The proposed tentative plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


We have sent to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of residential lots. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Sheet 1:In the dedication block 2nd paragraph, 2nd sentence after I HEREBY GRANT TO THE PUBLIC insert the following: ,PIMA COUNTY. In the third sentence do the same and add ,PIMA COUNTY after the word PUBLIC.

Sheet 2: Revise the public sewer easement notation to DK. instead of BK.. Also the word Abandoned should be changed to Vacated and add a DK.____ and Pg._____ for the sep. instr..

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the tentative plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.


The next submittal of this project will be the 2nd submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

Tucson Electric Power Company (TEP) has received the final plat
submitted for review April 26, 2007. TEP is unable to approve the plat
at this time.



When the tentative plat has been approved by Pima County submit to my
attention a copy of the signed Approved Tentative Plat. TEP will
provide an electrical design within fifteen (15) working days upon
receipt of the plat and the required additional plans. The completion
of the electrical design is necessary to determine our easement
requirements and review the final plat.



Additional plans necessary for preparation of the design are: building
plans including water, electrical, landscape, sidewalk and paving plans.
Also, submit the AutoCAD version of the plat on a CD or email to

the following format:



A. Complete and identical to the official hard copy (paper) subdivision
plat.

B. DWG format

C. AutoCAD Version 2002 or lower

(For example all lot lines should be on one layer, street centerlines
another layer)

F. Required Layers: Lot Line, Right of Way, and Street Centerline

G. At least three tie points are required; one must be a Section or a
Quarter and the others may be street intersections or lot corners.
Bearings and distances must be designated from the tie points

H. Any special fonts, X-REFs, or attachments should be submitted along
with the CAD drawing.

1. SUMMARY: The Final Plat, CC&R's, title report, assurance were received and reviewed for Final Plat conformance. This subdivision project is subject to SCZ and HDZ overlay applicability and is adjacent to an ERZ wash named San Juan Wash. There are proposed drainage improvement development encroachment into the San Juan ERZ wash. The existing San Juan ERZ is within a FEMA Special Flood Hazard Zone AE and consists of an existing constructed channel, approximately 5 feet deep and bottom width 60 feet, with sandy earthen bottom that has grade control structures and 1.5:1(H:V) shotcrete side slopes with toedowns. A CLOMR has been obtained from FEMA, as the jurisdictional flow is proposed as being contained within the channel. Proposed encroachment includes proposed bleed pipes with flap gates for outlets from two of the proposed basins, and shotcrete weir outlet / trail crossing the bank protection along the south side of the project. Engineering recommends SAC scheduling after trail or other easement clarifications are addressed in a Tentative Plat resubmittal. There are remaining HDZ grading comments that need to be addressed for Tentative Plat resubmittal. Due to substantial remaining comments on the plat, Tentative Plat approval is required prior to resubmittal of the revised Final Plat. Development Services Department Engineering Division has completed the review of the received items and does not recommend approval at this time.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.7: Submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat.
2) DS Sec.10-02.2.3.1.4.G: Regarding the San Juan Wash Zone AE FEMA floodplain which is partially on this project, provide updated FEMA status upon resubmittal.
3) DS Sec.2-03.6.1.D.2: Identify San Juan Wash watercourse on the project location map on sheet 1.
4) DS Sec.2-03.6.1.J: Revise line weights for right-of-way lines to be more prominent than lot lines or easements.
5) DS Sec.2-03.6.1.L: Add to legend delineations for floodplain line and any Erosion Hazard Setback line.
6) DS Sec.2-03.6.2.E: Since the plat is subject to FEMA floodplain requirements (LOMR has not yet been obtained), add the following note: "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Lots ____."
7) DS Sec.2-03.6.2.F: Since the property is subject to the requirements of the Hillside Development Zone, add as a general note to sheet 1: "Prior to the issuance of any building permits, Hillside Development Zone approval is required for all lots."
8) DS Sec.2-03.7.1.B: For engineering information (such as floodplain or EHS) is provided on the final plat, the seal, signature, and certification of the responsible engineer is also required next to the surveyor's certification. When ready for mylar, all signatures must be in permanent, black ink.
9) DS Sec.2-03.6.3.C: For the BENEFICIARY block, assure beneficiary statement includes title company: "The beneficiary of Fidelity National Title Agency (Trust Number) is …"
10) DS Sec.2-03.6.3.D: Add Pima County Recorder beneath F. Ann Rodriguez in the Recording Data section on sheet 1.
11) DS Sec.2-03.6.3.E: Under the Assurance section on sheet 1, revise "City of Tucson Development Services Center Engineering Administrator" to "City of Tucson Development Services Department Engineering Administrator"
12) DS Sec.2-03.6.4.A: The San Jose Drive, San Raphael Avenue, and 33rd Street alignments and street layout shall be approved by TDOT on the Tentative Plat.
13) DS Sec.2-03.6.4.E: Show any applicable EHS lines on sheet 2.
14) DS Sec.2-03.6.4.F: Show floodplain limits on plan view. Show the limits of the 100-year floodprone area in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for FEMA floodplain. The FEMA zone AE delineation is not removed until FEMA provides a LOMR. Recording the plat after obtaining LOMR is an acceptable option.
15) DS Sec.2-03.6.4.H: Show no vehicular access easement along rear of lots 22-27.
16) DS Sec.2-03.6.4.I: Show 100-year ponding limits within basin common areas.
17) DS Sec.2-03.6.5.A: At least one corner of the subdivision shall be tied by course and distance to a section corner or a quarter section corner.
18) DS Sec.2-03.6.5.B: Provide crow's feet for west project boundary to differentiate distances.
19) DS Sec.2-03.6.5.C.1: Show basis of bearing on planview on sheet 2.
20) DS Sec.2-03.6.5.C.3: Provide parcel boundary legal description as well as project boundary closure calculations with closing error.
21) DS Sec.2-03.6.5.C.4.b: A one-half inch iron rod tagged by a registered land surveyor will be set at all corners upon completion of construction.
22) DS Sec.2-03.6.5.C.5: Indicate all bearings and distances for boundary data as recorded, measured or calculated.
23) DS Sec.2-03.6.5.B: Address the following easement comments:
a) All existing easements will be drawn on the plat, and recordation information, locations, widths, and purposes shall be included. The engineer shall assure that all easements listed on the Title Report Schedule B are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the Final Plat.
b) Show Schedule B item 6 on the plat.
c) Explain why the following easements are not included on the title report schedule B.
i) Bk34 pg20 16-ft utility easement. Provide copy of this easement.
ii) The 16-ft x 25-ft anchor easement, also Bk34 pg 20.
iii) DS Sec.7-01.4 and DS Sec.2-03.2.3.C: There is a sewer easement (Bk1879 pg585) indicated on the plat as abandoned. This easement is shown to cross proposed lot locations, which conflicts with the status of the easement. The easement shall be extinguished prior to approval of the Final Plat. Clarify in response letter whether this easement is not showing on the title report due to completion of abandonment.
iv) Submit updated title report.
d) DS Sec.2-05.2.4.L.5: This following comment remains until acceptance of proposed drainage improvements are accepted by offsite owner: Verification will need to be provided that any drainage solutions, which occur outside the boundaries of the development plan area, are constructed with adjacent owners' permission. (Additional notarized documentation of that approval will be submitted with the drainage report.) Please be aware that the concrete weir outlets which are proposed to cross the maintenance road are not necessarily accepted. The proposed designs must meet SCZ and ERZ requirements. If the structures are approved, a drainage maintenance or construction easement will be needed at the south side of the project for those areas of drainage structures that are proposed outside of the property boundaries, including the flap-gated pipe outlets.
24) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Submit the following for other portions of the assurance package:
a) Regarding the Agreement to Construct and the Amendment to Trust, assure that the title block verbiage for the description of the plat exactly matches wording on the assurance document (recitals/first pages and legal descriptions in the exhibits) to prevent delays/rejection from the legal office.
b) Add case number S07-040 to each page, including exhibits, of the Agreement to Construct and the Amendment to Trust.
c) Provide address of trustee in section 24 of the AGREEMENT TO CONSTRUCT.
d) For the Exhibit "B" of the AGREEMENT TO CONSTRUCT, add 'onsite' to required improvements for assurable item 8.
e) Bottom of some of the pages of the assurances are partially deleted. Assure all pages are legible when originals are submitted.
f) After revising the third party trust assurances for this subdivision, provide:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S07-040" is on the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the updated/current Title Report.
vii) Three copies of the 8 ½ x 11 location map
g) Revise assurance package, address comments, compile the package, and then resubmit the revised assurance package with the resubmittal.
25) DS Sec.2-03.6.6.B: Address the following CC&R comments:
a) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas as well as the descriptions in the assurance paperwork. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
b) Provide a table of contents for the CC&R's.
c) Provide page numbering for every and all pages of the CC&R's including appendix.
d) Update dates on first page and last two pages of the CC&R's to reflect current year.
e) Add easement maintenance verbiage to CC&R's: All erosion protection and revegetation in all easements shall be the responsibility of the Homeowners Association.
f) On page 24 section (d) third sentence, add 'retention' to "The Association shall be solely responsible for … drainage structures and detention basins."
g) Add case number S07-040 to first sheet of CC&R's.
h) An original signed copy of the CC&R's will be required for Final Plat approval.
26) Due to substantial remaining comments on the plat, Tentative Plat approval is required prior to resubmittal of the revised Final Plat.
