The proposed tentative plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


Sheet 1: In the dedication block 1st paragraph, 1st sentence after I HEREBY GRANT TO THE PUBLIC insert the following: ,PIMA COUNTY. In the 2nd paragraph do the same and add ,PIMA COUNTY after the word PUBLIC.

Sheet 1:Add a general note which states the following:

THERE ARE NO NEW SEWER LINES PROPOSED. ALL SEWER LINES ARE PRIVATE AND EXISTING.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

COMMENTS:

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is 06/18/08.

2. Per LUC Sec. 6.2.3 the definition of a Condominium is a method of sale of air rights. It appears that a land subdivision is what is being applied for by this submittal. This property does not meet the minimum requirements of the LUC for land subdivision.

Indicate in the title block that this is a Final Plat for the "First Street Condominiums-Units 1 & 2" (if that is the name to be used) and number of common elements and limited use common elements. (common use element A, limited use common elements A, B, etc.)

See engineering comments for the correct method of establishing the boundaries and volume measurements of each condominium unit.

3. DS 2-03.6.1.D A small, project-location map will be drawn in the upper right corner of the first sheet of the plat at a scale of 3" = 1 mile. The location map shall provide the
following information.

1. Identify conditions within the square mile area, such as subdivisions, major
streets, major watercourses, and railroads. Reference recorded subdivision plats by book and page numbers.

2. Section corners will be labeled.


4. DS 2-03.6.1.K This project has been assigned the subdivision case number S07-077. Please list the case number in the lower right corner of all final plat sheets.

5. DS 2-03.6.2 Provide the following general notes on the final plat.

A. "The gross area of this lot is_______acres."
B. "The total number of units is ________."

6. DS 2-03.6.4.C If the project has common areas, label each common area individually with a separate letter designation. Enclose with a solid line each common area, private
street, etc., that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way.

7. DS 2-06.6 Protective Covenants. Protective covenants or Covenants, Conditions, and Restrictions (CC&Rs) establishing responsibility for construction, maintenance, and ownership of any proposed common area, open space, private street, or similar joint use, when needed, will:

A. Provide for maintenance of and liability for any proposed commonly-owned areas; and
B. Include the various conditions of rezoning or other special situations requiring permanent administration by an owners' association.

Since the definition of a Condominium is a method of sale of air rights and not any physical elements. The created association is to be responsible for owning and maintaining all structures, equipment, utilities, and common areas. Limited common areas such as patio areas, fenced in areas, or any area indicated for the sole use of one owner can be maintained by that owner.

On the cover sheet for the CC&Rs indicate the number of units that are included in this project.

8. Luc Sec 4.1.9.2 Disclosure Requirements. Any subdivider who files a final plat for a condominium, cooperative, community apartment, townhouse, or mobile home park subdivision, whether for the purpose of new development or the subdivision of an existing development, shall submit a copy of a report on the physical condition of all
buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.

A. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.

B. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.


C. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.

D. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.

E. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.

1. Accessibility of buildings and structures to fire-fighting equipment; and

2. Proximity and frequency of fire hydrants.

D.O.T. discourages the use of alleys as a primary access, such as provided for Unit 2. SUMMARY: The Final Plat and CC&Rs were received by Engineering on May 21, 2007. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs.

RESUBMITTAL REQUIRED: FINAL PLAT, CC&Rs

SUBMITTAL REQUIRED: BOUNDARY CLOSURE CALCS, TITLE REPORT

The next submittal must address the following items:

FINAL PLAT COMMENTS

1. A small, project-location map will be drawn in the upper right corner of the first sheet of the plat at a scale of 3" = 1 mile. The location map shall provide the following information.
1. Show the subject property approximately centered within a one (1) square
mile area.
2. Identify conditions within the square mile area, such as subdivisions, major
streets, major watercourses, and railroads. Reference recorded subdivision plats by book and page numbers.
3. Section, township, and range; section corners; north arrow; and the scale will be labeled.


2. This project has been assigned the subdivision case number S07-077. List the case number in the lower right corner of all final plat sheets. DS 2-03.6.1.K.


3. Indicate in the title block that this is a Final Plat for the "First Street Condominiums-Units 1 & 2" and number of common elements and limited use common elements. (common element A, limited use common elements A, B, etc.)

4. A legend which shows and describes all symbols used on the drawing will be placed on either the first sheet of the plat or the first sheet which contains all or part of the subdivision drawing. The legend provided is not sufficient. The legend should provide identification of boundary lines, easement lines, found survey monuments, tie point symbols, etc. DS 2-03.6.1.L.

5. Remove general note number 5 and 6. Be advised a title report is required for review of plats.

6. Revise the Final Plat Standard paragraphs on the first sheet so that they are listed in the following order for better understanding and clarity DS Sec.2-03.6.3:

1. Dedication Paragraph
2. Beneficiary Block Paragraph (if applicable)
3. Acknowledgement Paragraph
4. Approval Paragraph
5. Recordation Data Block Paragraph
6. Assurance Block

7. Revise the City of Tucson Engineer signature line to read, "City of Tucson Development Services Engineering Administrator." DS 2-03.6.3.

8. Provide the docket and page for the TEP easement. Indicate of the easement is public or private.

9. It is difficult to determine the boundaries of the common elements. Each common element should be labeled individually with a separate letter designation with a solid line clearly defining the boundary of the comment element. DS 2-03.6.4.C.

10. In addition to the above comment are there any porches or parking spaces specially designated for the tenants? If a parking space is designated to a unit number, this space is considered a limited common element. Or if a porch is attached to a unit this is also considered a limited common element. The limited common elements must be described in the title block with separate letter designation. Revise the plat as needed. DS 2-03.6.6., ARS 33-1202

11. A final plat serves as a survey document. Any site or building plan information not required to be on the final plat should be removed. Remove all labels and any information that is not required to be on a final plat; fences, walls, sidewalks, etc. DS 2-03.6.0.

12. If applicable show no-vehicular access easements for the project. DS 2-03.6.4.

13. Corner tie information is to be provided on the plat. At least one corner of the subdivision must be tied by course and distance to a section corner or a quarter section corner. The plat must include a description of that corner marker and an indication of how the bearings were determined. Provide the corner tie recordation information on the plat. DS 2-03.6.5.A.

14. Indicate whether the distances and bearings between all monuments are measured or calculated. DS 2-03.6.5.C.5.

15. Provide the volume for each unit. On the plat clearly define the footprint of the structure. It is acknowledge a floorplan is shown but how the inside of the structure is laid out is not necessary unless the structure has several units within the footprint of the structure. For plat clarity only provide the outside boundary of each unit and provide the volume of each unit.

16. Provide location description of two found monuments used to establish the basis of bearing. DS 2-03.6.5.C.6.

17. Additional comments could be forthcoming depending on how each comment has been addressed.
