, please explain whether any easement items in Schedule B are not shown on the plat. (See survey comment below)
3) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
4) For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.

FINAL PLAT COMMENTS:
5) DS Sec.2-03.6: Only data that is within the final plat boundary and survey ties should be shown on the Final Plat. Remove non-Final Plat data from the plat sheet 2, including Los Olivos and Honcho Estates lot lines as well as Tyndall and Morris Avenue labels.
6) DS Sec.2-03.6.6.A: Address the following CC&R comments:
a) Provide case number on CC&R's.
b) Provide an original signed copy of the Covenants, Conditions, and Restrictions (CC&Rs) that is revised to include verbiage regarding basin and drainage maintenance per section DS Sec.10-02.14.3.2. The CC&R's or Final Plat shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for any drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. Per Standards Manual for Drainage Design and Floodplain Management, the drainage area maintenance and responsibility verbiage from DS Sec.10-02.14.3.2.a-d (above as well as DS Sec.10-02.14.3.3 must be included on the CC&R's, or placed on the Final Plat.
7) DS Sec.2-03.6.1.D: On Location Map on sheet 1, provide labeled section corners.
8) DS Sec.2-03.6.4.E: Show any required setbacks, such as erosion hazard or drainage setbacks from basin.
9) DS Sec.2-03.6.4.I: Show detention/retention areas in a surveyable and readily retraceable manner.
10) DS Sec.2-03.6.1.D.2: Identify more clearly the delineation for Old Nebraska Wash on Location Map on sheet 1.
11) DS Sec.2-03.6.4.G: Corner lots may be designated with a star symbol indicating which street will be used for access (lots 1, 23, 24,& 42). Use of this designation may limit design options for access.
12) DS Sec.2-03.6.4.G: Provide 1 foot no access easement along rear yards of north lots and lots adjacent to church property.
13) DS Sec.2-03.6.4.H: Show no-vehicular access easements where applicable.
14) DS Sec.2-03.6.3: Provide additional space for seal under Approval & Acknowledgement sections on sheet 1.
15) DS Sec.2-03.6.3.E: Correct signature lines on sheet 1 to read: "City of Tucson Planning & Development Services Department Director" and "City of Tucson Planning & Development Services Engineering Administrator"
16) DS Sec.2-03.6.5.C: Address the following survey related comments:
a) Not one corner of the plat is ties to a section corner. At least 1 corner of the subdivision will be tied by course and distance to a section corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.
b) Address the following boundary comments:
i) Provide exhibit describing Exhibit "A" in Title Report to clarify boundary information as shown on the plat.
ii) Indicate whether measured or calculated or recorded for south boundary lines south of lots 1 & 42, and north boundary line south of lot 24-30.
iii) Provide survey monuments set on the Ray Clarke Loop street knuckle.
c) Show revised boundaries and lot lines, or easements that provide access to Nebraska Wash ramp access per Tentative Plat.
17) DS Sec.2-03.6.5.B: Assure that all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Show or add note regarding Tucson Gas Electric Light Power easement Dkt.1923 pg.33 per Schedule B item number 13. Provide dimensioning if these utility easements cross within the project boundaries, and label Bk/pg or Dkt/pg for each easement. In response letter, please state whether the item 13 of Schedule B is shown on the plat.
18) Provide copy of the final drainage report and a CD for archive.

The next submittal should address all the above items. Submit revised Final Plat, assurance documents, title report, a copy of the final Drainage Report with CD, and response letter.
