COMMENTS: The following comments are for the purpose of applying for a variance before the Board of Adjustment.


1) The lot is located in the HO-3 zone and the Development Designator is "L" (LUC Section 2.4.3.2.D.1). The minimum lot size for the zone is five thousand (5000) square feet (LUC Section 3.2.3.1.C). The Perimeter Yard Indicator is BB and the required setback for a building adjacent to interior lot line is equal to the height of the structure's wall, measured from the ground to the highest of that wall facing the property (LUC Section 3.2.6.4).

2) Please be aware that the minimum lot size is five thousand (5000) square feet for a residential lot in this zone (LUC Sections 2.4.3.2.D.1 and 3.2.3.1.C). You may apply for a Residential Cluster Project (RCP) (LUC Section 2.4.3.2.D.2 [RCP-8 LUC Section 3.2.3.1.F] subject to 3.6.1). You may also convert this duplex to a condominiums with a Final Plat for condominiums (LUC Section 4.1.9 and Development Standards 2-03).

3) The purposed lot split divided the current lot of five thousand five hundred eighty seven (5587) square feet into two lots, one with two thousand eight hundred forty seven (2847) square feet and the other with two thousand seven hundred forty (2740) square feet.

4) The minimum setback between each structure and the property line must equal the height of the structure's wall, measured from the ground level to the highest point of each wall, facing that property line (LUC Sections 3.2.3.1.C & 2.2.6.4). The setbacks to the purposed property line shall be zero between the units of the duplex.

5) Please be aware that this site is in the Historic Zone and this purposed split should be presented to Frank Podgorski to check for any issues relative to this historic zoning.
