The drawings for the proposed Final Plat for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

SHEET 1. In the DEDICATION block, in the fourth paragraph, add PIMA COUNTY following TUCSON.

2. SHEET 1. In general Note 13, fifth line, delete PUBLIC from PUBLIC AND PRIVATE SEWERS.

3. SHEET 1. Add a General Note that states:

ALL SEWER LINES ARE PRIVATE AND EXISTING. NO NEW SEWER LINES ARE PROPOSED..

4. SUBJECT TO THE ABOVE, the Pima county Department of Environmental Quality and the Wastewater Management Department hereby CONDITIONALLY approve the above referenced submittal of the Final Plat as received by us on April 11, 2007. The revision may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUMMARY: The Final Plat and CC&Rs were received by Engineering on April 12th, 2007. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs.

RESUBMITTAL REQUIRED: FINAL PLAT, CC&Rs

SUBMITTAL REQUIRED: TITLE REPORT, BOUNDARY CLOSURE CALCS


The next submittal must address the following items:

GENERAL COMMENTS

1. The grading permit must have approval of the final grading inspection prior to
approval of the final plat. The activity number for the grading permit is T04BU02627.


CC&R COMMENTS

1. Provide a table of contents for the CC&Rs.

2. Submit revised copies of the CC & R's that specifically address the maintenance of the drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in detail (i.e. what facilities to be inspected and maintained, how, when, by whom, the retention basin maintenance list, record keeping and repair decisions, etc). Please be advised that this Office recommends including the Retention maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities. SMDDFM 14.03.2.

FINAL PLAT COMMENTS

1. All lettering and dimensions will be the equivalent of 12 point font or greater in size. The purpose of this requirement is to assure that all lettering is legible when reproduced. Revise the first sheet of the plat appropriately. DS 2-03.6.1.C.

2. Revise the verbiage "common area," in the title block to read common element. DS 2-03.6.1.H.

3. Provide the subdivision case number in the lower right hand corner of each sheet. DS 2-03.6.1.K.

4. Revise the fourth paragraph in the dedication section to read "common element," rather than "common area." DS 2-03.6.3.B.

5. Revise the Final Plat Standard paragraphs on the first sheet so that they are listed in the following order for better understanding and clarity DS Sec.2-03.6.3:

9. On sheet 2, indicate the square footage of common element A. DS 2-03.6.4.D.

10. Show no vehicular access easements where applicable. DS 2-03.6.4.H.

11. Provide a bearing for the 55' dimension within the basin. DS 2-03.6.4.I.

12. From the 55' dimension provide a distance to a set pin. DS 2-03.6.4.I.

13. Provide crow's feet to clarify distances for 69.93' to 55'.

14. Provide identification in the legend of what the star symbol represents. If the star symbol represents information related to a site plan; remove symbol.

15. Indicate on the plat if the shown existing easements are public or private.

16. Corner tie information is to be provided on the plat. At least one corner of the subdivision must be tied by course and distance to a section corner or a quarter section corner. The plat must include a description of that corner marker and an indication of how the bearings were determined. Provide the corner tie recordation information on the plat. DS 2-03.6.5.A.

17. Indicate whether the distance and bearings between all monuments are measured or calculated. DS 2-03.6.5.C.5.

18. Depending on how each comment has been addressed, additional comments could be forthcoming.

COMMENTS:


1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is April 11, 2008.

2. This project was reviewed for compliance with DS 2-03, final plat criteria.

3. Per DS 2-03.6.1.D.2, enlarge type for recorded subdivisions listed in the location map to 12 point.

4. Per DS 2-03.6.1.D.3, provide a township range and section for the section to the east of the location map.

5. Per DS 2-03.6.1.H.1, define what the common area consists of (parking, etc.) in the title block. Be sure to revise all pages. On page 2, revise title block to read final -not preliminary -plat.

6. Per DS 2-03.6.1.K, place the assigned Development Services Department case number "S07-054" next to the title block, each page.

7. Per DS 2-03.6.2.H, add the following note exactly as written " There will be not further division of lots without the expressed approval of the City of Tucson." ( I acknowledge your similar statement about the condo units, please keep it on there, thank you. This will be a statement for the land.

8. Per DS 2-03.6.3.D, the Recording Data and Acknowledgement notes provided on the plat need to be removed and re-done per the sections of the code DS 2-03.6.3.D - EXACTLY IN THE FORMAT AS THEY ARE WRITTEN for recording purposes. Be sure to provide an Approval paragraph, a Recording Paragraph, the name of the Recorder, and the Assurances Paragraph EXACTLY AS WRITTEN. If you need a copy, please link to www.tucsonaz.gov/dsd under codes, under Development Standards, DS 2-03.6.3.D.

9. Per DS 2-03.6.4.C, define the areas, parking, landscaping, retention basin, etc. that are within the common area. Enclose common area(s) with a distinct solid line and label on the plat sheets.

10. Per DS 2-03.6.6.A, with regards to the CCRs:
A) page 4 discusses the condo owner's development rights - without limitation - to do several things, such as adding real estate to the condo and increasing condo area. NONE OF THESE THINGS ARE ALLOWED WITHOUT RE-PLATTING WITH CITY OF TUCSON APPROVAL. If you desire to keep this verbage, add a note to the top of that list that states "Any of the following changes to the condominium units and or common areas require expressed written permission from the City of Tucson."
B) Page 5 discusses Limited Common Elements. LCE's need to be defined on the plat if they are indeed going to be called LCE's.

11. Provide written advisements how this project will meet requirements of LUC 4.1.9.1 and 4.1.9.2.
