COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of application to obtain approval and recordation of a final condominium plat that complies with zoning and other development requirements in effect at the time of application. This final condominium plat must be approved and recorded on or before February 9, 2008.

2. Case number S07-022 has been assigned to this final plat. Please place this number in the right corner of all sheets of the final plat.

3. Please provide a small project location map in the upper right corner of the first sheet of the plat at a scale of 3"=I mile. The location map shall show the subject property approximately centered within one (1) square mile area. Conditions such as subdivisions (referenced by recorded book and page), major streets, and railroads are to be shown. Provide the section, township, and range; section corners; north arrow; and scale.

4. The property may be subject to conditions of rezoning case C9-69-55, ordinance number 3693. Please verify if there exists applicable conditions of rezoning for this site. If conditions apply please provide a separate letter detailing compliance to the rezoning conditions.

5. This site may be subject to the Pueblo Center Redevelopment Project, Urban Renewal Plan adopted by Mayor and Council, November 8, 1965. This document provides design criteria such as permitted uses, maximum densities, lot coverage, FAR, maximum building height, minimum open space, off street parking requirements, and off-street loading requirements. At this time staff is determining whether this document is part of rezoning conditions and/or a development agreement. The City Attorney's Office has been advised of the Plan and will be providing a determination as to its applicability and administration.

6. Please add the following note to the final plat. "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public".

b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.
1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.

ALL SHEETS. Add the project number, SO7-022, to the title block of each sheet. This number should be shown larger or bolder than any other cross reference numbers.

SHEET 1. Add a General Note that states:

The next submittal must address the following items:

FINAL PLAT COMMENTS

1. On sheet one of the final plat provide a location map that meets the criteria found in DS 2-03.6.1.D.

2. Provide the subdivision case number, S07-022, in the lower right hand corner of each sheet. DS 2-03.6.1K.

3. Remove all the line weight representing floor plan information. This office acknowledges the intent is to clarify, however this is a survey document and site/building plan information should not be provided on the plat.

4. In addition to the above comment, in regards to common element "A" remove the floor/site plan information and the labeling for mechanical equipment, lower court, transformer vault, electrical equipment, etc. The common element only requires, bearings, dimensions and ties. Revise appropriately.

5. When referencing the limited common element only provide bearings, dimensions and square footage. Remove from the plat view any descriptions of the limited common element, i.e balcony, restrooms, deck, etc.

6. Add the following note, "Any relocation, modification, etc., of existing utilities and/or public improvement necessitated by the proposed development will be at no expense to the public."

7. For clarity provide on sheet 1 adjacent to the list of sheets; provide a list indicating the square footage of common element "A" and the limited common elements with reference to the floor the common element resides on for each sheet.

8. Revise the Final Plat Standard paragraphs on the first sheet so that they are listed in the following order for better understanding and clarity DS Sec.2-03.6.3:

10. Indicate on the plat if the shown existing easements are public or private.

11. Item 5 and 6 on the title report states the easement is a "gas and electric easement." Where the plat only shows the easement to be an electric easement. The description of the easements in the title block should match the description of the easement provided on the plat. Revise the document(s) to match.

12. There are several easements listed in the title report that are not shown on the plat. The easements shown in the title report must match what is provided on the plat. The following list is the easements found in the title report but not provided on the plat. Revise the documents to match.

13. Describe in the response letter the easement agreement, Docket 5276 Page 691. If it is general easement provide the description in a general note. If the easement pertains to something specific, graphically show the easement on the plat.

14. Provide the docket and page for the overhead easement shown on sheet 3 or remove as the overhead easement is not part of the parcel.

15. There are four easements shown on the plat that are not described in the title report. The easements provided on the plat must be the same easements described in the title report. 16. Clarify in the response letter the area on sheet 5 labeled, "Unexcavated," and revise or remove from the plat.

17. On sheet 4, at the southeast corner of building 10 revise the overlay to not show the dimensions overlapping.

18. On sheet 4, at the west side of building 10, provide the missing dimensions for the limited common element.

19. On sheet 4, darken the line weight for building 2 and 4 on the west side of the structure. It is difficult to determine the building footprint.

20. Remove the verbiage from sheet 4, "Area of future development."

21. Remove on sheet 4 the line weight for the excluded parcel and the line weight or clarify why this information is provided when it is not part of the plat.

22. Remove the verbiage "BLDG 9 Excluded," from sheet 6, 7 and 9.

23. Provide the scale for all sheets indicating the volume; sheets 10 - 21.

24. On sheet 7, building 8, provide the dimensions for the lines that divide the building into three suites.

25. Provide dimensions for building 8, on sheet 8, for the line between the 18.8' and 41' dimensions, adjacent to the common element and for the lines between 8.3' and 16'.

26. On sheet 8, building 2, provide the curve data and dimensions for the lines between the 14.9' and 45.7' dimensions.

27. On sheet 4, building 4, provide dimensions between 24.5' and 59.7' dimensions.

28. Sheet 7, on the east side of building 3, common element A is missing lines and dimensions. Clarify and/or provide lines and dimensions for common element A.

29. On sheet 16 provide dimensions for Unit 50, Suite 5230 or clarify in the response letter why dimensions are not provided.

30. On sheet 18 of 21 provide dimensions for Unit 68, Suite 6429 or clarify in the response letter why dimensions are not provided.

31. For consistency provide the same font size for the title block on sheets 18 - 20, found on sheets 1 - 17 and 21.

32. On sheet 20 provide dimensions and solid lines to delineate the boundary of suite 6320 or clarify why the dimensions and lines are not provided.

33. On sheet 21 provide all the dimensions for both limited common elements for unit 40.

34. Provide the width for Broadway Boulevard and Church Avenue, label public or private. DS 2-03.6.4.A.

35. Corner tie information is to be provided on the plat. At least one corner of the subdivision must be tied by course and distance to a section corner or a quarter section corner. The plat must include a description of that corner marker and an indication of how the bearings were determined. Provide the corner tie recordation information on the plat. DS 2-03.6.5.A.

36. The structures must be tied to the boundary of the site. Building 3 is not tied to another building or the boundary of the site. Revise the plat to show a tie for building three. DS 2-03.6.5.

37. If applicable show no-vehicular access easements. DS 2-03.6.1.6.4.H.

38. Depending on how each comment has been addressed, additional comments could be forthcoming.
