The title report, geotechnical report, CC&R's and assurances were not in the submittal package and are needed for review. In the response letter, the CC&R's are still being prepared. Engineering does not recommend approval of the Final Plat at this time. Address the following comments prior to resubmittal. FINAL PLAT COMMENTS: 1) City of Tucson Development Standards (DS) Section No.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are reviewed and approved. In response letter, state type of assurance proposed for the project. Submit the following for the assurance package: a) If a third party trust is proposed for the subdivision assurances, provide: i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list; ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST; iii) assure that all exhibits are attached, and the case number "S06-270" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST; iv) copy of the original Trust Agreement; v) copy of a sample Warranty Deed; vi) copy of the current Title Report. vii) The assurance descriptions shall match the title block description on the first sheet of the Final Plat. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. b) For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats. 2) DS Sec.2-03.6.3: Consider revising the Approvals section due to more recent directive: The City Clerk, Kathleen S. Detrick, is retiring. Effective February 2, 2008, all correspondence for the City Clerk should be addressed to Roger W. Randolph per the City Clerk's Office. Mr. Randolph will serve as the City Clerk until such time as a City Clerk is appointed by Mayor and Council. Revise Approvals section verbiage on sheet 1 to state: "The undersigned, Roger W. Randolph, Clerk of the City of Tucson, Arizona, hereby certifies that this plat was approved by the Mayor and Council of the City of Tucson, Arizona, on this __ day of ________, 200__. 3) DS Sec.2-03.7.1.E: The following comments will be reviewed with submittal of CC&R's: Provide a copy of the Declaration of Covenants, Conditions and Restrictions (CC&R's) for the proposed project that addresses the following comments: a) DS Sec.10-02.14.3.2: Provide basin and drainage facility maintenance verbiage per this section of the standards, as General Note 19 provides only partial completion of this requirement. b) DS Sec.2-03.6.6.A: The CC&R's or Final Plat shall include verbiage regarding basin and drainage maintenance per section DS Sec.10-02.14.3.2. Add verbiage to the CC&R's to, or assure general notes on the Final Plat include all of the following statements: (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. c) DS Sec.10-02.14.3.3: Provide verbiage in the CC&R's for describing requirements of the certified annual report for maintenance of the proposed basin and other drainage structures. d) DS Sec.10-02.14.3.3: Assure that the CC&R's are revised to include a maintenance checklist as provided in the Drainage Report from the approved Tentative Plat. Provide copy of the Drainage Report in resubmittal. e) DS Sec.2-03.7.1.D: The CC&R's or final plat notes shall incorporate the various drainage related conditions of rezoning or other special situations requiring permanent administration by an owners' association. f) Provide easement maintenance verbiage in the CC&R's or on Final Plat note, that all erosion protection, drainage improvements, and revegetation in all easements shall be the responsibility of the Homeowners Association, per recent City Attorney directive. g) Consider providing a table of contents for the CC&R's. h) Provide page numbering for every and all pages of a revised CC&R's including any table of contents and appendix for CDRC processing. i) Add Subdivision case number S06-270 to first sheet of revised CC&R's. j) At Final Plat approval, an original copy of the signed revised CC&R's will be required to be submitted to CDRC Office. 4) DS Sec.2-03.6.4.E: The following comment will be reviewed with submittal of geotechnical report: Show required setbacks, such as erosion hazard, drainage, etc. Specifically address the following: a) Label and delineate setbacks from basins to location of future buildings per geotechnical report. 5) DS Sec.2-03.6.5.C: The following comments will be reviewed with submittal of title report: Address the following boundary comments: a) DS Sec.2-03.6.5.C.5: Some of the boundary data does not match the title report schedule B exhibit A. Clarify all bearings and distances for project boundary data as recorded, measured or calculated. b) DS Sec.2-03.6.5.C.3: Provide parcel boundary closure calculations with closing error. 6) DS Sec.2-03.6.5.A: At least one corner of the subdivision shall be tied by course and distance to a section corner or a quarter section corner. Clarify delineation tie on plan view sheets so that the tie runs to a project corner not a street monument. 7) DS Sec.2-03.6.5.B: The following comment will be reviewed with submittal of title report: Assure that all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Show or add note regarding (name/type) easement Dkt.(number) pg.(number) per Schedule B item (number). Provide dimensioning if these utility easements cross within the project boundaries, and label Bk/pg or Dkt/pg for each easement. In response letter, please state whether the items (5, 6, and 11) of Schedule B are shown on the plat. Submit revised Final Plat, a copy each of the final Drainage Report and Geotechnical Report, title report, CC&R's, assurances, and response letter. Please call me for clarifications at 837-4934.
