SUMMARY: The revised Final Plat sheets, a copy of the title report, CC&R's, geotechnical report, assurances, closure calc sheet, and response letter were received by Engineering for review. Engineering recommends conditional approval of the assurances and Final Plat. Contact CDRC as to whether the items below may be addressed at mylar stage.

FINAL PLAT AND ASSURANCES CONDITIONS OF APPROVAL:
1) City of Tucson Development Standards (DS) Section No.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are reviewed and approved. Address the following for the assurance package:
a) For the third party trust, address the following:
i) Address the following comments for the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST:
(1) Correct assurable item 3 to reflect "public water system …", not sewer, acceptable to Tucson Water.
(2) Revise the assurable items list to include an item for "all off-site and on-site improvements as shown on the Tentative Plat, Final Plat, and Improvement Plans".
(3) Clarify "%" sign in item 24 on page 4, before subdivider's address.
ii) Fill in the case number "S06-270" bottom of pages of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iii) Attach and provide page number for the exhibit A to the AMENDMENT TO TRUST;
iv) Add case number "S06-270" to Exhibit "A" of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
v) Clarify whether the exhibits for the Agreement to Construct need page numbers.
vi) After revising the assurance documents, submit a compiled revised set of original assurances to CDRC, including: original copy of the, original copy of the , copy of the original Trust Agreement, copy of the sample Warranty Deed, copy of the current Title Report, and a location map.
2) DS Sec.2-03.6.3.C: Under the BENEFICIARY block, correct verbiage to clarify by stating that the "Beneficiaries of (Title Company Name and Trust Number) are (Names and Addresses)."
3) DS Sec.2-03.7.1.E: Assure the remaining comments are addressed for the CC&R's:
a) Provide page numbering for every and all pages of a revised CC&R's including any table of contents and appendix for CDRC processing.
b) At Final Plat approval, an original copy of the signed revised CC&R's will be required to be submitted to CDRC Office.
4) DS Sec.2-03.6.5.B: Check discrepancy for bearing labeled north of lot 16 on sheet 1 and sheet 2.
5) DS Sec.2-03.6.4.A: Add a note to Final Plat cover sheet stating that Common Area "C" along east boundary (or identify correct location) contains an underground fiber optic cable; all work within this easement must be coordinated with the proper utilities prior to any site construction.
6) For legibility, correct the text overlap for details on sheet 2.

The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(1) Executed Final Plat Double Matte Océ or Photo Mylar.
(1) * Check in the amount of $8.50 per plat page for Mayor & Council distribution made payable to the local print company of your choice or provide an account number to charge.
(1) * Check in the amount of $55.00 per plat page for recorded plat distribution made payable to the local print company of your choice or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page.
(2) Executed and notarized CC&R's document (if applicable)(one original and one copy).

*Please do not combine the checks for the printing charges. They are processed at different times and require separate checks. An account number is also acceptable and you can include this information on your transmittal sheet when submitting the above listed items.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 7 - 8 weeks from the date submitted to the date scheduled for Mayor and Council approval.
