SUMMARY: The Final Plat submittal was reviewed for code compliance and against the rezoning conditions. Development Services Department Engineering Division does not recommend approval of the Final Plat until the assurances and revised final plat comments are addressed.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.7: Submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat. Assure that the final plat reflects approved tentative plat entities and layout.
2) DS Sec.2-03.7.1.D: Address the following rezoning comments:
a) Rezoning condition 32 requires a common area or PAAL adjacent to the basin; the adjacent easement shown should also be labeled as a basin access easement.
b) Provide copy of rezoning conditions in next submittal and assure any other final plat related rezoning conditions are addressed.
3) DS Sec.2-03.7.1.E: Provide a copy of the Declaration of Covenants, Conditions and Restrictions (CC&R's) for the current proposed project that addresses the following comments:
a) Provide exhibits as referenced in the CC&R's.
b) DS Sec.10-02.14.3.3: Provide a revised drainage report or CC&R's for this project that addresses the following:
i) Revise section 3.6 in the existing CC&R's or provide verbiage in the Drainage Report for describing requirements of the certified annual report for maintenance of the proposed basin, stormdrain systems, channels, and other drainage structures, using the drainage maintenance verbiage from DS Sec.10-02.14.3.3.
ii) CC&R's shall provide the list of maintenance recommendations for the drainage areas as outlined in the Drainage Report or as provided by the engineer and accepted by the City of Tucson DSD Engineer. Assure that the Drainage Report or CC&R's are revised to include a maintenance checklist as provided in the Drainage Report from the approved Tentative Plat. The CC&R's or final plat notes shall incorporate the various drainage related conditions of rezoning or other special situations requiring permanent administration by an owners' association.
iii) Provide easement maintenance verbiage in the CC&R's or on Final Plat note, that all erosion protection, drainage improvements, and revegetation in all easements shall be the responsibility of the Homeowners Association, per recent City Attorney directive.
c) Consider providing a table of contents for the CC&R's.
d) Provide page numbering for every and all pages of a revised CC&R's including any table of contents and appendix.
e) Add Subdivision case number S07-025 to first sheet of revised CC&R's.
f) At Final Plat approval, a copy of the final Drainage Report and/or a signed original copy of the revised CC&R's will be required to be submitted to CDRC Office.
4) DS Sec.2-03.6.4.C: Basin shall be provided within a common area. Label the common area with a letter designation. Enclose with a solid line around the common area and provide square footage of area.
5) DS Sec.2-03.9.3.B: Provide seal on each sheet of the plat.
6) DS Sec.2-03.6.3 For Final Plat approval, all the signatures for each dedication and certification will be required. All signatures must be in permanent, black, india ink and be accompanied by a notary signature and seal.
7) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. In response letter, state type of assurance proposed for the project. Submit the following for the assurance package:
a) If a third party trust is proposed for the subdivision assurances, provide:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S07-025" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current Title Report.
vii) The assurance descriptions shall match the title block description on the first sheet of the Final Plat. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
b) For basins located within a common area, revise title block to reflect the basin in common area description.
c) For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
8) DS Sec.2-03.6: Address the following easement comments:
a) If easements are shown to cross proposed lot structure foot print locations, or proposed layout causes conflicts with the status of the easement, the easements may need to be physically abandoned and shall have a docket and page indicating that they are extinguished prior to approval of the Final Plat.
b) Assure all easements as listed in the Title Report and other documents are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement on the Final Plat. Label each street, alley, easement (type), and drainageway with the appropriate dedication notation. Specifically address the following:
i) Include/address schedule B items 5 and 7.
ii) Show the correct TEP easement recording information.
c) DS Sec.2-03.6.4.K: Show offsite construction easements required for construction of any improvements including drainage outlets.
9) DS Sec.2-03.6.5: Provide accurate dimensions, bearings, or deflection angles and radii, arcs, and central angles of all curves and lines. Address the following boundary data / survey comments:
a) Each utility easement shall have surveyable information provided; label additional dimensions, bearings and distances, and/or curve data for the easements located within each of the lots.
b) Verify bearing south of east quarter corner section monument and SE corner of section 24.
c) Add crow's feet to distance "519.27".
d) Add delineation from south end of "519.27" to southeast corner of property.
e) Check/clarify commercial entrance radii.
f) DS Sec.2-03.6.5.C.1.a: Label on planview "Basis of Bearings"
g) DS Sec.2-03.6.5.C.3: Provide closure sheet for project boundary.
h) On sheet 2, label / indicate for the distance and bearing between all monuments used as measured (M) or calculated (C) or recorded (R).
i) DS Sec.2-03.6.5.C.4.a: Fully describe and show all markings on found monuments.
j) DS Sec.2-03.6.4.I: The basin 100-year ponding limits must be drawn in a surveyable, retraceable manner within the common area.
k) DS Sec.2-03.6.3.A: Explain on the plat why 2 survey seals are provided.
10) DS Sec.2-03.6.1.D.2: Check location map to see that all entities are identified within the square mile area, such as all subdivisions, major streets, major watercourses, and railroads. Reference recorded subdivision plats by book and page numbers. Add Desert Stone, La Estancia, Old Rodeo ERZ Wash, and Wilmot Road.
11) DS Sec.2-03.6.1.L: Address the following legend comments:
a) Provide in the legend linetypes used on the drawing, including centerline and easements.
b) Clarify monuments to be set or found.
12) DS Sec.2-03.6.2.A: Address the following General Note comments:
a) Add the following as Final Plat General Notes:
i) Include verbiage: "This plat is subject to the conditions of rezoning case number C9-01-05, unless superseded by a subsequent rezoning ordinance."
ii) DS Sec.2-03.6.2.I: "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."
iii) DS Sec.2-03.6.2.E: If subject to floodplain or EHS requirements, add the following note: "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Lots 1 and 6."
b) Revise General Note 6 to state "…approval of the City of Tucson." "
13) DS Sec.2-03.6.3: Update year references on plat to 2008.
14) DS Sec.2-03.6.3.B.2.c: Under Dedication section on sheet 1 check verbiage in fourth paragraph: "Drainageways and common areas, as shown hereon, are reserved for the private use and convenience of all owners of property within this subdivision and are granted as easements to the Public and all utility companies for the purposes of access, installation, and maintenance of utilities, drainage, and public sewers. Title to the land of all private streets, drainageways, and common areas shall be vested in an association of individual lot owners as established by Covenants, Conditions, and Restrictions recorded in Docket ____ at Pages ____ through ____ in the office of the Pima County Recorder. The association will accept responsibility for control, maintenance, and liability for the private streets, drainageways, private sewers, and common areas within this subdivision."
15) DS Sec.2-03.6.4.E: Show required dimensioned setbacks, such as erosion hazard, drainage, etc.
16) Submit the revised Final Plat addressing all of the comments, the drainage report, the revised CC&R's, additional notarized offsite improvement authorizations, assurance package, copy of rezoning conditions, and response letter thoroughly explaining each comment.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

1. Sheet 1: In the Dedication Block, third paragraph, first line after the word PUBLIC add the words ,PIMA COUNTY.

2. Sheet 1: Include the beneficiary of Trust # 8061 and 8062T.

3. The Final Plat cannot be approved until the Tentative Plat has been approved.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the . The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.
The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.
