submitted November 14, 2006. TEP is unable to approve the plat at this
time.



In order for this TEP to approve the final plat, the following is
required:

replacing repairing and maintenance of electrical meters, cable and
conduits, which grouped electrical meters are attached to the exterior
walls."



Show these requirements on the re-submittal of the plat and submit one

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of application to obtain approval and recordation of a final condominium plat that complies with zoning and other development requirements in effect at the time of application. This final condominium plat must be approved and recorded on or before November 13, 2007.

2. Case number S06-239 has been assigned to this final plat. Please place this number in the right corner of all sheets of the final plat.

3. On the 2005 aerials what appears to be a small shed is shown within Common Element "A" at the rear of unit 4 and 5. Please indicate if this structure has been removed or still exists. If existing please add the building footprint to the final plat, labeling its use and if it is to be something other than a part of Common Element "A". Because this structure was not part of the original site plan, provide a copy of the last approved site plan or other document that approved it.

4. Please remove general note 1, 2, and 4. These notes are typically provided on tentative plats.

5. Revise general note 5 to read "The gross area of this subdivision is 0.428 acres".

8. Please indicate if parking spaces within carports are to be assigned to individual units. 9. Please provide a copy of the CC&Rs which establishes responsibility for construction, maintenance, liability, and ownership of the proposed common and exclusive elements.

10. Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.
a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.
b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.
1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.

SUMMARY: The Final Plat and CC&Rs were received by Engineering on November 14th, 2006. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs.

SUBMITTAL REQUIRED: ASSURANCES, BOUNDARY CLOSURE CALCS, TITLE REPORT

The next submittal must address the following items:

GENERAL COMMENTS

1. The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. The complete assurances package must include a copy of the original trust, the original amendment to trust with exhibit A, the original agreement to construct with exhibit B, a copy of the warranty deed, a current title report and a location map on an 8 ½ x 11 sheet. DS 2-03.7.1.G

FINAL PLAT COMMENTS

1. Provide the subdivision case number in the lower right hand corner of each sheet. DS 2-03.6.1.K.

2. Revise the Final Plat Standard paragraphs on the first sheet so that they are listed in the following order for better understanding and clarity DS Sec.2-03.6.3:

1. Dedication Paragraph
2. Acknowledgement Paragraph
3. Approval Paragraph
4. Recordation Data Block Paragraph
5. Assurance Block
6. Certification of Survey

3. Comment number 6 from the Zoning Review requested a beneficiary block per DS 2-03.6.3.C. Beneficiary block is not required when there is no requirements for assurances. Verify that this project will not have a requirement for assurances and clarify in the response letter. If assurances are required provide the beneficiary block.

4. Clarify the hatching inside the buildings on sheet 3-5. The hatching is not identified in the legend. Is the hatching necessary? Clarify and if the hatching is not indicating survey information remove.

5. A final plat is a survey document only and should not have any site plan information on it. Remove from the plan view the verbiage, "1-story brick." Also remove the unit addresses from the structures and the verbiage in the legend.

6. This property is effected by the 100 year floodplain. The 100 year floodplain limit must be shown on the plat in a surveyable and readily retraceable manner with frequent ties to lot lines. Revise the plat appropriately. DS 2-03.6.4.F.

7. It is not clear why the profiles, total square footage, average height and cubic volume for units 4, 5 and 6 are provided on two separate sheets (sheet 4 and 5). It is highly recommended to provide this information on sheet 3. Revise as requested.

8. The legend shows a 1 foot no vehicular access easement, however on the plan view a no vehicular access easement is not on the plan. Clarify or revise plan appropriately. DS 2-03.6.4.H.

9. At least one (1) corner of the property will be tied by course and distance to a section corner, a quarter section corner, or an established City survey monument. The plan must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plan. Tie down one of the corners of the proposed lots to the provided basis of bearing. DS 2-03.6.5.A.

10. Provide bearings for the dimension from the centerline of Columbus Blvd to the east boundary line. DS 2-03.6.5.B.

11. A "Basis of Bearings" statement has not been provided on the plat. If the monuments at each end of the reference line are fully described on the plat. They need not to be described in the "Basis of Bearings" statement. THE monuments have not been fully described. Fully describe the 2 monuments for basis of bearing and all other found monuments shown on the plat. DS 2-03.6.5.C.1 and 4.

12. Indicate if the easements shown on the plat are public or private. DS 2-03.6.4.A.

13. The structures must be tied to the boundary of the site. Provide bearing for each tie dimension. DS 2-03.6.5.

This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

ALL SHEETS. Add the project number, S06-239, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers.

SHEET 1. Add a General Note that reads:

This is an apartment (duplexes) to condominium conversion project. The onsite sewers, except the public sewers within the public sewer easements, are existing and private. No new sewer lines are proposed.

SUBJECT TO THE ABOVE, The Pima County Department of Environmental Quality and the Wastewater Management Department hereby CONDITIONALLY approve the above referenced submittal of the Final Plat as received by us on November 13, 2006. The revisions may be shown on the mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality Department.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating, or engaging in any activity which may cause or contribute to air pollution.
