Engineering does not recommend approval of the Final Plat until are the Final Plat and assurances comments are addressed. FINAL PLAT COMMENTS: 1) City of Tucson Development Standards (DS) Section No. 2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Address the following for the assurance package: a) Revise the following for the AGREEMENT TO CONSTRUCT: i) In the first paragraph, add a comma after Trust No. 766 and before the city of Tucson. ii) Add a space before C2 in paragraph A of the Recitals. iii) Attach the exhibits A and B as referenced on page 1 to the Agreement and if additional exhibits are needed for the other portions of the assurance package, provide and attach. iv) Revise assurable items list to clarify that item 8: "… all off-site and onsite improvements as shown on …" b) Assure the title block common areas listed in the assurance paperwork match the plat. Please be aware that the City of Tucson's clerk or legal offices may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. c) Revise the subdivision assurance package and in the resubmittal, provide: i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list; ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST; iii) assure that all exhibits are attached, and the case number "S07-034" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST; iv) copy of the original Trust Agreement; v) copy of a sample Warranty Deed; vi) copy of the current Title Report. 2) DS Sec.2-03.6.1.L: Address the following comments: a) Clarify discrepancy of the common area labeling and the title block description. Common area labels on the planview do not match the title block description. b) Revise lot 9 frontage length to provide a minimum frontage that allows for driveway or any solid waste pick-up area requirements; typically 20 to 30 ft minimum frontage is needed to provide sufficient access. Also, clarify / revise star symbol location for lot 8 to show that access should not be too close to lot 9. c) Provide "100-year" floodplain limits for jurisdictional flows of 100 cfs or more, if applicable. State in response letter whether any flows are impacting site to the south of the project and reflect in engineering certification. Call for clarification. d) Clarify leader line near lot 9 for 457.32 distance as well as the crows feet for this distance as opposed to 637.48. e) Provide descriptions for each common area A, B, C, and D in title block or general notes. 3) DS Sec.2-03.7.1.B: It is unclear whether there is any jurisdictional floodplain lines within the plat boundary. Any 100-yr floodplains with flows of 100 cfs or more shall be shown on the plat and the certification indicates that there are some. Regarding the engineering certification on sheet 1, any floodplain or erosion hazard setback lines that fall within the project boundary shall be shown on the plat. Verify whether engineering certification is needed if floodplain or EHS lines do not fall within project boundary. 4) DS Sec.2-03.7.1.E: Provide a revised copy of the Declaration of Covenants, Conditions and Restrictions (CC&Rs) addressing the following comments: a) DS Sec.2-03.6.6: Assure that the CC&R's are revised to include a maintenance checklist as provided in the Drainage Report from the approved Tentative Plat, that outlines the maintenance requirements for the basin and drainageway and any other drainage areas. b) At Final Plat approval, a signed original copy of the CC&R's will be required to be submitted to CDRC Office. c) In the CC&R's add maintenance verbiage regarding: revegetation or other permanent erosion control in all easements shall be the responsibility of the Homeowners Association. 5) Show any TEP pedestal or other proposed utility easements on the plat. 6) DS Sec.2-03.6.3.C Add contact person to the Beneficiary paragraph. 7) DS Sec.2-03.6.3.A: For all seals, including any future project submittals, provide the expiration date of the registration below the seal per current AzBTR requirements. 8) DS Sec.2-03.6.5.C.5: Address the following boundary data and survey items: a) Clarify bearings and distances for tie to section corner from a corner of the project. Tie must be from the section corner through described monuments with bearings and distances to one of the project boundary corners. Tie to a street monument tie is not sufficient. b) DS Sec.2-03.6.5.C.4.b: Clarify lot 1 southwest survey monument and add to legend. c) DS Sec.2-03.6.4.F: For any surveyable 100-year floodprone limits if applicable, show frequent ties to intersecting lot lines. It was stated in response letter that ties to intersection lot lines were provided although no floodplain lines are shown. Show any 100-yr floodplain line that enters the plat boundary from any jurisdictional flows from Drexel Road. d) DS Sec.2-03.6.5.C.3: Provide closure sheet for project boundary with error calculation. 9) DS Sec.2-03.6.4.I: If 100-year ponding limits and basin common area delineation are the same ponding limit line may be deleted from the final plat. All lines must be surveyable. Show minimum geotechnical setback within basin common area. 10) DS Sec.2-03.6.3.D: Address the following for the Recording Data paragraph: a) Fill in the requestor's name for the Recording Data section on sheet 1. "… Filed for record at the request of (fill in name)____________________________ b) Also add a signature line for the Deputy County Recorder per this section of the standards. 11) DS Sec.2-03.6.3: Consider revising the Approvals section due to more recent directive: The City Clerk, Kathleen S. Detrick, is retiring. Effective February 2, 2008, all correspondence for the City Clerk should be addressed to Roger W. Randolph per the City Clerk's Office. Mr. Randolph will serve as the City Clerk until such time as a City Clerk is appointed by Mayor and Council. Revise Approvals section verbiage on sheet 1 to state: "The undersigned, Roger W. Randolph, Clerk of the City of Tucson, Arizona, hereby certifies that this plat was approved by the Mayor and Council of the City of Tucson, Arizona, on this __ day of ________, 200__. Submit complete assurance package, copy of the latest title report, revised Final Plat, copy of the revised CC&R's, and response letter. The next submittal should address all the above items.
