COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of submittal of the final plat to obtain approval that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before May 31, 2008.

2. Please center the subject property within the project location map. Identify subdivision within that square mile referencing the plats by book and page number.

3. Case number S07-083 has been assigned to this final plat. Please place this number in the right corner of all sheets of the final plat.

4. Please remove general notes 4 through 6. These notes would be required on a tentative plat and are not required on a final plat.

8. Because this is a final plat items within the common areas such as parking space and sidewalk dimensions area not required. Unnecessary information clutters and makes final plat hard to read. Please clearly identify each common area by enclosing them with a heavy solid line. Currently it is hard to distinguish common areas.

9. Please identify any areas that are to be "exclusive common elements" (ECE) which would be reserved for the use of a certain unit or units to the exclusion of other units, including but not limited to balconies, terraces, patios and parking spaces or facilities. The volume table appears to describe square footage of ECE but their location is not shown on the plat.

10. Please provide an affidavit stating that the subdivision has provided or will provide written notice of the subdivider's intent to convert to all tenants of units to be converted, beginning not less than one hundred twenty (120) days prior to the date on which the first unit is offered for sale, and will continue to provide such notice to prospective tenants until all units have been sold.

11. Please provide an affidavit stating that the subdivider will provide existing tenants an exclusive right to purchase the unit the tenant leases at a price which is not more than the price at which the subdivider intends to offer the unit to the general public for a period of not less than sixty (60) days from the date a tenant's units is offered for sale.

12. Please provide an affidavit that the subdivider will provide to each tenant, who has indicated to the subdivider his/her intention not to exercise his/her right to purchase, a written statement listing at least three (3) rental units unique to that tenant of comparable size and price to the unit occupied by the tenant.

Please provide an affidavit stating that the subdivider will provide to tenants a relocation payment of three hundred fifty (350) dollars per residential unit to be paid prior to termination of the tenants occupancy, including written notice of the availability of such payment prior to termination, provided that:
a) The tenant has occupied his unit for at least two (2) years prior to the date on which the tenant was eligible to receive a notice of intent to convert pursuant to Sec. 4.1.9.1.A.
b) The tenant has made a written request to the subdivider for the relocation payment.
c) The tenant has a total annual income at or below maximum eligibility limits established by the U.S. Department of Housing and Urban Development for the participation in the Section 8 Housing Assistance Payments Program or is sixty-two (62) years of age or older.

14. Please provide an affidavit stating that the units to be converted meet the applicable standards of the Housing Code, Tucson Code, Chapter 16.

15. Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. The subdivider shall provide this report to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.
a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.
b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.
1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

1. Sheet 1: Fill in the Trust No. where required in the Dedication Block.

2. Sheet 1:Fill in the information for the Beneficiary.

3. Sheet 1:In the Title Block the project should be described as , A CONDOMINIUM CONVERSION PROJECT

4. Sheet 1:Show the jurisdiction's case number, S07-083, in or near the Title Block of each sheet.
This case number should be shown larger and bolder than any associated cross-reference numbers.

5. Sheet 1:In the third line of the third paragraph of the Dedication Block add , PIMA COUNTY after the word PUBLIC.

6. Sheet 1: In the first line of the fourth paragraph of the Dedication Block add, PIMA COUNTY after the word PUBLIC.

7. Sheet 1: In the General Notes add a note which states:

THIS IS A CONDOMINIUM CONVERSION PROJECT. THE ON-SITE SEWERS ARE EXISTING AND PRIVATE. NO NEW SEWERS ARE PROPOSED.

8. A development plan will be required for this project due to the change of use. Refer to Chapter 18.71 of the Pima County Zoning Code.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second(2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

SUMMARY: The Final Plat and CC&Rs were received by Engineering on June 1st, 2007. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs.

1. Provide a table of contents for the CC&Rs.

2. Submit revised copies of the CC & R's that specifically address the maintenance of the drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in detail (i.e. what facilities to be inspected and maintained, how, when, by whom, the retention basin maintenance list, record keeping and repair decisions, etc). Please be advised that this Office recommends including the Retention maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities. 5. A BENEFICIARY block typically is used on a plat when there are assurances with the project. It appears the project is built out therefore assurances would not be required. Clarify in detail in the response letter and revise the plat appropriately.

6. This project with the activity permit number, T03CM04567, has not had all the final inspections approved. The plat will not be approved until this process is complete.

7. There is an electrical easement listed in the title report that are not shown on the plat. The easements shown in the title report must match what is provided on the plat. Revise appropriately.

8. Show the water harvesting area in a surveyable and readily retraceable manner.

9. Corner tie information is to be provided on the plat. At least one corner of the subdivision must be tied by course and distance to a section corner or a quarter section corner. The plat must include a description of that corner marker and an indication of how the bearings were determined. Provide the corner tie recordation information on the plat. DS 2-03.6.5.A.

10. Provide a bearing for the west boundary (property line). DS 2-03.6.4.B.

11. Provide a Basis of bearings - The purpose of the basis of bearings on a survey is to enable another surveyor to retrace the original survey. As such, the statement must be referenced to found, readily locatable monuments. There are three general methods of establishing bearings.

a. Reference to a record of survey or a recorded plat.
b. Astronomic (normally solar or polaris).
c. Assumed.
