time.



In order for this TEP to approve the final plat, the following is
required:

Docket-11612 at Page-2567.
* Add the following paragraph to the dedication:

"An easement is granted for the purpose of access, installation
replacing repairing and maintenance of electrical meters, cable and
conduits, which grouped electrical meters are attached to the exterior
walls."



Show these requirements on the re-submittal of the plat and submit one
copy of the plat to the City of Tucson for TEP's final approval.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of approval of condominium final plat to obtain approval that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before November 1, 2007.

2. CDRC case number S06-209 has been assigned to this final plat. Please place this number in the right corner of all sheets of the final plat.

3. Per aerials there are existing carports currently cover existing parking spaces. Please provide copies of permits and site plan that approved the installation of all carports currently on site. If none exists then the carports must be permitted prior to approval of the final plat. Permitting carports may require additional requirements such as:
a) Board of Adjustment to allow detached accessory structure to extend into front yard area.
b) Carports most likely will trigger requirements (20% of value) for accessibility upgrades to some of the units per structural review.
c) Carports may have to be fire rated is built to close to existing structure per structural review.
d) Review by traffic for type of carport (should be cantilevered) for access in and out of vehicles or parking spaces may be required to be widened (DS 3-05.2.1.B.2).

4. Those areas such as patios, storage closet, and entries, should be labeled as exclusive common elements and provided separate designation on plat. Stairwells are to be labeled as limited common elements and be provided with a separate designation on the plat. Square footage, cubic volume should be provided according. If included in current table then they should be further broken down to individual limited common elements.

5. The use of Common Area "A" should be specified in title block as possibly vehicle use area and landscaping. The detention basin shown on the original site plan should be designated as a separate common area since it will have separate and different restrictions and maintenance requirements in the CC&Rs. Please label as Common Area "B" detention basin and include in title block. The CC&Rs are to reflect this change and provide specifics in responsibility and maintenance requirements of detention basin. Revise general note 6 to include additional common area square footage.

6. Please provide an affidavit stating that the subdivision has provided or will provide written notice of the subdivider's intent to convert to all tenants of units to be converted, beginning not less than one hundred twenty (120) days prior to the date on which the first unit is offered for sale, and will continue to provide such notice to prospective tenants until all units have been sold.

7. Please provide an affidavit stating that the subdivider will provide existing tenants an exclusive right to purchase the unit the tenant leases at a price which is not more than the price at which the subdivider intends to offer the unit to the general public for a period of not less than sixty (60) days from the date a tenant's units is offered for sale.

8. Please provide an affidavit that the subdivider will provide to each tenant, who has indicated to the subdivider his/her intention not to exercise his/her right to purchase, a written statement listing at least three (3) rental units unique to that tenant of comparable size and price to the unit occupied by the tenant.

9. Please provide an affidavit stating that the subdivider will provide to tenants a relocation payment of three hundred fifty (350) dollars per residential unit to be paid prior to termination of the tenants occupancy, including written notice of the availability of such payment prior to termination, provided that:
a) The tenant has occupied his unit for at least two (2) years prior to the date on which the tenant was eligible to receive a notice of intent to convert pursuant to Sec. 4.1.9.1.A.
b) The tenant has made a written request to the subdivider for the relocation payment.
c) The tenant has a total annual income at or below maximum eligibility limits established by the U.S. Department of Housing and Urban Development for the participation in the Section 8 Housing Assistance Payments Program or is sixty-two (62) years of age or older.

10. Please provide an affidavit stating that the units to be converted meet the applicable standards of the Housing Code, Tucson Code, Chapter 16.

11. Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.
a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.
b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.
1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.

1. Provide a table of contents for the CC&R's.

2. Submit revised copies of the CC & R's that specifically address the maintenance of the drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in detail (i.e. what facilities to be inspected and maintained, how, when, by whom, the retention basin maintenance list, record keeping and repair decisions, etc). Please be advised that this Office recommends including the Retention maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities. SMDDFM 14.03.2.


FINAL PLAT COMMENTS

1. Provide the subdivision case number S06-209 on all sheets. DS 2-03.6.1.K.

2. Add a note to the plat stating this development is affected by FEMA Flood Zone AE, any development within the flood hazard area will be subject to floodplain requirements. DS 2-03.6.2.E.

3. It is understood the assurances will not be required because the entire project is existing. However the Assurance block and signature line found under DS 2-03.6.3.E. shall be provided on the fist sheet plat of the plat. Revise appropriately.

4. When a final plat is a condominium conversion common areas are referred to as "Common Elements." "Common elements" means all portions of a condominium other than the units. Change all references to "area" to "elements." Revise the plat appropriately. A.R.S. 33-1202

5. Common Element A should fully be described in the title block. Revise appropriately. DS 2-03.6.4.C.

6. The detention basins must be defined separately from Common Element A. Revise the title block and general note number 6 appropriately. DS 2-03.6.4.C.

7. Show the limits of the 100 year flood prone area in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines. DS 2-03.6.4.F.

8. If applicable show no-vehicular access easements. DS 2-03.6.4.H.

9. Show the detention basin in a surveyable and retraceable manner. DS 2-03.6.4.I.

10. Along the west boundary line, show the distance, between the set ½" iron pin tagged RLS 31025 to Found ½ " iron pin RLS 25405. DS 2-03.6.5.C.5.

11. Areas (storage, patios, balconies, parking spaces) that are exclusive to the property owner must be defined as exclusive common elements. Square footage, cubic area, dimensions and possibly bearings must be provided on the plat. Revise appropriately.

13. Provide a dimension between the exterior and the interior wall. DS 2-03.6.4.D.

This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

1. This project will be tributary to the Roger Road Wastewater Treatment Facility via the South Rillito - West (South Line) Interceptor. Per written guidance provided by the PCWMD Development Services Section, this apartment to four-plex condominium conversion project, with existing private sewers and no new sewer construction, will not require a formal capacity response letter.

2. All Sheets: Add the subdivision case number, S06-209, to the title block of each sheet. This number should be shown larger or bolder than any cross reference numbers. No wastewater review fees will be charged for sheets where this is the only required revision.
