COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before January 7, 2009.

2. The revised tentative plat has not been submitted for review and approval. At this time zoning cannot approve the final plat until the changes that are reflected on the final plat are made on the tentative plat and new CDRC approval is granted.

3. Please contact Patricia Gehlen for any info on processing the revised tentative plat.

SUMMARY: The revised Final Plat resubmittal package included the revised Final Plat, copy of the revised CC&R's, an assurance package, copy of rezoning conditions, and response letter. Development Services Department Engineering Division does not recommend approval of the Final Plat or the assurances until the following assurance comments and remaining final plat comments are addressed.

FINAL PLAT COMMENTS:
1) DS Sec.2-03.6: The final plat must conform to the approved tentative plat in lot configuration, design, and required conditions of development. Revise layout for basins, any easements, or other features that have been revised since the last Tentative Plat revision.
2) Revise General Notes 2 and 16 for updated number of Blocks.
3) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. In response letter, state type of assurance proposed for the project. Address the following for the assurance package:
a) For the third party trust subdivision assurances, address the following comments:
i) Clarify discrepancy of Subdivider's address on page 5 of the AGREEMENT TO CONSTRUCT. This address does not match plat sheet 1.
ii) On page 4 of the AMENDMENT TO TRUST, check punctuation after the word BASIN.
iii) Assure title report is updated with any new easements. The Title Report needs to be updated to reflect all current easement information including: Dkt13302 pg1988, Dkt13302 pg557, and Dkt13302 pg552.
b) For resubmittal of the assurance package submit the following:
i) original copy of the AGREEMENT TO CONSTRUCT
ii) original copy of the AMENDMENT TO TRUST
iii) copy of original Trust Agreement
iv) copy of a sample Warranty Deed;
v) copy of the current updated Title Report.
vi) copy of the location map
4) DS Sec.2-03.6: Label each easement (type), and drainageway with the appropriate dedication notation. Specifically address the remaining comments:
a) Call out whether the PUE's are public or private.
b) DS Sec.2-03.6.4.I: Assure that the detention/retention areas are shown to match the revised Drainage Report and revised Tentative Plat, and are delineated in a surveyable and readily retraceable manner. Clarify basin areas per the revised Drainage Report, shown as a common area or an easement and identified for maintenance in the CC&R's.


For resubmittal, provide an original copy of the Declaration of Covenants, Conditions and Restrictions (CC&R's), the revised Final Plat, final Drainage Report (per Tentative Plat comment), revised assurance package, updated title report, copy of rezoning conditions, and response letter addressing all of the comments. The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(2) Title reports current within the last thirty (30) days.
(1) Executed Final Plat Double Matte Océ or Photo Mylar.
(1) * Check in the amount of $8.50 per plat page for Mayor & Council distribution made payable to the local print company of your choice or provide an account number to charge.
(1) * Check in the amount of $55.00 per plat page for recorded plat distribution made payable to the local print company of your choice or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page.
(2) Executed and notarized CC&R's document (if applicable) and Assurance Package (if applicable). One original set and one copy of each.

*Please do not combine the checks for the printing charges. They are processed at different times and require separate checks. An account number is also acceptable and you can include this information on your transmittal sheet when submitting the above listed items.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 7 - 8 weeks from the date submitted to the date scheduled for Mayor and Council approval.
