COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The Zoning Review Section conditionally approves the final plat for this subdivision, subject to the following changes on the executed final plat and the recorded Covenants, Conditions, and Restrictions. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

2. D.S. 2-03.6.3.D Zoning acknowledges that a prior comment asked that the Approval block be revised to show "ROGER W. RANDOLPH" as the Clerk of the City of Tucson. Please remove "ROGER W. RANDOLPH" and provide a blank space to be filled in at a later date.

3. D.S. 2-03.6.6 The provided Covenants, Conditions, and Restrictions (CC&Rs) do not address maintenance for Common Area "B" (Landscape Buffer). Revise the CC&Rs.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Regional Wastewater Reclamation Department (RWRD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUMMARY: Engineering Division of Development Services Department has received and reviewed the submitted Final Plat, Covenants, Conditions and Restrictions (CC&Rs), Assurance Package and a copy of the Title Report. Engineering Division recommends conditional approval of the Final Plat at this time. Prior to Mylar submittal the following items need to be addressed:

FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.3.A: DS Sec.2-03.6.3.A: For Final Plat Mylar approval the Certificate of Survey section must be sealed and signed by the Land Surveyor, Todd Hout prior to Mylar submittal. For future projects if the registrant does not want to sign the seal that is required on the document until Mylar submittal than the word "Preliminary" must be used across the registrants seal for initial review.

Per the Rules of the AZ State Board R4-30-304.D.1 A registrant shall sign, date, and seal a professional document:

1. Before the document is submitted to a client, contractor, any regulatory or review body, or any other person, unless the document is marked "preliminary," "draft," or "not for construction" except when the document is work product intended for use by other members of a design team; and

2. In all cases, if the document is prepared for the purpose of dispute resolution, litigation, arbitration, or mediation.

Provide on the Final Plat Mylar the seal and signature for the Land Surveyor, Todd Hout, which is shown in the Certificate of Survey Section.

2) DS Sec.2-03.6.3.B.1: It is acknowledge that the word "title" has been removed from the language however the word "record" was added in its place. Revise the Final Plat and the Certificate of Title paragraph in the Dedication Section to remove the word "record" prior to the word interest. The paragraph must read exactly as stated within the referenced section.


GENERAL COMMENTS:

Provide the revised Final Plat Mylar Set to CDRC for review and approval prior to submittal to Mayor and Council. The Final Plat Mylar must address the comments provided above. Be advised that if all comments have not been addressed at the Mylar stage this will cause a delay in the Mayor and Council submittal.

The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(2) Title reports current within the last thirty (30) days.
(1) Executed Final Plat Double Matte Océ or Photo Mylar.
(1) * 81/2"X11" copy of plat and (3) 11"X17" copies of the plat
(1) * Check in the amount of $55.00 per plat page for recorded plat distribution made payable to the local print company that has access to Pima County Recorders on line platting system or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page and fees for consent(s) to dedicate, if applicable.
(2) Executed and notarized CC&R's document (if applicable) and Assurance Package (if applicable). One original set and one copy of each.


Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 7 - 8 weeks from the date submitted to the date scheduled for Mayor and Council approval.
