The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUMMARY: The revised Final Plat resubmittal was reviewed by Engineering. The resubmittal package included the revised Final Plat, the drainage report, copy of the CC&R's, assurance package, copy of rezoning conditions, closure calculations, and response letter. Comments from last submittal were not all addressed; assure that all comments are completely addressed prior to resubmittal. Development Services Department Engineering Division does not recommend approval of the Final Plat until the assurances and revised final plat comments are addressed.

FINAL PLAT COMMENTS:
1) DS Sec.2-03.7.1.E: Provide a copy of the revised Declaration of Covenants, Conditions and Restrictions (CC&R's) for the current proposed project that addresses the remaining comments:
a) Provide exhibits as referenced in the CC&R's.
b) DS Sec.10-02.14.3.3: Provide a revised drainage report and CC&R's for this project that addresses the remaining drainage comment: In drainage report, provide maintenance list for basin and stormdrain system and other drainage improvements. Maintenance of the proposed basin, stormdrain systems, channels, and other drainage structures shall be incorporated into a list in the revised CC&R's. CC&R's shall provide this list of maintenance recommendations for the drainage areas as outlined in the Drainage Report. The CC&R's or final plat notes shall incorporate the various drainage related conditions of rezoning or other special situations requiring permanent administration by an owners' association.
c) Provide page numbering for every and all pages of a revised CC&R's including any exhibits, table of contents, and appendix.
d) At Final Plat approval, a copy of the final Drainage Report and/or a signed original copy of the revised CC&R's will be required to be submitted to CDRC Office.
2) Under Beneficiary correct trust number to reflect assurances for trust number 8061-T.
3) Under Approval section on sheet 1, revise
4) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. In response letter, state type of assurance proposed for the project. Address the following for the assurance package:
a) Revise assurable items list to clarify that item 8: "… all off-site and onsite improvements as shown on …"
b) Add case number to each page of the AGREEMENT TO CONSTRUCT.
c) For resubmittal of the third party trust subdivision assurances, provide:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the updated assurable items list;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S07-025" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current updated Title Report.
5) DS Sec.2-03.6: Address the remaining easement comments:
a) Assure all easements as listed in the Title Report and other documents are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement on the Final Plat. Assure title report is updated with any new easements. Label each street, alley, easement (type), and drainageway with the appropriate dedication notation. Specifically address the remaining comments:
i) Include/address schedule B items 5 and 7.
ii) Update title report to include Dkt.12674 pg.262 (waterline easement) and Dkt.12769 pg.1617 (electrical easement).
b) DS Sec.2-03.6.4.K: Show offsite construction / maintenance easements required for construction of any improvements including drainage outlets as referred to in drainage concept along south boundary.
c) Clarify and distinguish the extents ingress- egress sewer pedestrian & PUE and extents of basin access drainageway maintenance easement on sheet 2.
6) DS Sec.2-03.6.5: Address the remaining boundary data / survey comments:
a) Easements shall have surveyable information provided; label additional dimensions, bearings and distances, and/or curve data for the easements located within each of the lots. Provide data and delineate stormdrain system.
b) On sheet 2, label / indicate for the distance and bearing between all monuments used as measured (M) or calculated (C) or recorded (R). Several boundary lines are not labeled.
c) Show easement for the stormdrain system per the drainage report. This must be shown as a common area or an easement and identified for maintenance in the CC&R's.
7) DS Sec.2-03.6.1.D.2: Check location map to see that all entities are identified within the square mile area, such as all subdivisions, major streets, major watercourses, and railroads. Reference recorded subdivision plats by book and page numbers. Add La Estancia.
8) DS Sec.2-03.6.1.L: Address the following legend comments:
a) Clarify / provide in the legend linetypes used on the drawing, including utility easement centerline.
9) DS Sec.2-03.6.2.A: Address the remaining General Note comments:
a) Clarify General Note 13 to state that the lots are subject to drainage maintenance responsibility for the stormdrain system and common area.
b) Clarify general note 1 for the gross area to match closure calculations and clarify project area as well.
10) DS Sec.2-03.6.4.E: Show required dimensioned setbacks, such as erosion hazard, drainage, etc. At minimum, the setbacks from the basin shall be drawn per geotechnical recommendations.
11) In drainage report, provide maintenance list for basin and stormdrain system and other drainage improvements. This list shall be incorporated in the revised CC&R's.
12) DS Sec.2-03.5.2: Regarding improvements to the site, please be aware that permits are required:
a) A grading plan is required for the improvements at the site. The spine roads and stormdrain system as well as the basin in common area A, will require a separate grading permit and shall be completed prior to release of any lots.
b) A right-of-way permit is required for any development, excavation, or construction activity within the right of way. Contact Tucson Department of Transportation - Permits and Codes Section, Engineering Division at 791-5100 for questions relating to right of way permit information.
13) Submit the revised Final Plat addressing all of the comments. Include the revised drainage report, the revised CC&R's, additional notarized offsite improvement authorizations, revised assurance package, updated title report, copy of rezoning conditions, and response letter thoroughly explaining each comment.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The Zoning Review Section approves the final plat for this subdivision, subject to the following changes on the executed final plat. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

2. The final plat is conditionally approved pending final approval of the tentative plat. Per permits plus it does not appear that the tentative plat has been approved. Any changes made to the tentative plat that affect the final plat must be made prior to final mylar submittal.

3. Review the easements and annotations and ensure that ingres/egress is provided to all lots. Some of the easements are labeled for access to the detention basin and drainageway but are not labeled for ingress/egress.

Review and revise as necessary to ensure proper and legal access.

4. Label where required the one-foot no access easement along the Wilmot Road boundary.
